Lobstermen may have to give up their secrets

January 10, 2018 — ELLSWORTH, Maine — The antiregulatory fervor sweeping the nation’s capital doesn’t seem to extend as far as the Gulf of Maine, at least not for lobster and Jonah crab fishermen.

This week, the Atlantic States Marine Fisheries Commission is holding two public hearings in Maine on a plan to impose new reporting requirements in the offshore lobster and crab fisheries. One hearing was scheduled for Scarborough on Tuesday evening. The other is scheduled for 6 p.m. today, Thursday, Jan. 11, at Ellsworth High School.

The ASMFC is concerned that it does not have enough data about the lobster and Jonah crab fisheries to make appropriate management decisions.

Ten percent of Maine lobstermen, chosen annually at random, are required to file monthly landing reports with the Department of Marine Resources about where and how they fish. The reports include detailed data about the geographic location of traps, how long they have been set and at what depths, how many traps are hauled on each trip, the total pounds landed and more.

Lobstermen licensed by other New England states already file detailed reports with their state resource management agencies.

Only about 20 percent of Maine’s roughly 5,000 commercial lobstermen also hold the federal permits required to fish outside the 3-mile limit of state waters, and even fewer fish in the really deep waters beyond 12 miles from shore. According to the ASMFC, some 98 percent of lobster landings from the Gulf of Maine come from inside that 12-mile zone, so reports of what’s happening in the offshore lobster fishery are generally scarce. What’s more, unlike most fishermen operating in federal waters, federal permit holders fishing only for lobster are not required to report their trips to the National Marine Fisheries Service via electronic reporting devices. No separate landing reports are currently required for Jonah crab.

ASMFC American Lobster Board Approves Draft Addenda XXVI & III to the American Lobster and Jonah Crab FMPs for Public Comment

October 17, 2017 — NORFOLK, Virginia — The following was released by the Atlantic States Marine Fisheries Commission

The Atlantic States Marine Fisheries Commission’s American Lobster Management Board approved American Lobster Draft Addendum XXVI/Jonah Crab Draft Addendum III for public comment. Given the same data collection needs apply to both American lobster and Jonah crab fisheries, Draft Addendum XXVI and Draft Addendum III are combined into one document that would modify management programs for both species upon its adoption. The Draft Addenda seek to improve harvest reporting and biological data collection in the American lobster and Jonah crab fisheries. The Draft Addenda propose using the latest reporting technology, expanding the collection of effort data, increasing the spatial resolution of harvester reporting, and advancing the collection of biological data, particularly offshore.

Recent management action in the Northwest Atlantic, including the protection of deep sea corals, the declaration of a national monument, and the expansion of offshore wind projects, have highlighted deficiencies in current American lobster and Jonah crab reporting requirements. These include a lack of spatial resolution in harvester data and a significant number of fishermen who are not required to report. As a result, efforts to estimate the economic impacts of these various management actions on American lobster and Jonah crab fisheries have been hindered. States have been forced to piece together information from harvester reports, industry surveys, and fishermen interviews to gather the information needed. In addition, as American lobster and Jonah crab fisheries continue to expand offshore, there is a greater disconnect between where the fishery is being prosecuted and where biological sampling is occurring. More specifically, while most of the sampling occurs in state waters, an increasing volume of American lobster and Jonah crab are being harvested in federal waters. The lack of biological information on the offshore portions of these fisheries can impede effective management.

The Draft Addenda present three questions for public comment: (1) what percentage of harvesters should be required to report in the American lobster and Jonah crab fisheries; (2) should current data elements be expanded to collect a greater amount of information in both fisheries; and (3) at what scale should spatial information be collected. In addition, the Draft Addenda provide several recommendations to NOAA Fisheries for data collection of offshore American lobster and Jonah crab fisheries. These include implementation of a harvester reporting requirement for federal lobster permit holders, creation of a fixed-gear VTR form, and expansion of a biological sampling program offshore.

It is anticipated the majority of states from Maine through New Jersey will be conducting public hearings on the Draft Addenda. The details of those hearings will be released in a subsequent press release. The Draft Addenda will be available on the Commission website, www.asmfc.org (under Public Input) by October 27th. Fishermen and other interested groups are encouraged to provide input on the Draft Addenda either by attending state public hearings or providing written comment. MAINE: Crab bycatch rule set

February 7, 2017 —  The Atlantic States Marine Fisheries Commission’s American Lobster Management Board approved Addendum II to the Jonah Crab Fishery Management Plan (FMP). The addendum establishes a coast-wide standard for claw harvest and a definition of bycatch, based on a percent composition of catch, in order to minimize the expansion of a small-scale fishery under the bycatch allowance.

