ASMFC Atlantic Menhaden Board Initiates Addendum on Fishery Measures

August 6, 2021 — The following was released by the Atlantic States Marine Fisheries Commission:

The Atlantic States Marine Fisheries Commission’s Atlantic Menhaden Management Board initiated an addendum to Amendment 3 to consider changes to commercial allocations, the episodic event set aside (EESA) program, and the incidental catch and small-scale fisheries provision. This action responds to the recommendations of a Board work group charged with evaluating provisions of the current management program and providing strategies to refine those provisions.

Amendment 3 (2017) established commercial fishery allocations, allocating a baseline quota of 0.5% to each jurisdiction with the rest of the total allowable catch (TAC) allocated based on historic landings between 2009 and 2011. The work group report outlined landings have shifted in recent years, with some states landing significantly more quota (through transfers and other FMP provisions) than they are allocated due to changes in abundance of menhaden and availability of other bait fish. The Board action aims to align state quotas with recent landings and availability while maintaining access to the resource for all states, reduce dependence on quota transfers, and minimize regulatory discards.

The addendum will also propose changes to the EESA and incidental catch and small-scale fisheries provisions. Both provisions have been impacted by recent trends in landings, most notably in New England where states rely on the EESA to keep their commercial fishery open while working to secure quota transfers. The increasing abundance of menhaden in New England has also led to a rise of landings under the incidental catch and small-scale fisheries provision once commercial quotas have been met. The Board is interested in exploring options to promote accountability such as capping the total amount of landings under this category or to count these landings against the TAC. Management alternatives for the incidental catch and small-scale fisheries will also consider changes to the current eligibility of gear types under the provision. In addition to these topics, the Board indicated the management document should maintain flexibility to respond to management needs in the future.

ASMFC Begins Preparations for American Eel Benchmark Stock Assessment

August 11, 2020 — The following was released by the Atlantic States Marine Fisheries Commission:

The Atlantic States Marine Fisheries Commission has begun work on the next American Eel Benchmark Stock Assessment and is requesting data from academia, member states, federal partners, participating jurisdictions and stakeholders. A data workshop has not been scheduled yet but is likely to occur in late 2020.

The Commission welcomes the submission of data sources that will improve the accuracy of the assessment. This includes, but is not limited to, data on catch per unit effort (young-of-the-year surveys, yellow eel surveys), biological samples (lengths, ages, stage data), and life history information (growth, maturity, natural mortality). For data sets to be considered, the data must be sent in the required format with accompanying description of methods to Dr. Kristen Anstead, Stock Assessment Scientist, at kanstead@asmfc.org by October 1, 2020.

Low quotas, high prices for herring will persist

April 14, 2020 — Since the late 19th century, New England’s commercial Atlantic herring fishery was tied to both the canning industry and the lobster fishery, and the connections to today’s lucrative lobster industry continue. For this reason, changes in the herring industry have wide-reaching ripple effects.

The 2018 benchmark stock assessment revealed changes to stock health and concerns about trends in recruitment and spawning stock biomass. In fact, 2016 recruitment was the lowest on record at 1.7 million fish.

The 2018 landings, says Kirby Rootes-Murdy of the Atlantic States Marine Fisheries Commission, were 43,772 metric tons with an ex-vessel value of $23 million. In 2019, the quota was slashed by more than half.

By the end of 2019, preliminary figures say more than 12,700 metric tons of herring were landed, according to Min-Yang Lee of the Northeast Fisheries Science Center. The value was $9.45 million.

Suzannah Raber, owner of New England Fish Co, a bait company, says markets have shifted.

“We used to send herring to Canada,” says Raber. “But now, 95 percent of our herring goes to lobster bait. We catch it and distribute it.” These days, Raber’s company targets mackerel this time of year, then goes seining for herring in summer.

ASMFC Atlantic Herring Board Approves Draft Addendum III for Public Comment

February 4, 2020 — The following was released by the Atlantic States Marine Fisheries Commission:

The Atlantic States Marine Fisheries Commission’s Atlantic Herring Management Board approved Draft Addendum III to Amendment 3 of the Interstate Fishery Management Plan for Atlantic Herring for public comment. The Draft Addendum proposes options to better manage the Area 1A (inshore Gulf of Maine) sub-annual catch limit (ACL) under low quota scenarios. This action responds to the challenges encountered in managing the reduced sub-ACL based on the 2018 benchmark stock assessment, which highlighted declining trends in recruitment and spawning stock biomass.

