Technology Can Improve Safety and Security for Observers on Fishing Vessels

The eastern Pacific Ocean is home to valuable tuna fisheries worth more than $5 billion each year.  These stocks are managed by the Inter-American Tropical Tuna Commission (IATTC), which is responsible for ensuring the sustainable management of tunas and other marine species, as well as enforcing rules to end and prevent illegal, unreported, and unregulated (IUU) fishing.

Transshipment is a key part of the seafood supply chain in which catch is transferred from a fishing vessel to a carrier vessel that then takes it to port, but management of transshipment is rife with loopholes, and IUU-caught fish can easily slip through the cracks.

For years, onboard fisheries observers have been the primary source of independent information on at-sea activity, collecting data on catch, transshipment, and more, and reporting rules violations and potential IUU activity to domestic authorities and regional fisheries management organizations (RFMOs) such as IATTC. But serving as an onboard observer is a risky job, and the casualty rate on fishing vessels is notoriously high. Observers can be at sea for months at a time, often without quick access to medical care or assistance if they are in a threatening situation.

Last year, MRAG Americas, a fisheries-focused consultancy, with support from The Pew Charitable Trusts and the Walmart Foundation, deployed a new model of two-way satellite communications devices to several IATTC transshipment observers to improve real-time exchanges of information and, hopefully, help observers feel more secure onboard vessels.

IATTC agrees to rollover tropical tuna quotas to 2021

December 22, 2020 — The Inter-American Tropical Tuna Commission (IATTC) agreed at a special session on 22 December to a rollover of its existing quotas for tropical tuna in the eastern Pacific for 2021.

The tropical tuna fishery – which includes bigeye, yellowfin, and skipjack tuna stocks – brings in billions of dollars’ worth of fish annually. At its annual meeting earlier this month, the commission failed to reach a consensus on the management of tropical tunas by one vote – with Colombia opposing the resolution – leaving tuna fisheries without any rules of governance starting on 1 January.

ISSF Statement: IATTC Emergency Commission Meeting

December 22, 2020 — The following was released by the International Seafood Sustainability Foundation:

The action by IATTC at its emergency Commission meeting held on December 22 — a meeting and decision that ISSF and its stakeholders called for earlier this month — keeps crucial “status quo” fishing effort and catch limit provisions and active FAD limits in place for 2021. This decision ensures that the valuable tuna resources and the marine ecosystems of the Eastern Pacific Ocean (EPO) will not be unmanaged for 2021. And it gives the Commission an opportune period to develop and adopt new comprehensive tuna management measures for 2022, including science-based limits on FADs and floating objects (e.g., active numbers, sets, deployments, etc.), that fully implement scientific advice.

ISSF calls on IATTC parties to work collaboratively throughout next year to hold detailed, inclusive discussions that will lead to decisive and science-based action for the protection of EPO tuna stocks and their marine ecosystems. Regardless of meeting format in 2021, ISSF will pursue all opportunities to help guide IATTC and all tuna RFMOs, member governments, industry, vessels, FIPs and NGOs on the complex issues they must navigate for sustainable global tuna stocks and their ecosystems.

WCPFC secures consensus to continue tropical tuna measure

December 16, 2020 — The 27 members of the Western and Central Pacific Fisheries Commission (WCPFC) have approved the rollover of the tropical tuna measure for bigeye, skipjack, and yellowfin tuna, which without a consensus would have expired in February 2021.

The move by the WCPFC is in contrast with the Inter-American Tropical Tuna Commission (IATTC), which failed to reach a consensus on regulations, leaving the fishery unmanaged beginning 1 January, 2021. The renewal by the WCPFC is considered a victory, but the Pacific Islands Forum’s Fisheries Forum Agency (FFA) said much work remains left to be tackled at next year’s tuna commission.

MSC calls for sustainable management of tropical tuna in Eastern Pacific

December 16, 2020 — The following was released by the Marine Stewardship Council:

From 1 January there could be no restrictions for tropical tuna fishing in nearly half of the Pacific Ocean, increasing the risk of overfishing of commercially important skipjack, yellowfin and bigeye tunas, the Marine Stewardship Council warns, unless all the member governments reach an agreement on how to manage these stocks in 2021.

