September 11, 2018 — The following was released by the Atlantic States Marine Fisheries Commission:
As of September 10, the Area 1A Atlantic herring fishery has harvested 97% of the Trimester 2 allocation. Beginning 12:00 a.m. Thursday, September 13, 2018 the Area 1A fishery will move to zero landing days through September 30, 2018, as specified in the ASMFC Atlantic Herring Fishery Management Plan.
Vessels participating in other fisheries may possess no more than 2,000 pounds of Atlantic herring per trip per day. In addition, all vessels traveling through Area 1A must have all seine and mid-water trawl gear stowed.

Virginia gets a year to comply with menhaden limits or face moratorium
September 10, 2018 — East Coast fishery managers have decided to give Virginia until next year to adopt regulations that limit catches of menhaden in the Chesapeake Bay rather than seek an immediate moratorium on harvests.
Conservation groups and the fishing industry have been engaged in a long-running battle over how many menhaden can be caught without ecological consequences.
Humans don’t eat menhaden, but the small, oily fish are a critical food for a host of marine life from whales to striped bass. While the overall stock is considered healthy, conservationists have argued that such evaluations do not account for its role as forage for fish, birds and marine mammals.
Last fall, forage fish advocates persuaded the Atlantic States Marine Fisheries Commission to slash the maximum allowable harvest in the Bay — where much of the East Coast harvest takes place — from 87,216 metric tons to 51,000 metric tons a year, even as it increased the total allowable coastwide catch.
But the action angered Omega Protein, which operates a facility in Reedville, VA, that “reduces” large amounts of menhaden caught by its fishing fleet into other products, such as fish oil supplements and animal feed. Omega is by far the largest harvester of menhaden in the Chesapeake and the entire East Coast. The company has not exceeded the new limit for Bay waters in years because it has drawn more of its catch from the Atlantic, but officials said the lower number restricts their future options and has no scientific basis.

Bountiful Bunker? Advocates Clash with Big Fish Oil in New York Harbor
September 10, 2018 — Advocacy groups are sounding the alarm on Virginia-based fishing fleets coming into the New York bight to harvest menhaden — a bait fish better known as “bunker” — but NOAA Fisheries says the species is not at risk of overfishing.
The boats work for Omega Protein, a company based in Reedville, Virginia, that runs the largest menhaden fishing operation on the east coast.
Menhaden are abundant now, but they’d been severely overfished in the past and advocacy groups like Menhaden Defenders and Gotham Whale are concerned about that happening again — especially since whales have returned to New York City waters. The cetaceans feed on menhaden, and fewer fish could mean fewer whale sightings, they say.
Advocates also worry about by-catch. The boats use huge purse seines that round up millions of fish at a time, and there’s concern that dolphins and other marine life could get caught up.
In a press release, Omega Protein charged that advocates are making “false statements” about their fleet, noting that there’s currently no concern about bunker overfishing and that their operations are completely legal. The company turns menhaden into commodities for fish oil supplements, dog food, fish meal, and other products.
Jennifer Goebel, a spokesperson for NOAA Fisheries, confirmed that there’s no current threat of overfishing for menhaden.
“There has been concern over the years from certain environmental groups regarding localized depletion in Chesapeake Bay, but studies have not found any evidence that localized depletion is occurring,” she said in an email. “The coastwide assessment shows the Atlantic menhaden stock is not overfished and overfishing is not occurring.”
She added that Omega Protein “follow[s] the schools and right now, if those schools are off New York, that’s where an industry vessel could be fishing.”

