Spiny Dogfish Board Approves Draft Addendum VII for Public Comment to Consider Action to Reduce Atlantic Sturgeon Bycatch

October 25, 2024 — The following was released by the Atlantic States Marine Fisheries Commission:

The Commission’s Spiny Dogfish Management Board approved Draft Addendum VII to the Interstate Fishery Management Plan for Spiny Dogfish for public comment. The Draft Addendum considers potential measures to maintain consistency with the federal Fishery Management Plan in response to the proposed rule to implement Spiny Dogfish Framework Adjustment 6.

The Mid-Atlantic and New England Fishery Management Councils developed Spiny Dogfish Framework Adjustment 6 in response to a 2021 Biological Opinion and 2022 Action Plan that called for reducing bycatch of Atlantic sturgeon in spiny dogfish gillnet fisheries. The coastwide Atlantic sturgeon population is made up of five distinct population segments, all of which are listed as threatened or endangered under the Endangered Species Act, and Atlantic sturgeon harvest has been under a coastwide moratorium in federal and state waters since 1998. The Commission’s Fishery Management Plan for Atlantic sturgeon maintains the moratorium through at least 2038, and while the 2024 stock assessment update showed signs of improvement, the stock remains depleted coastwide.
The Board initiated Draft Addendum VII in August 2024 after the Councils recommended measures to NOAA Fisheries to prohibit overnight soaks for federal spiny dogfish permit holders on gillnets with 5”-10” mesh in November and May for a certain area of state and federal waters off of New Jersey, as well as for gillnets of 5.25”-10” mesh in November through March in specified areas off of Maryland and Virginia. The options in the Draft Addendum aim to establish equivalent overnight soak restrictions for spiny dogfish harvesters in state waters that do not possess a federal spiny dogfish permit.
The Draft Addendum will be posted to the website next week at http://www.asmfc.org/about-us/public-input. A subsequent press release will provide details on the public hearing schedule and how to submit written comments. The Board will meet to review submitted comments and consider final action on the addendum in February at the Commission’s Winter Meeting.

New York Sues U.S. Dept. of Commerce Over Fluke Allocation

October 15, 2019 — SEAFOOD NEWS — In the most recent salvo of a lengthy battle, New York’s Department of Environmental Conservation sued the Department of Commerce for maintaining the annual allocation of summer flounder to the state, despite a well-documented stock migration from the mid-Atlantic to off the shores of NY’s Long Island.

“It is unjust that New York’s fishing communities continue to be subjected to outdated restrictions on a key source of their livelihoods, which is why we are challenging this quota,” said New York’s Attorney General Letitia James. “Previous years of limiting commercial fluke fishing have shown us that the federal government’s reliance on erroneous data violates federal fisheries law and stunts commercial growth in the state. My office will continue to fight for fair treatment of those who depend upon on our commercial fishing industry.”

The suit, filed on October 10, charges the DOC of violating the Magnuson-Stevens Act (MSA) and the Administrative Procedures Act by not responding to the stocks northward migration over the years and instead relying on outdated allocation shares.

Summer flounder is co-managed by the Mid-Atlantic Fisheries Management Council and the Atlantic States Fisheries Commission for inshore and offshore waters in North Carolina, Virginia, Maryland, Delaware, New Jersey, New York, Rhode Island, Connecticut, Massachusetts, New Hampshire, and Maine.  Allocation to all 11 states has been based on historical catch data from 1980-89, data which New York’s DEC says are “obsolete.”

Allocation shares give 27.5% to North Carolina, 21.3% to Virginia, 16.7% to New Jersey, 15.7% to Rhode Island; 7.7% to New York, 6.8% to Massachusetts, with the remaining 5% to Connecticut, Maryland, Maine, Delaware, and New Hampshire.

That puts 5.6 mlbs of summer fluke landings at ports in North Carolina and Virginia while only .88mlbs at ports in New York, “even though the center of the biomass of summer flounder—and commercial fishing activity—is off Long Island,” states the suit.

“New York’s commercial fishing industry is a critical economic driver that has been held back by outdated federal restrictions for decades,” Governor Andrew Cuomo said. “After numerous attempts to work with the federal government to adjust this unfair quota, we’re forced to make our case through the courts to protect the hardworking men and women of this industry. We will not back down until these unreasonable limits on New York’s fishing industry are made right.”

