West Coast Trawlers see Highest Groundfish Landings Since 2000 with Rockfish Resurgence

February 13, 2019 — SEAFOOD NEWS — Call it a rockfish resurgence — West Coast trawlers and processors are seeing the highest landings in groundfish since 2000, thanks in part to an ongoing exempted fishing permit from the National Marine Fisheries Service. At the same time, rockfish stocks are growing.

The EFP has allowed West Coast trawl fishermen to test changes in the fishery that increased their catch by more than 14 million pounds of fish in 2018, an increase of 300 percent from 2017.

The National Marine Fisheries Service issues EFPs exempting vessels from certain regulations on a trial basis to promote new gear types or methods, and allow industry to work cooperatively with the government and contribute to the scientific knowledge of the fishery and potential changes in regulations. Participating fishermen are able to harvest millions of pounds of abundant rockfish, allowing processors to stock retail markets and provide consumers with fresh, sustainable product – all with minimal bycatch of vulnerable species. Fishing under the EFP brought in roughly $5.5 million in additional revenue in 2018, according to National Marine Fisheries Service statistics.

The EFP program built on success from a similar permit in 2017, and the industry is off to a running start with this year’s EFP: More than 1 million pounds of groundfish have been landed under the EFP in January. Last year, 2018, the industry had the highest non-whiting groundfish landings since 2000, when several species were listed as overfished.

The EFPs follow the 2011 implementation of a catch share program for the West Coast groundfish fishery that substantially reduced discards of fish. Catch limits for several rockfish species have also increased dramatically as stocks listed as overfished have rebuilt. The industry tried for years to get archaic pre-catch shares trawl regulations abolished since fishermen were independently accountable for their catch and bycatch under the quota program. Finally, in 2016, the Pacific Fishery Management Council and NMFS worked with industry to identify trawl gear regulations that were obsolete.

The seafood industry was anxious to remove gear restrictions as the health of groundfish stocks improved, and because it would help assess potential impacts to salmon and other protected species. Lori Steele, executive director of the West Coast Seafood Processors Association; Brad Pettinger, former director of the Oregon Trawl Commission; Shems Jud, Pacific regional director, oceans program, Environmental Defense Fund; and Mike Okoniewski of Pacific Seafood; first applied for the EFP in 2016.

“We were eager for groundfish vessels to take advantage of healthy stocks and high quotas as quickly as possible while being sensitive to the need to minimize interactions with salmon and other protected species; NMFS stepped up and helped us design this EFP to provide fishing opportunities and collect important information the agency needed,” Steele, also the EFP coordinator, said.

NMFS was amenable to developing an EFP that would allow the industry to catch more fish while also providing insight into how regulatory changes would actually work with a subset of vessels before they were implemented throughout the entire fishery. NOAA Fisheries used data gathered from the 2017 and 2018 EFPs to permanently revise the trawl gear regulations for the start of the 2019 fishing year.

“The EFP provided the fishing community the flexibility to benefit from the rebound in many West Coast rockfish stocks, while continuing to protect those stocks and other vulnerable species such as salmon that need it,” said Ryan Wulff, Assistant Regional Administrator for Sustainable Fisheries in NOAA Fisheries’ West Coast Region. “The results were just as we hoped: a more productive fishery, increased revenue, and improved regulatory flexibility for the fleet.”

Now, with the third year of the EFP program just getting under way, more than a dozen groundfish fishermen are filling their fish holds, processors are hiring workers and the government is getting much-needed information about the impacts of adjusting gear regulations. While the seafood industry worked hard to regain its foothold in markets and provide the public with fresh West Coast rockfish on menus and in stores, it was possible only because NMFS worked with industry to issue the EFPs. It’s a win-win-win-win. And based on the EFP results thus far, the future is looking bright for the groundfish fishery, the EFP applicants said in a press release.