The lobster board is in charge of Jonah crab management, as the fisheries are linked in many states. Many fishermen fish for both species with the same gear.

Some crab fishermen keep only crab claws and throw back the rest of the crab. Under a provision in the 2015 FMP, only fishermen from New Jersey, Delaware, Maryland and Virginia who have a history of claw landings prior to June 2, 2015, were allowed to harvest claws. All other fishermen were required to land whole crabs only.

The commission discovered that there also were fishermen in New York and Maine who had a history of claw landings but they were required to land whole crabs under the provisions of the FMP.

ASMFC American Lobster Board Approves Jonah Crab Addendum II

February 2, 2017 — Alexandria, VA — The following was released by the Atlantic States Marine Fisheries Commission: 

Alexandria, VA – The Atlantic States Marine Fisheries Commission’s American Lobster Management Board approved Addendum II to the Jonah Crab Fishery Management Plan (FMP). The Addendum establishes a coastwide standard for claw harvest and a definition of bycatch, based on a percent composition of catch, in order to minimize the expansion of a small-scale fishery under the bycatch allowance.  

The Addendum responds to concerns regarding the equity of the claw provision established in the 2015 FMP, which instituted a whole crab fishery with the exception of fishermen from New Jersey, Delaware, Maryland, and Virginia who have a history of claw landings prior to June 2, 2015. Following approval of the FMP, claw fishermen from New York and Maine were identified and, while these fishermen had a history of claw landings, they were required to land whole crabs under the provisions of the FMP. Addendum II permits claw harvest coastwide. Specifically, the Addendum allows Jonah crab fishermen to detach and harvest claws at sea, with a required minimum claw length of 2.75” if the volume of claws landed is greater than five gallons. Claw landings less than five gallons do not have to meet the minimum claw length standard. Fishermen may also harvest whole crabs which meet the 4.75” minimum carapace width.

 Addendum II also establishes a definition of bycatch in the Jonah crab fishery, whereby the total pounds of Jonah crabs caught as bycatch must weigh less than the total amount of the targeted species at all times during a fishing trip. The intent of this definition is to address concerns regarding the expansion of a small-scale fishery under the bycatch limit. Prior to this Addendum, a non-trap or non-lobster trap fisherman could land 1,000 crabs as bycatch but was not required to have any other species of catch on-board. Through Addendum II, fishermen harvesting under the bycatch limit must have another species on board of greater weight than landed Jonah crabs.

ASMFC American Lobster Board Approves Jonah Crab Draft Addendum II for Public Comment

October 28th, 2016 — The following was released by the Atlantic States Marine Fisheries Commission: 

The Atlantic States Marine Fisheries Commission’s American Lobster Management Board approved Draft Addendum II to the Jonah Crab Fishery Management Plan (FMP) for public comment. The Draft Addendum considers establishing a coastwide standard for claw harvest to address concerns regarding the equity of the current claw provision. Specific options include establishing a whole crab fishery or allowing for the harvest of claws coastwide. The Draft Addendum also considers establishing a definition of bycatch, based on a percent composition of catch, in order to minimize the expansion of a small-scale fishery under the bycatch allowance. 

The FMP currently establishes a whole crab fishery with the exception of fishermen from NJ, DE, MD, and VA who have a history of claw landings prior to June 2, 2015. Following approval of the FMP, claw fishermen from NY and ME were identified. Currently, these fishermen are required to land whole crabs. As a result, jurisdictions have expressed concern regarding the equity of this provision as some fishermen with a history of claw landings are allowed to continue this practice while others must land whole crabs.

In order to address concerns regarding the expansion of a small-scale fishery, consideration of a bycatch definition was added as a second issue in the Draft Addendum. Addendum I established a bycatch allowance of 1,000 crabs per trip for non-trap gears and non-lobster trap gears (i.e., fish pots, crab pots, whelk traps). Fishermen using these gears are not required to have other species on Board when harvesting Jonah crab. As a result, fishermen harvesting Jonah crab under the bycatch limit may, in fact, directly target Jonah crab by landing 1,000 crabs per trip and nothing else. This does not reflect the intention of the bycatch allowance which is to account for Jonah crab caught while targeting another species.

