Dead Seabirds Do Tell Tales: How Fishery Observers Help Provide Data for Seabird Management

March 26, 2019 — The following was released by NOAA Fisheries:

Sometimes during regular fishing operations, seabirds accidentally get caught in fishing gear, resulting in injury or death. While this occurrence (also known as bycatch) is unfortunate, it does provide an opportunity to monitor seabird population characteristics and trends over time.

Observers deployed by the North Pacific, Pacific Islands and At-Sea Hake Observer Programs collect seabird bycatch. NOAA’s National Seabird Program works with the nonprofit organization Oikonos to conduct seabird necropsies. Collection of albatross, shearwater, and fulmar carcasses would be impossible without the cooperation of fishermen, observers, and observer program staff members.

What Information Do We Retrieve from Seabird Bycatch Carcasses?

From September 2017 to August 2018, Oikonos sampled a total of 206 seabird carcasses. Scientists and volunteers worked together to:

  • Identify bird species, age, sex, and health status.
  • Complete a variety of important measurements.
  • Support seabird diet studies through the analysis of seabird stomach contents.

Analysts also carefully measure the quantity of plastic ingested by seabirds in order to investigate trends related to the harmful impacts of plastic pollution in the North Pacific Ocean.

How Do Managers Use This Information?

Scientists and managers use age, sex, and health data from multiple years of deceased birds to identify trends indicative of population status. Necropsies also allow scientists to see how bird populations are responding to stressors such as oil spills, disease, and environmental changes. Regional and species differences in age and sex distributions can be documented and used to understand which groups of seabirds are most vulnerable to fisheries bycatch.

For example, from September 2017 to August 2018, adult black-footed albatrosses caught in Hawaii were mostly females, while more adult males were caught in Alaska. Most seabirds that were captured in both the Alaska and Hawaii fisheries were adults. Adult mortalities can slow population growth more than mortality of juveniles that are not yet able to reproduce.

NOAA, BOEM, and Fishing Industry Sign New Memorandum of Understanding

March 26, 2019 — The following was released by NOAA Fisheries, the Bureau of Ocean Energy Management, and the Responsible Offshore Development Alliance:

NOAA Fisheries, the Bureau of Ocean Energy Management (BOEM), and the Responsible Offshore Development Alliance (RODA) signed a 10-year Memorandum of Understanding that brings local and regional fishing interests together with federal regulators to collaborate on the science and process of offshore wind energy development on the Atlantic Outer Continental Shelf.

Safe, reliable, and affordable domestic energy production powers the U.S. economy, promotes jobs and is critical to our nation’s security. Offshore wind is an abundant, domestic energy resource that is located close to major coastal load centers, providing an alternative to long-distance transmission or development of electricity generation in these land-constrained regions.

Fishing has occurred in New England and Mid-Atlantic waters for hundreds of years and is an integral part of the region’s culture and economy. Regional fisheries not only provide a healthy and sustainable source of food for both domestic and international markets, but also recreational opportunities for thousands of anglers, divers, and nature enthusiasts. Fisheries also support numerous shoreside processing jobs and support industries important to the economies of many coastal communities.

“Any development on the Outer Continental Shelf must consider how these activities can affect current ocean users and the marine environment,” said BOEM Acting Director Walter Cruickshank. “That is why working with federal, state, and local agencies, fishing communities, and the public is such an essential part of our renewable energy program. We look forward to working with NOAA and RODA through early and constant communication to ensure that the most recent information is available to decision makers.”

“With wind energy developing in the New England/Mid-Atlantic region, this collaboration comes at a crucial time,” said Chris Oliver, assistant administrator for NOAA Fisheries, the primary federal agency charged with sustaining U.S. marine resources and habitats. “This Memorandum of Understanding will help achieve NOAA Fisheries’ strategic national goal of maximizing fishing opportunities while supporting responsible resource development.”

RODA, which is a broad membership-based coalition of fishing industry associations and fishing companies, will work with NOAA Fisheries and BOEM to compile, develop, and deliver the best available scientific products and information necessary to address offshore development, fisheries management, and ecosystem health.

“The fishing industry has expressed its concern about the potential impacts of rapid large-scale wind energy development to coastal communities and sustainable fishing practices,” said Annie Hawkins, executive director of RODA. “This agreement paves a way forward for fishing communities to give meaningful input to federal regulators in determining the future of our ocean resources.”

Working together to engage local and regional fishing interests early and often throughout the offshore wind development processes will help develop a collaborative regional research and monitoring program and lead to scientifically sound decisions.

“This unified approach will help ensure the best possible science and information is used to inform offshore energy development planning, siting, and operations,” said Dr. Jon Hare, science and research director for the Northeast Fisheries Science Center. “Tapping into the expertise and the knowledge of the fishing industry is essential to this process.”

Focus on Engagement, Research, and Monitoring

Today, the Federal Government has 15 active leases covering nearly 1.7 million acres in the Outer Continental Shelf for potential offshore wind development. Collectively, these leases could generate more than 19 GW of energy – enough to power more than 6.5 million homes and further solidify our nation’s energy future.