“This EFP has been a remarkable success – millions of pounds of sustainable rockfish landed with almost no bycatch,” Jud said. “NMFS’ recent adoption of changes to trawl gear regulations will enshrine some of the benefits of the EFP, securing greater revenue for fishermen and processors and more abundant rockfish on menus and in seafood markets for consumers to enjoy.”

Of course, big projects like this one aren’t done in a vacuum. The applicants credit both NMFS and the West Coast lawmakers for getting the EFP approved.

“This EFP shows the value of diverse collaboration for solving complex issues,” Okoniewski said. “The genesis for the EFP originated in a conversation among [NMFS West Coast Regional Administrator] Barry Thom, Shems Jud, and me. Brad [Pettinger] became the data expert and adviser. The professional construction of the EFP itself was done by Lori who drove it across the finish line.”

The support of 13 lawmakers was instrumental in getting the project started. Reps. Kurt Schrader, D-Ore.; Jaime Herrera Beutler, R-Wash.; Peter DeFazio, D-Ore.; Jared Huffman, D-Calif.; Derek Kilmer, D-Wash.; Denny Heck, D-Wash.; Greg Walden, R-Ore.; Earl Blumenauer, D-Ore.; Suzanne Bonamici, D-Ore; and Sens. Maria Cantwell and Patty Murray, D-Wash.; and Sens. Ron Wyden and Jeff Merkley, D-Ore., all signed a letter supporting the trawl gear changes.

“This EFP is a collaborative success amongst processors, fishermen, an ENGO and National Marine Fisheries Service that added millions to our fishermen’s incomes, created processor jobs, and brought a great U.S. seafood item to the American consumer,” Okoniewski said.

Bycatch an Issue in 2018 Pacific Hake Fishery; Uncertainty Lies Ahead Amid Shutdown

January 10, 2019 — SEAFOOD NEWS — None of the three sectors in the U.S. Pacific hake fishery attained its specified sector allocation in 2018 and all reported problems with bycatch — either smaller sizes of whiting or other species.

The catcher-processor sector achieved the highest percentage of its allocation, catching 116,074 mt of its 139, 612 mt allocation, or 85 percent. The shoreside sector harvested 76 percent of its 169,127 mt allocation for a total of 129,180 mt in landings. The mothership sector struggled the most last year and attained only 69 percent of its 96,614 mt allocation for 67,096 mt in landings.

“It was one of our better seasons,” Pacific Seafood’s Mike Okoniewski said, noting that the company’s Newport plant did exceptionally well while the Astoria plant had adequate production. “There was a greater amount of nice fish off of Newport this year, so fishermen didn’t have to travel far.”

Similarly, the Arctic Storm Management Group, a mothership company based out of Seattle, generally had a good season but that was not representative of the whole mothership sector, said Sarah Nayani, Arctic Storm’s director of compliance.

“In 2018 our company processed 38 percent of the mothership catcher vessel catch and 26 percent of the total mothership sector allocation. Unfortunately, 31 percent of the mothership sector allocation went uncaught, which is more than any single company processed,” Nayani said. “For next year we’ve planned additional trips to improve attainment and provide more MSC-certified sustainable product to the market.”

Around the Columbia River and into Washington, particularly near Willapa Bay, fishermen struggled to find larger fish, around 450 to 500 grams. The CPs and motherships, like shoreside fishermen, traveled north or south of the Willapa area to find bigger, more marketable hake.

However, traveling north led to other problems. The CP and mothership sectors said a lot of other species were mixed with whiting schools and many of those other species had hard caps. Pacific ocean perch rockfish bycatch was an issue as was sablefish, so both sectors continually moved their operations to avoid those other species. Southern areas were problematic as well, since Chinook salmon were frequently prevalent. Both of the at-sea sectors stopped fishing in November to avoid bycatch interactions.

“2018 was a good year for Arctic Storm overall,” Nayani said. “We saw demand and prices up for Pacific hake and a strong spring fishery with minimal bycatch. However, even with extra processing capacity from putting Arctic Fjord out on the water this fall (in addition to Arctic Storm) the fall fishery was slow for us due to patchy fishing, higher bycatch rates, and frequent movement to avoid bycatch.”