The Draft Addendum will be available on the Commission website, www.asmfc.org (under Public Input) by mid-November. It is anticipated that the majority of states of Maine through Maryland will be conducting public hearings; the details of those hearings will be released in a subsequent press release. The Draft Addendum proposes changes to the incidental bycatch limits for non-trap gear (e.g., otter trawls, gillnets) and non-lobster trap gear (e.g., fish, crab, and whelk pots). For non-trap gear, the Draft Addendum includes options to maintain, increase, or eliminate the bycatch limit, while options for non-lobster traps include establishing bycatch limits of varying size or maintaining no limit on these gears. The intent of the Draft Addendum is to cap incidental landings of Jonah crab while ensuring the inclusion of current participants in the Jonah crab fishery. The FMP currently prescribes a 200 crab per calendar day/500 crab per trip incidental bycatch limit for non-trap gear; however, concerns were expressed over the appropriateness of these limits. Data submitted by the New England Fishery Management Council and NOAA Fisheries illustrate while 97-99% of trips from 2010 through 2014 were within the current limit, there were several trips above the limit. Furthermore, current bycatch landings were sufficiently low, accounting for approximately 0.1% of total landings.

Bycatch limits for non-lobster trap gear were added as a second issue for consideration in the Draft Addendum to address concerns regarding the lack of effort controls on non-lobster traps and the potential for trap proliferation. Data submitted by NOAA Fisheries show between May 1, 2013 and August 31, 2015, 194 trips landed Jonah crab with whelk pots, crab pots, and fish pots. Of these, 80 trips landed 100 crab or fewer and 115 trips landed 200 crab or fewer.  Approximately 45 trips landed between 200 and 500 crab and 40 trips landed more than 450 crab.  Landings from Maryland show between 2012 and 2015, 33 trips landed Jonah crab with fish pots. All of these trips were under 200 pounds. Reports also indicated from 2014-2015, 36 trips landed Jonah crab with whelk pots. Average landings per trip with whelk pots were under 500 pounds; however, there is concern that these whelk pot landings may in fact be rock crab, a closely related species which is often misreported as Jonah crab.

Fishermen and other interested groups are encouraged to provide input on the Draft Addendum either by attending state public hearings or providing written comment. CFRF Completes Three Multi-Year NOAA Awards

February 24, 2015 — The following was released by the Commercial Fisheries Research Foundation (CFRF):

The CFRF is proud to announce the successful completion of three major multi-year NOAA awards spanning the past seven years. The awards were issued through the National Marine Fisheries Service with the funding secured through efforts made by U.S. Senator Jack Reed (RI-D). The work completed under these awards focused on supporting collaborative fisheries research projects important to the sustainable management of fisheries resources in the southern New England region, and involved some 151 members of the commercial fishing industry, 108 researchers and students, and 25 fisheries managers from Rhode Island and across the region. Anna Malek Mercer, CFRF Executive Director, noted that “the projects that CFRF supported and conducted through these awards demonstrate the importance of implementing a collaborative approach to fisheries research to produce applicable results and build trust between the fishing industry, science community, and management system.”

During the seven years of work, the CFRF administered $5.8 million that supported over 30 research projects covering subjects such as conservation gear engineering, bycatch reduction, lobster settlement and recruitment, spiny dogfish stock dynamics, discard mortality estimation, fish habitat characterization, shellfish larval dynamics, industry based biological data collection, underutilized species processing, state fishery profiles, and supplementary trawl and trap surveys, among others. Fred Mattera, CFRF Vice President and owner of the Northeast Safety Training Company, noted that “CFRF has been extremely successful in conservation engineering research, establishing a rich dialogue between fishermen and gear experts that has resulted in a number of new tools to minimize bycatch and promote sustainability”.

All of the supported projects are prime examples of collaborative research, as each was carried out by teams of scientists and members of the fishing industry working together through all phases of research, from the development of the research idea, to the execution of research protocols, analysis and sharing of results, and application to management. The results of these projects were far reaching, with the Lobster and Jonah Crab Research Fleet contributing to the 2015 lobster stock assessment and development of the Jonah Crab Fishery Management Plan, quahog and whelk research projects feeding data into state stock assessments and guiding management efforts, the development and distribution of modified fishing gear to reduce bycatch and improve selectivity in the small mesh trawl and dredge fisheries, and the advancement of fish habitat characterization in an area slated for offshore wind energy development. David Spencer, CFRF President and owner of the F/V Nathaniel Lee out of Newport, RI, further remarked that “The CFRF played a critical role in facilitating discussions between fishermen and scientists to develop research ideas, and ultimately in carrying those ideas through to project completion and management application.”

The CFRF will continue working to implement a collaborative approach to fisheries research, engaging the commercial fishing industry in research to address key issues in science and management. Furthermore, current bycatch landings are sufficiently low, accounting for approximately 1% of total landings.

Given a goal of the Jonah Crab FMP is to prevent expansion of the fishery while including all current participants, the Board has initiated an addendum to consider altering the incidental bycatch limit with options to increase the  limit to 1000 crabs per trip or eliminate the bycatch limit for non-trap gear. Draft Addendum I will be presented to the Board in February. If approved, the Board would release the Draft Addendum for public comment and will consider final approval of the addendum at the Commission’s Spring Meeting in May.