NOAA Fisheries manages more than 42 commercially and recreationally important species as part of 14 fishery management plans. In 2016, approximately 4,600 vessels landed more than 1 billion pounds of key fish species, supporting roughly 140,000 seafood jobs. The region is also vital for many endangered and threatened marine species, including the North Atlantic right whale, necessitating protective measures to ensure their survival for future generations.

“NOAA is committed to assessing the impacts of offshore wind energy projects on these resources,” said Michael Pentony, regional administrator for the Greater Atlantic Regional Fisheries Office. “The development of offshore wind energy projects must be done in ways that support the protection and sustainable management of our marine trust resources, fishing communities, and protected species.”

The new Memorandum of Understanding identifies four areas of mutual interest, which include the responsible planning, siting, and development of offshore wind power and working with regional and local fishing interests. The parties agree to collaborate on: engaging local and regional fishing interests in the offshore wind development process; identifying the most effective ways to bring fishing industry expertise and information into planning and development processes; and developing a collaborative regional research and monitoring framework to ensure decisions are based on the best available science.

Collaboration with BOEM, states, and fishing industry interests throughout the renewable energy leasing process will help improve compatibility of offshore wind with other ocean uses and create an effective regional research and monitoring program that will help improve our understanding of potential ecological, economic, and social impacts of offshore wind development.

Seismic surveying proposal in Atlantic raises Bay concerns

March 25, 2019 — The Atlantic Ocean is staring down the barrel of an air gun, and its blast could reverberate into the Chesapeake Bay.

Despite outcry from coastal communities and most East Coast states, the Trump administration is moving forward with allowing five companies to perform seismic surveys offshore from Delaware Bay to central Florida.

Environmental groups and many marine scientists fear that the tests’ loud, repeated blasts, which are used to detect oil and gas deposits deep beneath the ocean floor, could upend an underwater ecosystem that relies on sound for communication.

“The ocean is an acoustic world,” said Michael Jasny, director of the Natural Resources Defense Council’s marine mammal protection program. “Whales, fish and many other species depend on sound to survive. The extensive blasting that the Trump administration has authorized would undermine marine life on an enormous scale.”

The NRDC joined several environmental groups in a federal lawsuit filed in South Carolina in December, challenging the administration’s approval of the seismic surveys a month earlier. On Feb. 20, the conservation groups asked the judge in the case to block the seismic tests from going forward while the litigation is pending. The National Marine Fisheries Service decision allows the companies to “incidentally harass” marine mammals during the tests.

US judge rules cod quota set-asides for Alaskan cities are unlawful

March 25, 2019 — Washington, D.C. Circuit Court Judge Timothy Kelly ruled March 21 that the North Pacific Council’s Amendment 113 (A113) to the Bering Sea Groundfish Fisheries Management Plan does not comply with Magnuson-Stevens Act (MSA) requirements.

The amendment, adopted in 2016, provided 5,000 metric tons of Pacific cod as a set-aside for processing facilities located west of 170 degrees longitude. It named the specific cities of Adak and Atka in the US state of Alaska and the plants located there as the plants that would benefit from this set-aside.

Shortly after the amendment was adopted in late 2016, the Groundfish Forum, United Catcher Boats and other groups who rely on cod, flatfish, and other groundfish in the Bering Sea, filed a complaint challenging the rule, based on five separate claims for relief.

They contended first, that the National Oceanic Atmospheric Administration’s National Marine Fisheries Service (NMFS) didn’t have the authority to “allocate shore-based processing privileges” and overstepped its authority with this amendment.

Federally Managed Fisheries in US Pacific Islands Face a Mixed Future

March 22, 2019 — HONOLULU — The following was released yesterday by the Western Pacific Regional Fishery Management Council:

Federal fishery managers concluded their meeting in Honolulu today after dealing since Tuesday with a mixed bag of good and bad news about the future of fisheries in Hawai‘i and the US Pacific islands.

On the good side, a 2018 stock assessment estimates the Hawai‘i Kona crabs maximum sustainable yield at 73,069 pounds. The fishery has reported catch below 3,000 pounds in 2015 and 2016, indicating the potential for a lot of growth. However, participants have left the fishery (which landed 70,000 pounds in the 1970s) since the State of Hawai‘i banned the retention of female Kona crabs. The Council recommended that the Hawai‘i Division of Aquatic Resources (DAR) record female crab and minimum size discards separately on the fisherman trip reports to provide a more comprehensive record of commercial catch. It also requested that DAR remove the statute that prohibits take of female Kona crabs and consider revised regulations to extend or shift the closed season to protect berried females.

Other good news is that a recent economic report by the National Marine Fisheries Service (NMFS) found the Hawai‘i charter fishery generated close to $50 million in gross sales and supported nearly 900 jobs statewide in 2011. The Council encouraged NMFS to maintain a regular schedule of economic evaluations and monitoring of the fisheries in the Pacific islands.

On the bleaker side, the Council discussed the ongoing UN Intergovernmental Conference on Biodiversity beyond National Jurisdiction (BBNJ), which is considering a framework to establish fishing closures on the high seas. The Council asked the Department of State, which has a non-voting representative on the Council, to exempt high seas fisheries targeting tuna and tuna-like species from any potential high seas closures established under the new BBNJ convention. About 70 percent of the fishing effort of the Hawai‘i based longline fishery is on the high seas.