The MSC standard requires fisheries certified to its globally recognised standard to limit their catch within sustainable limits. Robust management is one of the fundamental principles of sustainable fisheries, especially for those catching highly migratory species such as tuna, as it prevents overfishing.

However, the body responsible in international law[i] for agreeing how much tuna is safe to catch is yet to reach a consensus on important measures to restrict tuna catch in the Eastern Pacific Ocean in 2021. Scientific advice recommended to carry over the rules set for 2020 into 2021.

After the Inter-American Tropical Tuna Commission (IATTC) failed to reach an agreement at their meeting earlier this month, the Chair of IATTC has called an extraordinary meeting of the delegations on 22 December, recommending carrying over the 2020 management measures into 2021 and holding a series of further meetings in 2021 to develop the way tuna stocks are managed in the Eastern Pacific Ocean.

IATTC had previously agreed management measures for skipjack, yellowfin and bigeye in the Eastern Pacific Ocean. Having such measures in place even when stocks are perceived as healthy enables fisheries to act quickly when needed.

With increased demand for tuna globally comes increased pressure on tuna stocks and associated ecosystems. At present 17.5 % of the world’s tuna fisheries are overfished.

The Marine Stewardship Council’s Chief Science and Standards Officer, Dr Rohan Currey, said:

“We welcome IATTC’s decision to convene an extraordinary meeting, reflecting the critical importance of maintaining the conservation measures for tropical tuna stocks.  The nations involved must find a way to reach a consensus that will protect the future health of these economically important stocks, that reflects scientific advice and is grounded in a robust long-term management plan.

“Nations have a duty to come together to manage fisheries and their impact on the oceans. If the IATTC cannot agree on how to manage this tropical tuna fishery, it will have effectively abandoned this duty, putting the future of the stocks at risk. We join with others in expressing deep concern about this and urge the delegates to reach a speedy decision on this at their extraordinary meeting on 22 December.”

ISSF: IATTC Fails to Preserve Tuna Conservation and FAD Measures at Annual Meeting

The following release was updated on December 9, 2020 to reflect changes made by the International Seafood Sustainability Foundation:

Last month, ISSF and its partners appealed to the Inter-American Tropical Tuna Commission (IATTC) to, at a minimum, act to ensure its current measures on tuna conservation and management do not lapse and stay in place for 2021. ISSF outlined its science-based recommendations to IATTC in our position statement.

Unfortunately, IATTC ended its Nov. 30–Dec. 4 virtual Commission meeting without keeping crucial “status quo” measures in place:

  • First, the Commission could not agree to extend its current resolution for tropical tuna species for 2021, leaving the entire fishery for bigeye, yellowfin and skipjack tuna stocks without management measures. Fishing effort and catch limit provisions for these stocks are no longer in place.
  • Second, IATTC did not extend into 2021 the requirements to limit the number of active FADs.

Despite the clear scientific advice to, at a minimum, keep these provisions intact, the objection of one party blocked their extension. As a result, the sustainability of the region’s tropical tuna fisheries and marine ecosystems is now at risk.

IATTC’s inaction is a breakdown of its responsibility to ensure the long-term sustainable use of Eastern Pacific Ocean (EPO) tuna resources. In response to the Commission’s flagrant failings, ISSF urges all IATTC parties to exercise restraint and take the precautionary approach by voluntarily continuing to apply the previously in-effect provisions throughout 2021. Doing so will help keep fishing mortality at a level consistent with IATTC objectives.

ISSF calls upon IATTC to urgently organize an emergency session of the Commission early in 2021 to put in place binding conservation measures that will apply immediately.

We recognize that pandemic lockdowns and travel limitations have made substantive discussions and consensus-building especially difficult this year. But RFMOs and national governments will remain in this situation for the foreseeable future — and they need to adapt, as other organizations worldwide have, to the new reality. The virtual meeting format does not prevent or excuse them from ensuring detailed, inclusive discussions and taking decisive action to protect global tuna stocks and their marine ecosystems.

U.S. Adopts Safety Improvements for Observers in Pacific Tuna Fisheries

August 18, 2020 — The following was released by NOAA Fisheries:

NOAA Fisheries this week made effective new regulations to implement measures that will promote the safety of fisheries observers on tuna-fishing vessels. These measures reflect stronger international standards developed through years of U.S.-led negotiations to improve the safety of observers at sea.