Now, everyone is looking forward to this year’s season, but any uncertainty now is due to the U.S. government shutdown and the inability of U.S. scientists to contribute to the stock assessment routinely done collaboratively with Canadian scientists. The stock assessment draft is due to be released Feb. 6, so scientists would normally be assimilating data and running models right now.

In an email to some Pacific hake stakeholders and U.S. fishery managers and scientists, Canadian stock assessment author Joint Technical Committee member Chris Grandin wrote Tuesday that Canadian scientists would produce the whiting stock assessment on time — but without the U.S. fishery dependent age composition data.

“If the government comes back online before Jan. 14, and U.S. JTC members are back at work we will be producing the hake assessment as usual without any changes,” Grandin wrote.

“If not, Andy and I will be producing a hake assessment on time for delivery Feb. 6. It will consist of adding 2018 catch to the base model from last year’s assessment, and some common sensitivity cases. Unfortunately, we cannot get access to the U.S. age composition data due to the shutdown and therefore will not include any 2018 age composition data in the models. Note that the assessment will be of the standard format with an executive summary, and all decision tables and projections in place for the base model.

“We realize the importance of this assessment to the fishery, and will endeavour to do as much as is possible given the constraints placed before us.”

U.S. industry representatives and scientists remain hopeful the shutdown will end soon so the stock assessment and management process will get back on track.

“We’re hoping we get a good quota this year, but won’t really know until we see the stock assessment,” Okoniewski said.

West Coast Whiting Industry Apprehensive About Shutdown’s Effect on Pacific Hake Season, Treaty

January 9, 2019 —  SEAFOOD NEWS — A recent report by KING-5 TV News in Seattle picked up on NOAA Stock Assessment Scientist Ian Taylor’s recent Tweet about his frustration with the government shutdown and how it could affect the Pacific hake fishery.

“I love my U.S. federal job at @NOAAFish_NWFSC but it’s immensely frustrating to have #shutdown be such a common disturbance,” Taylor said in a Dec. 21, 2018 tweet. “Last time it was short, science got done, and U.S. #pacifichake catch was ~300,000 tons in 2018. Now 2019 assessment needs to happen yet here we go again.”

The U.S. whiting fishery caught more than 266,000 mt last year for a value of close to $50 million, about half of the overall West Coast groundfish fishery value.

Taylor is one of the U.S. scientists who works collaboratively with Canadian scientists to develop the hake stock assessment, scheduled for a draft release and review by Feb. 6, 2019. Without the stock assessment on which to base 2019 regulations, a number of options could occur: the season could be delayed or it could be managed very conservatively. The assessment may rely solely on the Canadian scientists’ work, with limited input already done by U.S. advisers. It’s unclear at this point exactly how the season will proceed, but the treaty process is continuing without the scientific input from the U.S.

However, the series of dominoes that make the whiting fishery work starts with getting the assessment done.

Sarah Nayani, Director of Compliance for Arctic Storm Management Group LLC, based in Seattle, said she’s watching the issue closely.

“We are concerned about the impact the government shutdown may have on the hake assessment and the timing of the Pacific Whiting Treaty process,” Nayani said in an email. “We hope that the U.S. scientists and managers may resume their work soon so that our 2019 fishery won’t be impacted or delayed.”

Taylor and other scientists discussed the pending assessment during a Joint Management Committee conference call in early December. The JMC includes industry and managers from both countries. On the call, U.S. scientists told participants that NMFS was prioritizing other species for stock assessment work; Pacific hake was just lower on the list at the time but still scheduled for completion. It’s likely nobody suspected a government shutdown would happen two weeks later, or that it would drag on into the New Year.

The predicament now is that the only new data for an updated stock assessment from the U.S. side is fishery-dependent data, such as age classes, length-at-age data, volumes, etc. Fishery-independent data, in the form of a NOAA Fisheries acoustic research survey, is done once every two years (2018 was an off year). Therefore, complete data from the 2018 U.S. fishery is essential to developing a scientifically-robust stock assessment for managing the 2019 fishery. This data is currently incomplete because of the government shutdown.