Currently, the Board can allocate the sub-ACL throughout the fishing season using bi-monthly, trimester, or seasonal quota periods to meet the needs of the fishery. For the 2019 fishing season, the Board implemented a bimonthly quota period approach to maximize use of the reduced sub-ACL when demand for bait is high. Due to the low quota, the 2019 fishery experienced frequent closures to avoid an overage. The 2020 sub-ACL (3,344 mt) is lower than in 2019, creating further challenges in distributing the quota throughout the fishing season. The Draft Addendum considers additional tools to provide the Board more flexibility in specifying the allocation under low quota scenarios and meet the needs of the herring fishery moving forward. 
 
Additionally, the Draft Addendum considers expanding landing provisions across different permit categories within the days out program. The Board utilizes days out of the fishery and weekly landing limits to adjust the rate of Area 1A catch. The Draft Addendum includes options that apply weekly landing limits to all vessel categories landing herring in Area 1A throughout the entire fishing season.
 
Interested groups are encouraged to provide input on the Draft Addendum either by attending state public hearings or providing written comment. The Draft Addendum will be available on the Commission website (www.asmfc.org) under Public Input by February 12, 2020. Herring Fishing To Be Limited Off New England For Months

December 4, 2019 — The inshore waters of the Gulf of Maine from Cape Cod to the Canadian border have been closed to herring fishing through the end of the year to prevent overharvesting.

Federal regulators cut this year’s catch limit for Atlantic herring based on last year’s stock assessment. Kirby Rootes-Murdy, with the Atlantic States Marine Fisheries Commission, says regulations mandate that the fishery must be closed when 92% of the area catch limit has been harvested.

“There is a by-catch allowance, which is the non-directed fishery,” says Rootes-Murdy. “Two thousand pounds can be taken incidentally, but the directed fishery is closed.”

ASMFC Atlantic Herring Board Approves Addendum II

May 1, 2019 — The following was published by the Atlantic States Marine Fisheries Commission:                                                                                                                                                                                                                The Atlantic States Marine Fisheries Commission’s Atlantic Herring Management Board approved Addendum II to Amendment 3 of the Interstate Fishery Management Plan for Atlantic Herring. The Addendum strengthens spawning protections in Area 1A (inshore Gulf of Maine) by initiating a closure when a lower percentage of the population is spawning (from approximately 25% to 20%) and extending the closure for a longer time (from four to six weeks). The Addendum also modifies the trigger level necessary to reclose the fishery, with the fishery reclosing when 20% or more of the sampled herring are mature but have not yet spawned. These changes to spawning protections are in response to the results of the 2018 Benchmark Stock Assessment which showed reduced levels of recruitment and spawning stock biomass over the past five years, with 2016 recruitment levels the lowest on record.
 
Under Amendment 3, the Board uses a series of closures to protect spawning aggregations in the Gulf of Maine. Biological samples are used to annually project the start of the spawning closures. A recent analysis by the Atlantic Herring Technical Committee found that while the spawning closure system was significantly improved under Amendment 3, the protocol could continue to be strengthened by considering when, and for how long, a closure is initiated. Specifically, the analysis showed greater protection could be provided by initiating a closure when a lower percentage of the population is spawning and extending the closure for a longer time. 
 
The states are required to implement Addendum II’s measures by August 1, 2019. The Addendum will available on the Commission website (www.asmfc.org) on the Atlantic Herring page by mid-May. The Draft Addendum proposes options to strengthen spawning protections in Area 1A (inshore Gulf of Maine). The Draft Addendum responds to the results of the 2018 benchmark stock assessment, which show reduced levels of recruitment and spawning stock biomass over the past five years, with 2016 recruitment levels the lowest on record.

 Currently, the Board uses a series of closures to protect spawning aggregations in the Gulf of Maine. These closures, which were implemented through Amendment 3, use biological samples to annually project the start of spawning. The closures are initially implemented for four weeks but can be extended by two additional weeks if samples indicate the continued presence of spawning herring. Recent analysis by the Atlantic Herring Technical Committee found that while the current spawning closure system was significantly improved under Amendment 3, the protocol could continue to be strengthened by considering when, and for how long, a closure is initiated. Specifically, the analysis showed, under the current protocol, spawning closures are initiated when there are approximately 25% spawners in the fishery; greater protection could be provided by initiating a closure when a lower percentage of the population is spawning and extending the closure for a longer time. As a result, Draft Addendum II considers extending the length of the spawning closures as well as altering the point at which closures are triggered in order to provide greater protection to the stock.
 
Fishermen and others interested in Atlantic herring management are encouraged to provide input on the Draft Addendum by attending state public hearings, participating in the webinar hearing, or providing written comment. Regulators approve Maine elver quota

October 24, 2017 — NORFOLK, Va. — Interstate fisheries regulators voted last week to approve Maine’s elver landings quota for another year.