For example, the measures require countries and vessel operators to take emergency actions to help observers if an observer is threatened, harassed, assaulted, missing, presumed fallen overboard, injured, or suffering from a serious illness. Also, observers aboard purse seine vessels will now receive emergency communication devices and personal locator beacons before leaving port.

Fisheries observers collect data essential to the international organizations managing tuna fishing in the eastern Pacific Ocean: the Inter-American Tropical Tuna Commission (IATTC) and Agreement on the International Dolphin Conservation Program (AIDCP). IATTC staff use the information collected by observers in fish stock assessments and to evaluate the compliance of member nations’ fishing fleets with international conservation measures.

Fisheries observers often face hazardous situations at sea. Rough waters churned up by storms, as well as busy decks with crews pulling in their catch, create dangerous conditions. Observers can also encounter difficult situations on board a vessel with fishing crews who can view them as intrusive.

Improved Monitoring, Reduced Fishing Pressure and Strengthened FAD Management Needed for Sustainable Eastern Pacific Ocean Tuna Fisheries

July 22, 2019 — The following was released by the International Seafood Sustainability Foundation:

The International Seafood Sustainability Foundation (ISSF) released its position statement in for the 94th Meeting of the Inter-American Tropical Tuna Commission (IATTC) in Bilbao, Spain, from July 22-26, 2019.

“The Commission took some important steps last year, including the adoption of a technical definition for non-entangling FAD designs, a binding measure on safety at sea for human observers and to require International Maritime Organization (IMO) numbers on all fishing vessels greater than 12m,” said ISSF President Susan Jackson. “However there were many important issues left unresolved and these must be urgently addressed this year.”

As top priorities, ISSF urges IATTC to:

  1. Develop a set of options to limit fishing pressure by the purse seine fleet, such as limiting fish aggregating device (FAD) deployments, further limiting the number of active FADs per vessel, and/or limiting the number of all set types.
  2. Strengthen FAD management through science-based measures, including a transition to FADs that do not use nets, and to encouraging the provision of echo-sounder data for scientific purposes.
  3. Fund knowledge-sharing, capacity-building and communication of scientific advice, including the establishment of a scientist-manager dialogue process and the development of harvest strategies for all key tuna species.
  4. Require 100% observer coverage (human or electronic) for longline vessels, small class purse seine vessels and all vessels engaged in at-sea transshipment within five years, and develop minimum electronic monitoring and reporting standards.
  5. Adopt measures to mitigate the incidental catch and maximize post-release survival of sharks, mobulid rays and sea turtles, and require all sharks be landed with fins naturally attached.
  6. Strengthen the IATTC compliance assessment process.

1. Specifying Harvest Limits for the Main Hawaiian Islands Kona Crab

The Council will consider specifying multi-year harvest limits for the main Hawaiian Island Kona crab for fishing years 2020-2023. The best scientific information available is the 2019 benchmark stock assessment with catch projection to 2026[1]. Based on this updated information, the maximum sustainable yield was estimated to be at 73,609 pounds and the overfishing limit at 33,989 pounds. The Council’s P* and SEEM* Working Groups and the Scientific and Statistical Committee (SSC) evaluated the scientific, social, ecological, economic, and management uncertainties and recommended a risk level for the Council to consider. The SEEM* working group used a new standardized process developed by the Social Science Planning Committee (SSPC), in which the social, ecological, and economic dimension is used to determine the risk of overfishing, and the monitoring and compliance/management criteria are used to determine management uncertainty. The risk of overfishing informs the Council’s consideration of annual catch limit (ACL) specification, and the management uncertainty informs the Council’s consideration in setting the annual catch target (ACT).

The Council will evaluate the following options:
1) No Action. No harvest limits will be specified for fishing year 2020-2023.
2) Specify the previous harvest limit at 3,500 pounds using the 2015 assessment (Thomas et al. 2015) for fishing year 2020-2023.
3) Specify the ACL equal to the acceptable biological catch (ABC) at P*=38 percent at 30,802 pounds and set an ACT at P*=30 percent at 28,324 pounds based on the P* and SEEM* Analysis using the 2019 benchmark stock assessment.
4) Specify the ACL equal to the ABC at P*=38 percent at 30,802 pounds and set an ACT 10 percent lower than the SEEM* analysis at P*=20 percent at 25,491 pounds using the 2019 benchmark stock assessment
5) Specify the ACL equal to the ABC at P*=38 percent at 30,802 pounds and set an ACT 20 percent lower than the SEEM* analysis at P*=10 percent at 21,243 pounds using the 2019 benchmark stock assessment

At its 178th meeting, the Council will consider taking final action to specify the harvest limits and the accountability measure that will prevent the fishery from overfishing the stock.