Beyond the stock assessment, the seafood industry frequently relies on preliminary scientific data to make business plans and update customers on volumes and product availability.

“What do we tell our markets?” Pacific Seafood’s Mike Okoniewski said. “Our customers want to know that as far in advance as they can. It can have a detrimental effect on our business side, too.”

For Okoniewski, Nayani and others involved in or watching the whiting process, the politics of the government shutdown are frequently secondary to their business considerations. It’s more frustrating to not have access to scientific information that affects the bottom line.

“They’re [scientists/researchers] considered to be nonessential, but they compose the bulk of the work force that we consider essential,” Okoniewski said.

Pacific Council Gives Preliminary Nod to Two Coastal Sardine and Other Pelagic Species Projects

November 22, 2017 — SEAFOOD NEWS — The Pacific Fishery Management Council last week approved for public review two exempted fishing permits that should help improve coastal pelagic species stock assessments.

Both projects would add more survey work to nearshore areas. Fishermen have identified schools of sardines, in particular, close to shore but accessing them for survey work has been a problem because the sardine season has been closed and NOAA ships cannot access shallow areas. Additionally, both proposals would build on the use of industry knowledge.

The California Wetfish Producers Association research project intends to sample CPS schools in the southern California Bight using aerial spotter pilots with camera systems to fly surveys close to shore and photo-document schools. At the same time, qualified purse seine vessels would capture a subset of the schools identified in the photographs as “point sets.” This would provide a way to address issues identified in the aerial survey methodology review. The survey period is scheduled for late August 2018.

According to the CWPA application, all fish captured, including sardines, would be processed and sold by participating processors, and fishermen will be paid for their catches at the usual rates. Aside from the sale of fish, processors would not be compensated for the extra labor they will incur in weighing and fully sorting each school individually and documenting species composition by school, rather than the normal procedure of offloading the entire catch and documenting by load.

“We strongly support these EFP projects to improve the accuracy of stock assessments. It should be noted that 70 percent or more of the CPS harvest in California occurs in the area inshore of NOAA acoustic surveys,” CWPA Executive Director Diane Pleschner-Steele said. “We are grateful to the California Department of Fish and Wildlife and Southwest Fishery Science Center for their help and recognition that surveying the nearshore is a high priority research and data need.”

Pacific Seafood’s Mike Okoniewski presented the Westport, Wash.-based West Coast Pelagic Conservation Group project to both the Council and the Scientific and Statistical Committee. The project is designed to provide supplementary data collection and additional sampling techniques for areas nearshore of the proposed 2018 NOAA/Southwest Fisheries Science Center acoustic-trawl survey, according to the group’s application. This research off of Washington and Oregon would continue and expand the 2017 collaborative effort in 2018 so that samples of CPS for species composition and individual fish metrics may be obtained through purse seine operations, according to Council documents.

Sampling would be done at the same general time and nearshore areas as the NOAA survey, the applicants stated. The coastal pelagic species (CPS) that will be retained in small amounts (e.g. 5kg to 25kg) for sampling will be dip-netted sardines, anchovies, and mackerel(s). The sample fish will be frozen and retained for identification and biological measurements to be performed by NOAA.

But unlike the southern EFP, no fish will be harvested for commercial purposes. Wrapped schools would be released alive, the applicants said.

“This collaboration will continue to support the already commendable efforts of the scientists, balancing it with industry knowledge of the fishing grounds,” Okoniewski said.

Both EFPs will add to current survey and stock assessment work, providing more robust data for the fisheries in the future. The Council’s Scientific and Statistical Committee and Coastal Pelagics Species Management Team supported the EFPs and suggested minor technical changes to each; both applicants plan to incorporate those suggestions prior to the Council’s and NMFS’ final approval in early 2018.