US East Coast could build nearly 9 GW of offshore wind capacity over next decade
September 10, 2018 — The US East Coast is leading the nation’s charge toward developing an offshore wind industry, and while the country only has 30 MW of offshore wind capacity installed currently, if goals are met and announced projects are built, the East Coast could have nearly 9 GW of offshore wind capacity by the 2030s.
The US has a long way to go in closing the gap with Europe in terms of offshore wind capacity, but with several East Coast states committing to achieve aggressive offshore wind development goals, the country could make considerable progress over the next decade.
Europe had nearly 16 GW of total installed offshore wind capacity at the end of 2017, according to trade group Wind Europe, compared with just one operating facility in the US — Deepwater Wind’s 30-MW Block Island Wind Farm in Rhode Island.
New York, New Jersey and Massachusetts are leading the way when it comes to setting offshore wind development goals. New York has a target to receive 2.4 GW of offshore wind power by 2030 and plans to issue requests for proposals for 800 MW in fourth-quarter 2018.
Not to be outdone, New Jersey has a goal of 3.5 GW of offshore wind generation by 2030. The state’s Board of Public Utilities Wednesday accepted an application from EDF Renewables and Fishermen’s Energy for the small-scale 25-MW Nautilus Offshore Wind project that would be located off the Atlantic City coast and could be generating power by 2021. Building a smaller project first has been touted by the companies as a way to kick start New Jersey’s offshore wind industry.
MARYLAND: Seafood restaurant wages war with PETA
September 7, 2018 — After People for the Ethical Treatment of Animals (PETA) targeted Maryland’s blue crab industry in an ad campaign last month, seafood restaurant Jimmy’s Famous Seafood is fighting back to protect its livelihood.
“It’s our livelihood and the Maryland blue crab is the bloodline of Maryland.…Tens of thousands of jobs depend on the Maryland blue crab economy on a daily basis,” John Minadakis, owner of Jimmy’s Famous Seafood in Dundalk, Maryland, told SeafoodSource.
To that end, Jimmy’s launched a scathing Twitter campaign that, in part, accuses PETA of slaughtering kittens and puppies. The restaurant also posted a billboard featuring a photo of its steamed crab with the statement: “SteaMEd crabs. Here to stay. Get Famous.”
In late August, PETA placed a billboard near Baltimore’s Inner Harbor, home to several seafood restaurants such as Phillips Seafood, McCormick & Schmick’s, and The Oceanaire Seafood Room. The billboard, which includes an image of a Maryland blue crab, states: “I’m me, not meat. See the individual. Go vegan.”
“Just like humans, crabs feel pain and fear, have unique personalities, and value their own lives,” PETA Executive Vice President Tracy Reiman said in a statement. “PETA’s billboard aims to give Charm City residents some food for thought about sparing sensitive marine animals the agony of being boiled alive or crushed to death in fishing nets simply by going vegan.”
NEW YORK: Plea to Fund Fishing Survey
September 7, 2018 — Several months after they asked East Hampton Town for $30,000 to collect data aimed at protecting fishing grounds and compensating commercial fishermen when they are unable to work, that request has still not been granted, the director of the Long Island Commercial Fishing Association and the liaison chosen by East Hampton Town’s fisheries advisory committee to communicate with Deepwater Wind complained to the town board on Tuesday.
While the liaison, Julie Evans, and Bonnie Brady of the fishing association addressed the board, Deepwater Wind, the Rhode Island company planning to construct the 15-turbine South Fork Wind Farm approximately 30 miles off Montauk, is in the midst of a projected four-month survey at the site and along the transmission cable’s route to shore.
Commercial fishermen are mostly opposed to the wind farm, fearing damage or destruction of fishing grounds and potential alteration of migration patterns caused by the electromagnetic frequency emitted by its transmission cable.
A “mariners briefing” dated Tuesday and posted on Deepwater Wind’s website states that “all mariners transiting or fishing in the survey area are requested to give a wide berth to survey vessels as they will be limited in their ability to maneuver and towing gear out to 300 meters behind the vessel.”
Ms. Brady told the board that the purpose of a fisheries representative is to develop a mitigation-monitoring plan with a Deepwater Wind representative. “Unfortunately,” she said, “when it comes to Deepwater, their communication as far as the survey is ‘Get out of the way,’ and outreach is ‘Get out of the way now.’ ” Commercial fishermen who work in the survey area are now restricted, she said. “For how long? Who pays that? If you’ve got a day’s pay and have made that same day’s pay over the course of the last 10 or 20 years, and suddenly you can’t fish because the survey boat is there,” a mitigation plan is not only needed but should have been in place prior to commencement of the survey.

ASMFC Northern Shrimp Section to Meet October 4th to Review Benchmark Assessment Results and Consider Draft Addendum I for Public Comment

The Atlantic States Marine Fisheries Commission’s Northern Shrimp Section (Section) will meet on October 4, 2018 at the Maine Historical Society, 2nd Floor Reading Room, 489 Congress Street, Portland, Maine. The Section will review the findings of the 2018 Benchmark Stock Assessment and Peer Review Report, and consider its approval for management use. The Section will also review Draft Addendum I and consider approving the document for public comment. This Draft Addendum considers providing states the authority to allocate their state-specific quota between gear types in the event the fishery reopens.
In November 2018, the Northern Shrimp Advisory Panel (AP) will meet to review the Benchmark Stock Assessment and provide recommendations on the 2019 fishery specifications. In addition, the AP will review public comment on Draft Addendum I and provide recommendations on its preferred management alternative. Following the AP meeting, the Section will meet to review the AP’s recommendations, take final action on Addendum I, and set 2019 specifications. Information regarding the date and location of the November meeting will be provided, when available, in a subsequent press release.

Can offshore wind and commercial fishing coexist?
September 5, 2018 — The Virginia Marise slides away from the dock into the pitch-black night. At 4 a.m., the only light comes from a flood light illuminating the deck of the boat and a handful of streetlights on land that disappear into the darkness as Captain Rodman Sykes maneuvers his boat out of the harbor, the black sky indistinguishable from the black sea.
This is a familiar scene to fishermen like Mr. Sykes. Commercial fishermen have headed out on these New England waters for some 400 years, casting their lines and nets overboard just as the sun peeks over the horizon. But at daybreak on this August morning, there’s a new sight. As the inky-black night gradually fades into the dim gray pre-dawn light, five red flashing lights appear all in a row on the horizon.
Those lights come from the five turbines making up the United States’ first offshore wind farm – the 30 megawatt Block Island Wind Farm. As the Virginia Marise draws closer, and the sky begins to blush pink, the turbines stand out on the horizon. The blades turn slowly in the slight breeze, generating electricity that flows through a cable buried in the seabed to Rhode Island’s Block Island.
The turbines and all the hardware that accompanies them spun to life in December 2016. So far, this is the only offshore wind power in the nation, and with just five turbines, it’s a small installation. But that’s soon to change. Massachusetts, Rhode Island, and Connecticut have already selected larger projects which are set to be installed not far from the Block Island Wind Farm. And more are in the development pipeline in New York, New Jersey, and Maryland.
This flurry of activity has sparked agitation among the fishermen who have long been a fixture on the Eastern seaboard. Could fields of turbines disrupt their operations and the resource on which their livelihoods depend? Meetings with developers and permitting officials have been tense and, at times, explosive. A group of fishermen have even sued the federal government for leasing a tract of seafloor south of Long Island to an offshore wind developer.
