New Owner May Reopen Fish Company After Food Safety Upgrade

February 17, 2016 — The federal court documents that Friday led to the mandatory closure of the Sullivan Harbor Farm smokehouse in Hancock, ME, also included  a lengthy recipe for re-opening the facility known for annually smoking as much as 75,000 pounds of Atlantic salmon.

Friday’s consent decree of permanent injunction, ordered by a federal judge, shut down Mill Stream Corp., doing business as Sullivan Harbor Farm on U.S. 1 in Maine. The injunction also prohibits the company’s former president and owner, Ira J. Frantzman, from working in the food industry. The injunction is in response to a Feb. 10 complaint by the U.S. Department of Justice at the behest of the U.S. Food and Drug Administration (FDA).

But ahead of the Feb. 12 injunction, in late January, Sullivan Harbor Farm reportedly was sold.

“The new owner has already made most of the necessary improvements while working with a food safety expert in conjunction with FDA to improve safety, sanitation and training practices in anticipation of reopening soon, bringing award winning products back into the marketplace,” stated a Sullivan Harbor Farm post Monday on the company’s Facebook page.

It did not disclose the name of the new owner, but said whoever it is plans to “move forward with new concepts, while continuing the 25 year tradition of producing safe, tasty artisanal smoked seafood.”

NOAA Cuts Monitor Days for Massachusetts Lobstermen

February 16, 2016 — NOAA Fisheries has recalibrated its method for determining the requisite sea days of observer coverage for lobster boats, resulting in decreased coverage for Massachusetts-based lobstermen and increased coverage for those based in Maine in the final quarter of this fishing season.

The National Oceanic and Atmospheric Administration, responding to criticisms from Bay State lobstermen, re-allotted the number of sea-days after expanding the pool of vessels eligible for observer coverage to include all federally permitted lobster boats rather than just those holding limited-use, multi-species permits that require the filing of vessel trip reports (VTRs).

The result is that for the final quarter of the 2015 fishing season (Jan. 1 to March 31), Massachusetts lobstermen will have six sea-days of mandated observer coverage, down from the previously scheduled 18. Maine lobstermen, however, will see their mandated sea-days of observer coverage rise to 33 from the originally scheduled 14 in the same period.

The modified methodology also means that New Hampshire and Rhode Island lobstermen will have one day of mandated observer coverage respectively in the final quarter of the 2015, down from the previously scheduled five for New Hampshire and four for Rhode Island.

Amy Martins, manager of NOAA’s Northeast Fisheries Observer Program (NEFOP) that provides the observer coverage for lobster boats, said the new method for determining observer coverage will continue into the 2016 fishing season that begins May 1.

Maine Seafood Company Shut Down For Food Safety Violations

February 14, 2016 — A high-end Hancock seafood company has been shut down for repeated unsanitary conditions and food safety violations, including manufacturing in the presence of rodent excrement, according to the U.S. Department of Justice.

U.S. District Judge Jon D. Levy on Friday signed a consent decree of permanent injunction against Mill Stream Corp., which does business as Sullivan Harbor Farm, and its owner, Ira Joel Frantzman.

The action followed more than a decade of warnings to the company by the Food and Drug Administration, which found the company’s smoked fish products were being prepared, packed and held under unsanitary conditions so that the products may have become contaminated with filth or rendered injurious to health, says a complaint filed by the Justice Department in U.S. District Court in Maine.

The company, founded in 1992, has annually made about 75,000 pounds of ready-to-eat smoked fish and fishery products, such as smoked salmon, trout and char, which are sold across the country. Customers include Legal Sea Foods in Boston and Dean & DeLuca of New York. The company’s smoked fish products have received a number of food industry awards.

Amid boom in catch, debate rages over lobster license rules

February 10, 2016 — AUGUSTA, Maine (AP) — Members of the next generation of Maine lobster fishermen say they fear they will never get a license to fish for the valuable critters, but some longstanding lobstermen fear changing the rules could result in overfishing.