“The CPSMT recognizes the value of the EFP research proposed by both groups to improve CPS stock assessments by obtaining data that has not been attainable by other means,” the CPS Management Team said in its statement.

The Coastal Pelagic Species Advisory Subpanel also supported the projects. “[We are] encouraged that forward progress is now being made to develop effective survey methods for the nearshore area,” the panel said in its statement. “The CPSAS thanks CWPA, WCPCG and especially the SWFSC for acknowledging the data gaps in current surveys and helping to provide support and funding for cooperative surveys that will hopefully improve the accuracy of future CPS stock assessments.”

In Their Own Words: Sablefish Gear Switching in the West Coast Trawl Quota Program

October 23, 2017 — SEAFOOD NEWS — The West Coast trawl catch shares program (individual fishing quota/IFQ program) was implemented in 2011 for the groundfish fishery — but it’s not without its problems. One provision rose to the top during the current five-year review as the most controversial: gear switching.

Sablefish is the most valuable groundfish, on a per-pound basis, on the West Coast. It is often graded on quality and at least five different sizes. Most sablefish is sold to Japan and a few other countries, but domestic markets have been in expanding for a few years. Whereas most other groundfish species have ex-vessel prices of cents per pound, sablefish frequently goes for dollars per pound. Better quality fish, i.e., those that are caught by longline or pots, typically fetch higher prices.

On the West Coast, sablefish — or blackcod — are caught in a mixed species fishery by trawl and are targeted by longline and pots. The species is an important component of the trawl “deepwater complex” that includes Dover sole, thornyhead rockfish and sablefish. Dover sole is a low price/high-volume species for trawlers but access may be limited if a trawler has insufficient sablefish quota.

Proponents of the trawl catch shares program in the late 2000s included an option to be able to switch gears to catch sablefish. That is, a trawler could use any legal groundfish gear, including pots and longline, to catch the valuable species if they so desired. Some fishermen say this was intended to allow trawlers to catch smaller amounts of sablefish that may be leftover from harvesting their deepwater complex. Other fishermen say it was intended to allow a switch to what some claim is an environmentally cleaner harvesting method. Because a single provision may have multiple purposes, both may be correct.

Regardless, the effect of the provision was that some fixed-gear vessels purchased trawl permits and quota and are now harvesting sablefish. Sablefish quota prices increased to the point where some trawlers could not afford to buy or lease it on the open market in order to access their Dover sole quota. Others may have simply chosen not to buy or lease the quota. A limited supply of sablefish quota overall may also have been the culprit for some trawlers not being able to access their Dover sole. In some years, the quota went quickly and less than five percent was available by year’s end. At the same time, fixed-gear vessels have made significant investments in gear and equipment to access trawl sablefish quota. Processors are concerned blackcod will continue to act as a choke species, limiting access to the volumes of groundfish necessary to keep processing crews working.

But there’s another wrinkle. Sablefish quota is available in two distributions: north or south of 36 degrees N. Latitude — near Point Conception in southern California. A handful of fixed-gear vessels using trawl quota have traveled from Oregon and Washington to fish the southern area. Southern California fixed-gear fishermen found themselves with new entrants on their traditional fishing grounds.

The Pacific Fishery Management Council in September took the first step at making the gear-switching provision work for everyone. One of the proposals includes eliminating the management line at 36 degrees north latitude, thereby creating one coastwide pool of quota. The Council also proposed mitigation measures to limit gear switching.

Seafood News talked with four people representing the major factions concerned about the sablefish gear-switching provision:

  • Jeff Lackey, a trawl vessel manager from Newport, Ore.
  • Michele Longo Eder, whose family members are fixed gear fishermen who have made investments in the trawl program
  • Mike Okoniewski, who works for a processor that depends on trawl groundfish
  • Chris Hoeflinger, representing Southern California traditional fixed-gear fishermen

Seafood News will run their perspectives, in their own words, of the gear-switching issue this week. The Pacific Fishery Management Council will be wrestling with this issue over the coming months.