“In the more than 30 years since those data were collected, the center of the summer flounder stock has shifted significantly northeast to the waters off New York’s coast,” wrote Plaintiff Basil Seggos, Commissioner of the New York State Department of Environmental Conservation (DEC).

“Boats from North Carolina and Virginia—states which have significantly larger quotas than New York predicated on the now obsolete landings data derived from the vastly different fishery of the 1980s—routinely travel hundreds of miles to waters off Long Island, fish, and then return hundreds of miles back to land their catch.

“Long Island-based boats have a far shorter trip to the prime fishing grounds but are constrained by New York’s small allocation—based on the same obsolete data—to return with far fewer fish than their southern counterparts.  To eke out a living, some New York boats have had to purchase North Carolina or Virginia licenses, catch summer flounder off Long Island, then sail hundreds of miles south to land their catch.”

The suit claims the management actions taken by DOC are inconsistent with four National Standards in the MSA: National Standard 2, which calls for “best scientific information” to be used in management decisions; NS 4, which prohibits discrimination between residents of different states; and NS 5 and 7, which require efficiency in the use of fishery resources and to minimize costs where practicable.

The suit asks the court to partially vacate the 2020–2021 Specifications Rule by invalidating New York’s quota and partially vacate the 1993 Allocation Rule by invalidating New York’s allocation and remand the Rules to Commerce for further proceedings.

Commercial landings of summer flounder peaked in 1984 at 37.77 million pounds and reached a low of 5.83 million pounds in 2017. Total ex-vessel value in 2018 was $25.27 million, resulting in an average price per pound of $4.11

The Council and ASFMC recently approved increases in quota for all the states if the coastwide commercial quota exceeds 9.55mlbs. In that case, NY would get 12.375% of the additional quota, as would six other states. But the modification will not be effective, if approved, until January 1, 2021.

The stock for summer flounder spawning females is at 98 million pounds, but recruitment is low. In addition, annual removals are above what the stock can currently replace, so forecasts are for declining abundance.

Recent changes in accounting for sport landings have also increased those removals historically.

The next benchmark stock assessment is tentatively scheduled for 2021.

DELAWARE: Governor’s Office seeking Mid-Atlantic Fisheries Management Council nominees

February 14, 2019 — The Office of Gov. John Carney is seeking candidates to be nominated for Delaware’s Obligatory Seat on the Mid-Atlantic Fisheries Management Council.

To be eligible for consideration as a nominee by the governor for selection to the MAFMC seat by the National Oceanic and Atmospheric Administration, individuals must be Delaware residents and must complete and submit a nomination application kit outlining their fisheries background, experience and ability to serve as a council member.

The MAFMC is responsible for managing fisheries in mid-Atlantic federal waters extending from three to 200 miles offshore from New York through North Carolina. MAFMC members must be prepared to attend six MAFMC meetings a year during a three-year term, with each meeting typically lasting four days. Council members are compensated by the MAFMC for travel expenses for transportation, hotel and meals and receive a stipend of $483.52 per meeting day.

NEW YORK: Fluke Regs Still Problematic

July 27, 2018 –The current two-week closure of the commercial fluke fishery has once again drawn the ire of State Assemblyman Fred W. Thiele, Jr. and State Senator Kenneth P. LaValle, who issued a joint statement last week calling for New York State to keep its promise to its commercial fishermen and immediately bring litigation to strike down the inequitable fluke quotas that continue to put a severe crimp on the economic viability of the state’s commercial industry.

On July 15, New York’s Department of Environmental Conservation announced that the fluke fishery would be closed in state waters until the end of the month and would then reopen with a harvest limit of 50 pounds per day.

In late 2017, Governor Cuomo promised to sue the federal government over the state’s low share of the East Coast fluke fishery. This spring, instead of bringing litigation, the state filed a petition with the United States Department of Commerce protesting the quota. The state has yet to hear back.

“These state-by-state quotas created by the Mid-Atlantic Fisheries Management Council and the U.S. Department of Commerce’s National Marine Fisheries Service, pursuant to the Magnuson-Stevens Act, are based upon faulty and incomplete collection data, which discriminate against commercial fishermen in the State of New York,” Mr. Thiele said in a statement. “As a result of these discriminatory practices, New York’s quota for a number of species of black sea bass, bluefish, scup, and fluke are much lower than would be allocated under a fair non-discriminatory system. New York’s summer flounder quota was less than half of that allocated to Rhode Island, New Jersey, Virginia, and North Carolina.”