A key Maine legislative panel held a public hearing on Wednesday on changes designed to streamline the process of obtaining one of about 5,800 lobstering licenses in the state. The call for changes comes as Maine lobsters have grown in value in recent years, and prices have held steady for consumers as lobstermen’s catches have boomed, resulting in heavy supply.

A vote could come as early as Feb. 17.

There are nearly 300 people on the waiting list for a license, and some have been on the list for more than a decade. Ethan DeBery, a Phippsburg lobsterman who completed an apprenticeship and has been on the list for seven years, said the current system isn’t fair.

Maine Coldwater Shrimp Research Survey Harvests Fall Short of Predictions

February 10, 2016 — Maine shrimp lovers are hoping for the best this winter. With the shrimp population in decline over the past few years, and the Gulf of Maine shrimp fishery being closed for the third season in a row to shrimp trappers and trawlers, there won’t be much Maine shrimp in markets, restaurants or on dinner tables again this year.

But thanks to a study being conducted by the Atlantic States Marine Fisheries Commission (ASMFC) and the states of Maine, New Hampshire and Massachusetts, four trawlers and two trappers have been selected to collect samples of northern shrimp from the Gulf of Maine.

Marine biologists will use the data to determine the timing of the egg hatch, and the size, gender and developmental stage of the shrimp, according to biologist Margaret Hunter of the Maine Department of Marine Resources (DMR). A total catch of 48,500 pounds from the Gulf of Maine is being allowed. Any shrimp not used in the study may be sold by the fishermen.

Each participating trawler is required to conduct five research trips in one region, and is being compensated $500 per trip. Each would be allowed to sell up to 1,800 pounds of shrimp per trip.

The two shrimp-trapping vessels are required to continue hauling until the shrimp have hatched off all their eggs. Each is allowed 40 traps, and may haul as often as necessary during the project, with a 600-pound weekly catch limit. The shrimp may be sold, but there will be no other compensation for the trappers.

Despite the best efforts of local trapper Bill Sherburne, as of yet, the shrimp catch has not met his expectations.

As of Feb. 1, Sherburne said he hadn’t done as well as he had hoped. “It makes a difference where the traps are placed. They don’t come close to shore until the water cools down.”

Atlantic herring fishing rules changed to reduce waste

February 9, 2016 — PORTLAND, Maine (AP) — Interstate fishing regulators say the rules for fishing Atlantic herring have changed in an attempt to reduce waste.

An amendment to the herring rules says the holds of the fishing boats where the catch is stored must be empty before the ship departs. The Atlantic States Marine Fisheries Commission says the change will encourage fishermen to harvest the fish in line with market demand.

Maine lobster industry wary as warm waters suggest repeat of disastrous 2012 season

February 4, 2016 — For those in the lobster industry, any sign of a return to the conditions of 2012 is cause for high anxiety.

Researchers say the industry needs to be prepared for that possibility because warming trends are laying the groundwork for a potential repeat of the disastrous season of four years ago.

“We learned a hard lesson in 2012,” said Patrice McCarron, executive director of the Maine Lobstermen’s Association.

Because of warm waters in the Gulf of Maine, peak harvesting started in May that year, weeks ahead of schedule. The catch jumped more than 20 percent, from 104 million pounds in 2011 to 127 million pounds in 2012. The shedding season, when lobsters lose their hard shells and grow new ones, typically happens in June and results in soft-shelled lobsters that are difficult to transport. In 2012, shedding began almost as soon as the lobstermen started pulling in traps, and extended into the fall.

As a result, prices paid to lobstermen fell to as low as $2 a pound.

Andrew Pershing, chief scientific officer at the Gulf of Maine Research Institute in Portland, said Thursday that the stage is set for a possible repeat of 2012, at least weather-wise.

Pershing said five buoys that measure water temperatures around the gulf are all running above average, and three are at record highs.

“The average surface temperature across the entire Gulf of Maine is now slightly warmer than during the 2012 ocean heat wave,” Pershing said.