In his own words: Jeff Lackey, trawl vessel manager from Newport, Ore.:

The trawl catch shares program that began in 2011 has some positive elements. However, it has also led to operational difficulties that have significantly decreased catch for bottom trawlers.

The unintended consequence of the catch shares program was that a significant fixed-gear fishery for sablefish sprang up almost literally overnight within the trawl fishery. Hundreds of thousands of pounds of sablefish quota a year were going to fixed gear vessels and then coming to the dock without the associated catch of other groundfish species.

So by 2016, five years later, the species that trawl catch of sablefish helps get to the dock had seen their coastwide annual catch drop by about a third compared to pre-catch shares capacity. That’s roughly 14 million pounds a year in lost catch and corresponding seafood available to the consumer. This translates to dozens of lost full time jobs in the processing sector alone, as well as dozens of trawl vessels that left the fishery.

In 2011, some trawlers left the fishery altogether and some switched to the shrimp fishery rather than compete with fixed gear boats that were buying trawl permits and entering the trawl individual fishing quota (IFQ) fishery. It is difficult to generalize the business plan of each individual trawl vessel as each has a different set of circumstances, such as the amount of quota they have and the other fisheries they participate in.

However, when you match the individual stories of difficulty in executing a viable fishery given sablefish limitations with the overall data of a diminished fishery, a clear picture emerges. The lost yearly bottom trawl catch is about what one would expect for the amount of sablefish that has been lost from the trawl fishery. To return the fishery to pre-IFQ program catch levels and allow the stability the program affords to make even more gains, the coastwide sablefish quota allocated to the trawl IFQ program would need to be caught by trawl vessels to facilitate the catch of other groundfish species.

Fishermen See ‘Science in Action’ Aboard NOAA Survey Ship

August 18, 2017 — Each spring and early summer, scientists set out along the West Coast aboard NOAA vessel Reuben Lasker to survey coastal pelagic species, or CPS, which includes small schooling fish such as northern anchovy, Pacific sardine, and jack and Pacific mackerels.

This year, with the help of West Coast fishermen, the scientists tested a new approach to extend their reach into nearshore waters to improve the accuracy of the survey results. The collaboration involved the fishing vessel Lisa Marie, of Gig Harbor, Washington, and brought two commercial fishermen aboard Lasker for an inside look at NOAA Fisheries surveys that inform stock assessments and guide decisions on how many fish can be caught by West Coast fishermen.

The idea emerged years before when the then-Director of NOAA’s Southwest Fisheries Science Center in La Jolla, California,  Cisco Werner, along with Deputy Director Kristen Koch and Fisheries Resources Division Director Gerard DiNardo, discussed the potential collaboration with Mike Okoniewski of Pacific Seafood and Diane Pleschner-Steele of the California Wetfish Producers Association.

Werner has since been named Chief Scientist of NOAA Fisheries.

The Magnuson-Stevens Fishery Conservation and Management Act requires NOAA Fisheries to use the best available science to help managers set catch limits and prevent overfishing. Annual surveys, using echosounders to detect and measure the abundances of CPS populations off the coasts of California, Oregon, Washington, and Canada’s Vancouver Island help fulfill this mandate. NOAA Fisheries also uses trawl catches, and fish-egg samples to help gauge fish reproduction and population trends.

“Acoustic-trawl surveys are our principal tool for monitoring the various species and determining how their abundances, distributions, and sizes are changing,” said David Demer, the Chief Scientist of the survey and leader of the Advanced Survey Technologies Group at Southwest Fisheries Science Center in La Jolla. “The surveys are very rigorous because they’re very important to our mission.”

First MSA Reauthorization Hearing Acknowledged Successes, Identified Needed Changes

August 2, 2017 — SEAFOOD NEWS — At the first of a series of hearings on the Magnuson-Stevens Act held yesterday at the Subcommittee on Oceans, Atmosphere, Fisheries, and Coast Guard, senators from both sides of the aisle voiced support for the regional management council system, NOAA Fisheries, and the science that supports fisheries management, despite the deep cuts proposed in the President’s budget.