Atlantic City charter boat captain reappointed to fisheries council

June 29, 2018 — Atlantic City charter boat Captain Adam Nowalsky has been reappointed for his second, three-year term on the Mid-Atlantic Fisheries Management Council.

Nowalsky has more than 20 years of saltwater fishing experience and is captain of the Karen Ann II, a 35-foot charter fishing vessel.

The Mid-Atlantic council is one of eight regional councils that work with the National Ocean Atmospheric Administration to manage ocean fish stocks, determining both fishing limits, and how allowable harvests are split between recreational and commercial fishermen and between states. Appointments are made by the U.S. Commerce Department.

The Mid-Atlantic council includes members from Delaware, Maryland, New Jersey, New York, North Carolina, Pennsylvania and Virginia.

NOAA Fisheries Proposes Rule Requiring Electronic Reporting for Charter/Party Vessels in the Mid-Atlantic Region

May 24, 2017 — The following was released by NOAA:

NOAA Fisheries announces a proposed rule that would require for-hire vessels with federal permits for some species managed by the Mid-Atlantic Fisheries Management Council to submit their vessel trip reports (VTRs) electronically. 

This action is not a change in reporting requirements; however, it is an administrative modification to the method for submitting VTRs.

This action is expected to:

  • Increase the timeliness (availability) of data submitted through VTRs;
  • Reduce the reporting burden on data providers (for-hire operators and/or captains) by eliminating the need of paper-based reporting; and
  • Increase the accuracy and quality of data by reducing recall bias associated with delayed completion and submission of paper forms.

Mid-Atlantic Fishery Management Council to Hold Hearings on New Jersey Special Management Zones

October 21st, 2016 — The following was released by the Mid-Atlantic Fishery Management Council: 

The Mid-Atlantic Fishery Management Council will hold three public hearings in November 2016 to gather public comments on a request by the State of New Jersey to designate 13 of its artificial reef sites located in federal waters as Special Management Zones (SMZ). The hearings will be held November 15-17, 2016. Written comments will be accepted until Friday, November 25, 2016, 11:59 p.m. EST.

Background

In November 2015, the New Jersey Department of Environmental Protection (DEP) petitioned the Mid-Atlantic Council to designate 13 artificial reef sites as SMZs under provisions of Amendment 9 to the Summer Flounder, Scup and Black Sea Bass Fishery Management Plan. The petition was based on the need to reduce gear conflicts between hook and line fishermen and fixed pot/trap gear at those sites. The SMZ designation could prohibit the use of any gear except hook and line and spear fishing within the 13 potential SMZ sites. The Council’s SMZ Monitoring Team (MT) evaluated the NJDEP request and recommended that the Council designate all 13 artificial reef sites as SMZs. The MT analysis indicated that commercial fishing vessels deploying pot/trap gear off the coast of New Jersey would likely face minimal to no losses in ex-vessel revenue if the artificial reefs are designated as SMZs. The Council is scheduled to review public comments and make a decision relative to NJ SMZ designation at its December 2016 meeting in Annapolis, MD.

Jersey Shore Fishing: MAFMC to vote on protecting federal waters reefs on Wednesday

October 5th, 2016 — The New Jersey Outdoor Alliance provided the following important notice:

This October 5th, 2016; NJOA’s continuing efforts to bring New Jersey’s offshore artificial reefs under the protection of a Special Management Zone (SMZ) enters formal review by the Mid-Atlantic Fisheries Management Council (MAFMC).   The SMZ Monitoring Team comprised of MAFMC staff members has released its recommendation regarding SMZ status for NJ’s 13 artificial reefs located in Federal waters.

To summarize, the SMZ Monitoring Team’s recommendation is “the SMZ Monitoring Team recommends that the Council designate all 13 New Jersey’s artificial reefs located in the EEZ as SMZs. The SMZ designation should stipulate that no fishing vessel or person on a fishing vessel may fish in the 13 New Jersey Special Management Zones with any gear except hook and line and spear fishing (including the taking of fish by hand)”

The SMZ report will be presented at the MAMFC’s October meeting at the Stockton Seaview Hotel, 401 S New York Rd,  Galloway, NJ, 08205.