2. Hawai’i Fishery Ecosystem Plan Amendment to Precious Coral Essential Fish Habitat

The Council at its 173rd meeting in June 2018 directed staff to develop options to redefine essential fish habitat (EFH) and any habitat areas of particular concern (HAPC) for precious corals in Hawai’i for Council consideration for a Fishery Ecosystem Plan (FEP) amendment. EFH information was reviewed through the 2015 and 2016 annual Stock Assessment and Fishery Evaluation (SAFE) report cycles and an options paper was developed for the 174th meeting in October 2018.

New observations of precious corals have occurred throughout the region, with research concentrated in the Hawai’i Archipelago. Observations in the territories and of the larval phase of precious corals are rare or nonexistent. However, new information exists to refine the habitat characteristics and geographic extent of deep- and shallow-water precious coral EFH in the Hawai’i Archipelago. Narrative information on which the EFH designations are based and information to fulfill the EFH requirements of fishery management plans may also be used to update the archipelagic FEPs. The redefinition of precious corals EFH is framed in three separate actions: refinement of deep-water species complex EFH; refinement of shallow-water precious coral species complex EFH; and update of the narrative information.

The Council at its 174th meeting reviewed the following options for each of the three actions:
Action 1 – Update EFH for deep-water precious coral species
Options
1) No change (status quo)
2) Revise EFH by depth range
3) Refine the geographic boundary of existing precious coral beds
4) Refine the geographic boundary of existing beds and add new beds

Action 2 – Update EFH for shallow-water precious coral species:

The Council took initial action at its 174th meeting directing staff to prepare an amendment to the Hawai’i FEP to revise the Precious Corals EFH and selected the following preliminary preferred options:

Action 1 – Option 4: Refine the geographic boundary of existing beds and add new beds.
Action 2 – Option 2: Update geographic extent and habitat characteristics.
Action 3 – Option 1: Update the FEP narrative information on EFH.
At its 178th meeting, the Council will consider taking final action to amend the Precious Coral EFH section of the Hawai’i FEP.

3. Managing Loggerhead and Leatherback Sea Turtle Interactions in the Hawai’i-Based Shallow-Set Longline Fishery

The Council at its 173rd meeting in June 2018 recommended amending the Pelagic FEP to establish a management framework for the Hawai’i shallow-set longline fishery that consists of 1) annual limits on the number North Pacific loggerhead and leatherback turtle interactions consistent with the anticipated level of annual interactions that is set forth in the current valid biological opinion (BiOp) and 2) individual trip interaction limits for loggerhead and leatherback turtles. The Council also recommended specifications under the framework as follows: 1) annual limits of 37 North Pacific loggerhead turtles and 21 leatherback turtles; and 2) individual trip limit of five North Pacific loggerhead turtles.

The Council’s recommendation for specifying the loggerhead and leatherback turtle annual limits was based on the anticipated level of interactions analyzed in the biological evaluation (BE) initiating reconsultation of the Hawai’i shallow-set longline fishery under the Endangered Species Act (ESA) Section 7 consultation process. As part of its recommendation, the Council noted that it would review its recommendation if the new BiOp from the ongoing consultation results in a jeopardy decision or otherwise results in a different incidental take statement for North Pacific loggerheads or leatherbacks. The new BiOp was originally scheduled to be completed by Oct. 31, 2018, but the draft was not completed in time for the October SSC and Council meeting. Following the October meetings, the National Marine Fisheries Service (NMFS) Pacific Islands Regional Office (PIRO) set a new timeline to deliver the draft BiOp by Jan. 31, 2019, and a final BiOp by Feb. 28, 2019. Due to the federal government shutdown, the draft BiOp timeline was further delayed to March 25, 2019.