Idaho Plan Safeguards Wild Steelehead, Per NOAA

March 22, 2019 — NOAA Fisheries has determined that Idaho’s Fishery Management and Evaluation Plan for their recreational steelhead fishery provides necessary protections for salmon and steelhead listed under the ESA.

NOAA Fisheries has determined that Idaho’s Fishery Management and Evaluation Plan (FMEP) for their recreational steelhead fishery provides necessary protections for salmon and steelhead listed under the Endangered Species Act (ESA). NOAA fisheries has approved Idaho’s plan under section 4(d) Rule.

Under section 4(d), NOAA Fisheries can specify how an activity can be exempt from additional ESA regulations. This applies particularly to “take,” which can include any act that kills or injures fish, and may include habitat modification. The ESA prohibits any take of species listed as endangered, but some take of threatened species that does not interfere with survival and recovery may be allowed.

“Idaho has developed a plan that provides continuing recreational fishing opportunities while ensuring that ESA-listed salmon and steelhead have the protection they need to recover,” said Allyson Purcell, Branch Chief in NOAA Fisheries’ West Coast Region.

Idaho’s plan came together through collaboration with fishery managers across the Snake River Basin and includes a new basin-wide framework designed to limit total impacts on steelhead from all fisheries in the Snake River Basin. Under Idaho’s plan, fishermen will continue to be required to release any wild steelhead they encounter.

NOAA Fisheries Seeks Comments on Proposed Measures for the Jonah Crab Fishery

March 21, 2019 — The following was released by NOAA Fisheries:

NOAA Fisheries seeks comments on proposed measures for the Jonah crab fishery that complement the Atlantic States Marine Fisheries Commission’s Interstate Fishery Management Plan for Jonah Crab.

The Atlantic States Marine Fisheries Commission recommended these measures for managing Jonah crabs in federal waters. The management plan was initiated after an increase in landings.

Proposed measures include limiting Jonah crab harvest to those who already have a limited-access American lobster permit, a minimum size, protection for egg-bearing females, and incidental catch limits.These proposed regulations do not expand trap fishing effort. They propose to regulate the catch of Jonah crabs that is already occurring in the American lobster fishery.

NOAA Fisheries Announces Transfer of Georges Bank and Southern New England/Mid-Atlantic Yellowtail Flounder Quota

March 21, 2019 — The following was released by NOAA Fisheries:

NOAA Fisheries is transferring unused quota of Georges Bank and Southern New England/Mid Atlantic yellowtail flounder from the Atlantic sea scallop fishery to the commercial groundfish fishery.

If the scallop fishery is expected to catch less than 90 percent of its Georges Bank or Southern New England/Mid Atlantic yellowtail flounder quota, we are authorized to reduce the scallop fishery quota for these yellowtail flounder stocks to the amount projected to be caught, and increase the groundfish fishery quota by the same amount. This adjustment helps achieve optimum yield for both fisheries, while still protecting from an overage of the annual catch limits.

Based on the current projections, the scallop fishery is expected to catch 80 percent of its allocation of Southern New England/Mid Atlantic yellowtail flounder quota, and 44 percent of its Georges Bank yellowtail allocation.

We are transferring 0.78 mt of Southern New England/Mid Atlantic yellowtail flounder from the scallop fishery to the groundfish fishery, and 18.53 mt of Georges Bank yellowtail flounder through the end of the 2018 fishing year (April 30, 2019).

NOAA Fisheries Approves Monkfish Quota for 2019

March 19, 2019 — The following was released by NOAA Fisheries:

NOAA Fisheries is implementing monkfish quotas for the 2019 fishing year that we announced on July 12, 2017. There have been no overages in 2018, and there is no new biological information, so we are now finalizing the 2019 quotas that were previously announced. The quotas are the same as the 2017 and 2018 quotas and are in place until April 30, 2020.

All other requirements remain the same.

ASMFC expected to set stricter regs for harvesting striped bass

March 18, 2019 — A new status review has found the striped bass population to be in worse shape than previously thought, a result that will almost certainly trigger new catch restrictions for the prized species next year in the Chesapeake Bay and along the East Coast.

A preview of a soon-to-be-released stock assessment presented in February to the Atlantic States Marine Fisheries Commission indicates that the striped bass population is overfished and has been for several years.

Members of the commission, a panel of East Coast fishery managers, knew that the migratory species has been in coastwide decline for more than a decade, but the new assessment paints a bleaker picture than many expected, including data that show recreational catches are significantly higher than previously estimated.

“We had all hoped that the results of the assessment would be a little better,” said Mike Luisi, an estuarine and marine fisheries manager with the Maryland Department of Natural Resources. “It is clear that we need to do something.”

Once the ASMFC officially accepts the new stock assessment, it will need to implement a plan within a year to end overfishing.

The commission can’t adopt the assessment until its May meeting, though. Its completion was delayed by the partial federal government shutdown, which sidelined biologists with the National Marine Fisheries Service who were working to complete both the final document and the peer review report.