“With regard to the budget, I think some of these cuts may not survive the [reauthorization] process,” said Chairman Dan Sullivan (R-AK). “I think we’re going to be adding a lot back to the projects that we think are vital.”

Sullivan was responding in part to a series of questions from Sen. Richard Blumenthal (D-CT) to Chris Oliver, Assistant Administrator for NOAA Fisheries, about the current administration’s proposed budget for the agency.

“My question concerns the budget submitted by the president of the United States. The budget slashes funding for programs like Sea Grant and the Milford Lab at the University of Connecticut [Northeast Fisheries Science Center],” Blumenthal said.

“These federal research efforts to help grow and expand certain aspects of aquaculture are very promising. As a representative of this administration, how can you justify these cuts to the agency that you are responsible for administering? Are you going to commit to me that you’re going to [find funding] for Sea Grant and the Milford Lab?”

Oliver responded, “Senator, I don’t know that I’m in a position to comment very extensively on the President’s budget. I do know that they’ve placed a revised emphasis on the Department of Defense and national security.”

Blumenthal: “I’m on the Armed Services Committee sir, and I very much support that emphasis … but this kind of slashing and trashing of programs that are essential to the kinds of programs you administer, that are vital to our economic future in aquaculture I consider a mockery of the mission of your agency. And if you’re not in a position to justify it, who would be?”

Oliver: “All I can say sir is we’re going to do our best to operate within the budget that we have, and I know that a lot of the programs that were slated to be cut involve cooperative agreements or past grants of funding through the Sea Grant program, for example, and grants to the coastal states. We’re going to do our best to make that up internally…”

Blumenthal: “Are you going to commit to me that you can make up those cuts to the Sea Grant program and the Milford Lab and the University of Connecticut that are essential to those programs?”

Oliver: “I can’t commit that we’re specifically going to be able to make those up from our baseline budget. I think that we’re facing some tough decisions too. I’ve said on many occasions that I feel that this agency may be in a position to refocus on some of its very core mission – science mission…”

Blumenthal: “You’d agree with me that those are valid and important programs?”

Oliver: “Of course sir, I really do.”

Blumenthal: “If you agree these programs are valid, then your agency has a responsibility to fight for them and to make sure they are fully funded.”

The exchange was toward the end of an otherwise non-confrontational hearing on the “long overdue” reauthorization of the MSA with Oliver and Dr. John Quinn, Chair of the New England Fisheries Management Council. Both men lauded the successes brought about by the original 1976 law and the amendments to it, most recently in 2007.

“As a group, we are strong believers in the Magnuson-Stevens Act – and not just because it established the Councils,” said Quinn, who spoke on behalf of the Council Coordination Committee (CCC), which is made up of the chairs, vice chairs, and executive directors of the eight Regional Fishery Management Councils.

“The outcome of our management success is clear: commercial, recreational, and subsistence fisheries are key contributors to our coastal communities and the nation’s economy. In large measure, this is because the Act structured a very successful approach to sustainable fisheries management. Central to the Act are the 10 National Standards that guide our management process.”

“Under the standards set in the Magnuson-Stevens Act the nation has made great strides in maintaining more stocks at biologically sustainable levels, ending overfishing, rebuilding overfished stocks, building a sustainable future for our fishing-dependent communities, and providing more domestic options for U.S. seafood consumers in a market dominated by imports,” echoed Oliver.

Both agreed, however, that changes should be made. Oliver noted in particular ways in which overall production could be increased, particularly in areas where catch limits have not been updated to changes in stock sizes.

“For example, while our West Coast groundfish fisheries have rebuilt several important stocks, in recent years fishermen are leaving a substantial amount of the available harvest of some groundfish species in the water, due to regulatory or bycatch species constraints. We must find ways to maximize allowable harvests that are still protective of non-target species in all of our fisheries,” explained Oliver.