At its October 2018 meeting, the SSC received a presentation from the NMFS Pacific Islands Fisheries Science Center (PIFSC) on the population viability analysis (PVA) for loggerhead and leatherback turtles prepared for the ongoing Section 7 consultation. The modeling was conducted in response to a request by the PIRO Protected Resources Division for the purpose of examining the long-term viability of the species. PVA results indicate that the North Pacific loggerhead population has a mean estimated population growth rate of 2.4 precent, while the Western Pacific leatherback turtle population has a mean estimated population growth rate of 5.3 percent. The growth rates reflect long-term population trends based on nesting beach data representing approximately 52 percent of the North Pacific loggerhead turtle population and approximately 85 percent of the Western Pacific leatherback turtle population.

The Council at its 174th meeting in October 2018 reviewed the approach to the assessment for the BiOp and considered the SSC’s report regarding the PVA. The Council recommended convening an interim Council meeting, if needed, to review draft BiOp and consider any revisions to its June 2018 recommendations based on the BiOp and stated that it will reconsider a specification of leatherback individual trip limits if necessary.

The Council convened its 175th Meeting on Dec. 17, 2018, to consider final action on additional mitigation measures for the Western Pacific leatherback turtles in advance of the draft BiOp completion, taking into consideration the results of the PVA model indicating a continuing long-term declining trend of the population. The Council deferred action until the draft BiOp and more complete information on the impacts of the fishery on the Western Pacific leatherback turtles are available to fully inform the Council decision.

The draft BiOp was provided to the Council on March 28, 2019. The Council convened its 177th meeting on April 12, 2019, to review its recommendations on the management framework from the 173rd meeting for consistency with the draft BiOp and to consider taking final action on the management framework. The draft BiOp concluded that the shallow-set longline fishery is not likely to jeopardize the continued existence of ESA-listed species, including loggerhead and leatherback turtles. However, the draft BiOp also contained Reasonable and Prudent Measures (RPMs) that were inconsistent with the Council’s recommended framework. The Council at its 177th meeting maintained its management framework recommendation from the 173rd Council meeting, additionally recommended an individual trip limit of two leatherback turtles and requested that NMFS consider revising the RPMs for consistency with the Council recommended action.

At its 178th meeting, the Council will review the final BiOp for consistency with the 177th meeting recommendations and may consider taking additional final action if any discrepancies remain with the previously recommended action.

4. US Participating Territory Longline Bigeye Catch/Allocation Limits

Bigeye tuna comprises a Pacific-wide population that is internationally managed and assessed as separate stocks in the Western and Central Pacific Ocean (WCPO) and Eastern Pacific Ocean (EPO) by the Western and Central Pacific Fisheries Commission (WCPFC) and the Inter-American Tropical Tuna Association (IATTC), respectively. The best scientific information available indicates that both stocks are not subject to overfishing nor are they overfished, according to the stock status determination reference points in the FEP for Pelagic Fisheries of the Western Pacific Region. The scientific bodies of the WCPFC and IATTC will consider new benchmark stock assessments for both stocks in 2020.

In December 2018, the WCPFC agreed on CMM 2018-01, which limits the US longline bigeye tuna catch in the WCPO to 3,554 metric tons (mt) in 2019 and 2020. CMM 2018-01 does not establish an individual limit on the amount of bigeye tuna that may be harvested annually in the Convention Area by Small Island Developing States (SIDS) and Participating Territories, including American Samoa, Guam and the Commonwealth of the Northern Mariana Islands (CNMI). Limits are not provided to the SIDS and Participating Territories in recognition of their fisheries development aspirations.

In 2014, Amendment 7 to the Council’s Pelagic FEP was approved and implemented (50 CFR 665.819). It established the territorial catch/effort and allocation limit measure that provides NMFS with authority to:
Specify annual catch or effort limits for a US Participating Territory, as recommended by the Council, not to exceed any WCPFC-adopted limits;
Specify a limit recommended by the Council authorizing a US Participating Territory to allocate a portion of that specified catch or effort limit to eligible US vessels through a specified fishing agreement; and
Review and approve specified fishing agreements for consistency with the Pelagic FEP and other applicable laws.