Meeting in Norfolk, Va., on Oct. 17, the American Eel Board of the Atlantic States Marine Fisheries Commission authorized Maine harvesters to land up to 9,688 pounds of elvers during the upcoming 2018 fishing season. That is the same quota the fishery has operated under for the past three years.

They also initiated an addendum to consider alternative allocations, management triggers and coastwide caps relative to the current management program for both the yellow and glass eel commercial fisheries starting with the 2019 fishing season.

Back in 2014, for the first time, the ASMFC established a quota for Maine’s glass eel (elver) landings. The quota governed the 2015 through 2017 fishing seasons. The regulators agreed to review that quota allocation before the 2018 season.

American Eel Stock Assessment Update Finds Resource Remains Depleted

October 19, 2017 — NORFOLK, Va. — The following was released by the Atlantic States Marine Fisheries Commission:

The Atlantic States Marine Fisheries Commission’s American Eel Management Board reviewed the results of the 2017 American Eel Stock Assessment Update, which indicates the resource remains depleted. The assessment updates the 2012 American Eel Benchmark Stock Assessment with data from 2010-2016. Trend analyses of abundance indices indicated large declines in abundance of yellow eels during the 1980s through the early 1990s, with primarily neutral or stable abundance from the mid-1990s through 2016. Total landings remain low but stable. Based on these findings, the stock is still considered depleted. No overfishing determination can be made based on the analyses performed.

The American eel fishery primarily targets yellow eel. Glass eel fisheries along the Atlantic coast are prohibited in all states except Maine and South Carolina. In recent years, Maine is the only state reporting significant glass eel harvest. The highest total landings of all life stages occurred from the mid-1970s to the early 1980s after which they declined. Since the 1990s, landings have been lower than historical landings and have been stable in recent decades. The value of U.S. commercial American eel landings has varied from a few hundred thousand dollars (prior to the 1980s) to a peak of $40.6 million in 2012 (largely driven by the price of glass eels).

The 2012 benchmark stock assessment found the resource depleted and Addenda III (2013) and IV (2014) were approved with the goal of reducing mortality across all life stages. These addenda established a 9-inch minimum size limit for commercial and recreational fisheries, a yellow eel commercial coastwide cap of 907,671 pounds, and glass eel quota of 9,688 pounds for Maine beginning for the 2015 fishing year. The yellow eel cap has two management triggers: (1) the coastwide cap is exceeded by more than 10% in a given year and (2) the coastwide cap is exceeded for two consecutive years, regardless of the percent over. If either trigger is met, there is an automatic implementation of state-by-state quotas. The 2015 yellow eel landings were below the cap. However, 2016 landings were 925,798 pounds, which exceeded the cap by less than 10%.

It was developed to aid media and interested stakeholders in better understanding the results. The assessment update will be available on the Commission website on the American Eel webpage the week of October 23rd.

In other business, the Board maintained Maine’s glass eel quota of 9,688 pounds for the 2018 fishing season. The Board also initiated an addendum to consider alternative allocations, management triggers, and coastwide caps relative to the current management program for both the yellow and glass eel commercial fisheries starting for the 2019 fishing season.

NEW JERSEY: Measuring flounder a complex undertaking with a big impact

March 27, 2017 — It’s likely few people have written more about summer flounder than Mark Terceiro.

Terceiro has published a 44-page journal article about the science, politics and litigation surrounding the species from 1975 to 2000. A 32-page follow-up covered the period from 2001 to 2010, and another article regarding developments in recent years is in the works.

But it’s Terceiro’s summer flounder stock assessment update, released by the National Oceanic and Atmospheric Administration in December, that has him in the crosshairs of New Jersey politicians and recreational fishing leaders.

That’s because his report led federal regulatory agencies to reduce this year’s summer flounder catch by 30 percent.

Some say the move will cripple recreational flounder fishing, a multimillion-dollar industry in New Jersey that supports bait-and-tackle shops, boat dealerships and other businesses that cater to fishermen.

“It is based on a questionable, out-of-date stock assessment and a flawed modeling,” Bob Martin, commissioner of the New Jersey Department of Environmental Protection, wrote in a letter to Commerce Secretary Wilbur Ross last month.

But federal fisheries experts, including Terceiro, say they have confidence in the measurements, which show the flounder population has been “experiencing overfishing” since 2008.

“A stock assessment is one of our best ways to estimate the population and status of a resource we manage,” said Kirby Rootes-Murdy, senior fishery management plan coordinator for summer flounder at the Atlantic States Marine Fisheries Commission, one of the agencies that regulate the species.