Stakeholders in the West Coast groundfish fishery were enthusiastic about Oliver’s references to the plight of those working in the non-whiting trawl catch shares program. The program has realized far less than full utilization of the resource, with less than one-third of the available fish being harvested annually.

“We applaud Chris Oliver’s recent testimony to the Senate on the state of the West Coast IFQ non-whiting trawl fishery,” Pacific Seafood’s Mike Okoniewski said.

“Members of industry have been testifying for years that while the conservation benefits of the program have passed all expectations, but the economics are performing at abysmal levels,” Okoniewski said.

Oliver’s testimony drilled to the heart of the matter: if you cannot get the fish out of the water you cannot realize the economic benefits outlined in the program’s goals and objectives. Targets such as increasing economic benefits, providing full utilization of the trawl sector allocation, increasing operational flexibility and providing measurable economic and employment benefits throughout the processing and distribution chain have not been met for the non-whiting sector.

“Chris Oliver’s testimony is a huge step forward to reverse the present trajectory we are on. Again we thank him and look forward his leadership of NMFS. His focus on balance and economic output, as well as conservation and sustainability, is long overdue,” Okoniewski said.

“Much like Pacific groundfish (to quote AA Oliver), New England groundfish fishermen ‘are leaving a substantial amount of the available harvest of some groundfish species in the water, due to regulatory or bycatch species constraints’”, noted Maggie Raymond, Executive Director of Associated Fisheries of Maine.

Both Quinn and Oliver referenced a need for “flexibility”, Raymond observed.

“Quinn’s testimony is specific to a need for flexibility in rebuilding timelines.  But flexibility in rebuilding timelines is not necessarily the fix, at least not for New England,” she added.

“As long as an otherwise healthy mixed stock fishery remains constrained by a weak stock in the complex, the problem of leaving available harvest in the water cannot be addressed.  We look forward to working with AA Oliver to ‘find ways to maximize allowable harvests that are still protective of non-target species.’

“Let’s start with windowpane flounder. A species with no economic value that puts a significant burden on the NE groundfish and scallop fisheries,” said Raymond.

Oliver acknowledged his testimony from last year on no need for further flexibility on MSA. But, he said, “I’m in a new role now and as I look at the issue more broadly, I’d heard from constituents across the country, listened to the dialog about issues with the Act, and I’ve come to believe that there is a possibility that additional flexibilities should be considered, accountability measures that are used to enforced annual catch limits (ACLs), particularly in fisheries where we don’t have the robust and accurate accounting.

“Many of our recreational fisheries are of a nature that don’t lend themselves well to those monitoring methods.

“The administration has not taken positions on these specific issues,” Oliver said. “But in my personal view, in fisheries that don’t have robust systems of accountability, in particular the recreational fisheries that have different goals, there’s room for flexibility.”

Quinn agreed. “We’re here to reauthorize [the MSA], not repeal it. Data availability and stock assessment, particularly in the recreational side, I think we’ve got a lot of work to do. Data needs are really important. ACLs and AMs work for the commercial, not necessarily for the recreational fisheries.”

Senator Cory Booker (D-NJ) called the nation’s bycatch quantity “unacceptable” and asked Quinn for an assessment on catch shares.

“In some parts of the country, catch shares have worked,” Quinn responded. “In my part of the country, it hasn’t worked as well. But the CCC’s position is to keep catch shares as a part of our management tool box.”

Sullivan brought up the issue of electronic monitoring as a less expensive alternative to onboard observers and asked, “What can we do to help the councils use EM more efficiently?”

“Like catch shares, the authority for EM is in the Act now,” said Quinn, “but individual regions may have specific fisheries that may or may not use EM. There are a lot of pilot programs using EM now. Decisions should be made region by region.”

“I want to compliment you both on your emphasis on data and science,” Sullivan said in closing comments. “We’re going to back you up on that.”

The next hearing will be August 23, 2017 in Kenai, Alaska.