The Council must annually review the conservation status of the fishery resource, the needs of fishing communities dependent on the particular fishery resource and consistency with the Pelagics FEP and other applicable laws in considering its recommendations for territorial catch, effort and allocation limits as well as its review of specified fishing agreements. Amendment 7 also established a territorial longline bigeye tuna catch limit of 2,000 mt for each territory and an allocation limit of 1,000 mt for each territory. At its 173rd meeting in June 2018, the Council took final action to modify the territorial catch/effort and allocation limit measure and implementing regulations. Should NMFS approve the action, it will amend the Pelagic FEP to remove the requirement for establishing separate total catch or effort limits for the US Participating Territories in order to establish an allocation limit and also would allow multi-year limits. The Council would annually review any established limits to determine whether the best available scientific information or the needs of fishing communities warrant modifying or rescinding such limits.

At its 178th meeting, the Council will consider recommending territorial bigeye tuna catch and/or allocation limits to take effect beginning in 2020, given the Council’s recommended modification of the territorial catch, effort and allocation limit measure. The Council will consider the following options:
1. No catch or allocation limits (no action)
2. 2,000 mt catch and 1,000 mt allocation limits
3. No catch limit and up to 2,000 mt allocation limits

The Council will also consider the fishing years in which the limits will take effect or expire, in consideration of the requirement for annual review, availability of new scientific information and potential for multi-year limits.

118 Organizations Make Sustainability Appeal for Critical Improvements in Global Tuna Fisheries

A diverse, global group of 118 commercial and non-profit organizations have joined together to call for immediate action by tuna RFMOs to address critical tuna sustainability priorities. In a letter dated 7 May 2018, the signatories call for accelerated action on the following global tuna fishery priorities:

  • The development and implementation of comprehensive, precautionary harvest strategies
  • Effective monitoring and management of fish aggregating devices (FADs)
  • Strengthened monitoring, control and surveillance tools, including increased observer coverage in purse seine and longline fisheries, and of at-sea transshipment activity, through human observers and/or electronic monitoring
  • Greater focus on the implementation of bycatch mitigation best practices broadly, with an emphasis on longline fisheries

Tuna fisheries represent not only a high-value protein source but also an important economic driver for countries and communities around the globe. As a highly migratory, global species, the health of tuna stocks is of global concern – as witnessed by the breadth of signatories to this appeal.

The letter and outreach effort are being coordinated by leading NGOs working on tuna sustainability globally through the NGO Tuna Forum. The letter has been shared with the Indian Ocean Tuna Commission in advance of its annual meeting later this month; it will also be sent to Inter-American Tropical Tuna Commission (IATTC), International Commission for the Conservation of Atlantic Tunas (ICCAT), and Western and Central Pacific Fisheries Commission (WCPFC) in advance of their 2018 general meetings.

While the signatories recognize that RFMOs have made progress to-date on some these priorities, accelerated action is required on all fronts to ensure the long-term sustainability of tuna fisheries.

Specific actions that IOTC, IATTC, ICCAT and WCPFC are being asked to address in 2018 include:

  1. Develop and implement comprehensive, precautionary harvest strategies with specific timelines for all tuna stocks, including the adoption and implementation of target and limit reference points, harvest control rules, monitoring strategies, operational objectives, performance indicators, and management strategy evaluation;
  2. Adopt a 100% observer coverage requirement for purse seine vessels where it is not already required, and require the use of the best-available observer safety equipment, communications and procedures;
  3. Increase compliance with mandatory minimum 5% longline observer coverage rates by identifying and sanctioning non-compliance, and adopt and implement a 100% observer coverage requirement – human and/or electronic – within five years for longline fisheries;
  4. Adopt and implement a 100% observer coverage requirement for at-sea transshipment activities, as well as other measures that ensure transshipment activity is transparent and well- managed, and that all required data is fully collected and sent to the appropriate bodies in a timely manner;
  5. Develop and implement science-based recommendations for the effective management of FADs, and integrate FAD-based information into stock assessments to reduce uncertainties;
  6. Adopt effective measures for the use of non-entangling FAD designs as a precautionary measure to minimize the entanglement of sharks and other non-target species, and support research on biodegradable materials and transition to their use to mitigate marine debris;
  7. More effectively implement, and ensure compliance with, existing RFMO bycatch requirements and take additional mitigation action, such as improving monitoring at sea, collecting and sharing operational-level, species-specific data, and adopting stronger compliance measures, including consequences for non-compliance for all gear types.

The organizations believe these measures are needed to positively impact the long-term sustainability of tuna stocks and the overall health of the marine ecosystem.