Coast Guard aids disabled fishing vessel off Maine

February 5, 2016 —  BOSTON — The Jocka, a fishing boat with a crew of four aboard, had to be towed to port by the Coast Guard from 45 miles southeast of Portland, Maine, after the engine became disabled.

“It was a pretty rough night, but they’re almost in and everybody’s OK,” ship owner Terry Alexander said late Thursday afternoon. “They just had to sit it out because of the weather.”

At approximately 7:30 a.m. Wednesday, a crew member aboard the Jocka used a VHF-FM radio to contact Coast Guard watchstanders to report the ship’s engine was disabled and the crew needed assistance, the Coast Guard said in a press release.

The boat is owned by the corporation Jordan Lynn Inc. is which headed by New England Fishery Management Council member and former chairman Terry Alexander. The home address for the corporation is Harpswell, Maine, though Alexander said Thursday the Jocka’s hailing port is Boston. He said none of the crew was from Cape Ann.

Alexander said the boat, which is registered in Massachusetts and permitted for off-shore, non-trap lobstering, experienced general engine failure Wednesday and had to stay out on the water overnight because of the harsh weather conditions made it difficult for the Coast Guard to get a line to the 61-foot trawler.

The crew aboard the 110-foot Coast Guard cutter Ocracoke, homeported in South Portland, Maine, responded to the hail for help. Ocracoke had arrived on-scene at approximately 3:15 p.m. Wednesday, but, as Alexander said, was unable to get Jocka in tow due to the weather, the Coast Guard reported.

Fish Farming In Gulf Poses Questions And Opportunities

February 3, 2016 — Most of the fish we eat in the U.S. comes from other countries. Fishermen in Louisiana have long sought to displace some of those imports but the industry has faced challenges like hurricanes and the 2010 BP oil spill.

Now, a new source of fish in the gulf offers promise — but also raises questions.

For the first time, the Gulf of Mexico is open for fish farming.

Companies can apply for permits through the National Oceanic and Atmospheric Administration, the Army Corps of Engineers and the Environmental Protection Agency. Then they can install floating fish cages — like those already in place in state waters off the coasts of Maine, Washington and Hawaii.

Harlon Pearce owns Harlon’s LA Fish, which sells local fish to restaurants and grocery stores across the south. On a recent afternoon his refrigerated warehouse in Kenner was full of them. He pointed to yellowfin tuna, snapper, black drum and sheep’s head. It doesn’t always look this way.

Pearce, who is on the board of the Gulf Seafood Institute, says he freezes a lot of his fish in order to meet continuous demand, but ultimately always runs out. He wants to sell nationwide and contract with big chains, like Red Lobster, but he says, “We never have enough fish to supply the markets. Never.”

That’s true for a couple of reasons – the seafood industry in the Gulf still hasn’t bounced back from the 2010 BP oil spill, but it’s always fluctuated due to hurricanes and pollution.

Maine to pay for research in effort to keep lobster fishery healthy

February 4, 2016 — Maine’s lobsters are about to get new scrutiny.

The Department of Marine Resources has put out a call for proposals to gauge the impact of warming Gulf of Maine waters on lobster biology, populations and susceptibility to disease. A separate study will attempt to measure the economic impact of Maine’s most valuable fishery beyond what lobstermen are paid for their catch.

The department has earmarked up to $700,000 to pay for the studies, with the money coming out of the Lobster Research, Education and Development Fund. The money in that fund comes from sales of the lobster license plate.

Research proposals are due Thursday. The department’s request for proposals suggests the contracts will be awarded by early March, but department spokesman Jeff Nichols said the timing depends on how many proposals are received and how quickly a panel is formed to review them.

The department said it needs the research to determine how to help maintain the industry’s remarkable health over the past 20 or 30 years. Lobster landed in Maine was valued at a record $465.9 million in 2014, up more than fourfold in the past two decades. The catch by 5,818 commercial license holders made up 78 percent of the value of commercial fishery landings in the state.

Carl Wilson, director of the department’s Bureau of Marine Science, said “there are sufficient questions” about what’s happening with climate change and its impact on the Gulf of Maine to warrant more study.
