MASSACHUSETTS: New Bedford fish fraud case underscores need for greater NOAA monitoring

February 29, 2016 — BOSTON — Fraud charges against the owner of a prominent New Bedford fishing company highlight the need for greater enforcement of fishery regulations, according to an environmental group.

Carlos Rafael, owner of 40 fishing vessels in New Bedford and Gloucester as well as Carlos Seafood, was arrested on Friday on charges his organization lied about the species of fish landed, and he smuggled cash out of the country.

Among other allegations, federal authorities said Rafael told undercover agents he had assistance from a local law enforcement officer who helped him move cash through the airport to Portugal.

Accused of circumventing federal quotas by labeling dabs and other fish as haddock – where Rafael said he has a 15-million-pound quota – Rafael regularly shipped the mislabeled fish to a buyer in New York City, according to federal officials.

“Because it is nearly impossible to monitor what fishing vessels do out at sea, commercial fishing vessels are required to comply with various reporting requirement,” the 18-page affidavit by Internal Revenue Service Special Agent Ronald Mullett states.

Rafael told undercover agents posing as Russian mobsters interested in buying the business that co-defendant Debra Messier had “been in the life” with him for 30 years and everyone in the company “knows the scheme,” according to the complaint.

According to the affidavit in support of a criminal complaint Rafael was previously convicted of tax evasion in the 1980s, acquitted of price-fixing in 1994 and convicted of making false statements on fishing vessels’ landing slips in 2000. Messier is his bookkeeper and both live in Dartmouth, according to the U.S. Attorney’s Office. According to the Boston Globe, Rafael was held without bail pending a detention hearing on Wednesday and Messier was released from custody on $10,000 unsecured bond.

MASSACHUSETTS: A win for Gloucester Fresh

February 24, 2016 — For former Gloucester Mayor Carolyn Kirk, it was a rare home game in her role as the executive secretary of the state’s Seaport Economic Council. For the city, it was another step forward in its efforts to brand and market its seafood and seafood businesses.

The Seaport Economic Council and its chairwoman, Lt. Gov. Karyn Polito, rolled into Gloucester on Tuesday morning, meeting for more than two hours at the Tavern on the Harbor and awarding 10 state grants worth $5.15 million to 10 Massachusetts entities — including $151,000 to the city’s Gloucester Fresh Seafood Innovation Program.

The Gloucester grant, according to city Economic Development Director Sal Di Stefano, will help the city expand its campaign to promote its seafood harvest locally, regionally and nationally. That expansion includes the nine-day rental of two digital billboards along Route 1 in advance of the city’s participation in the annual Seafood Expo North America in Boston during the first week of March.

Di Stefano said the billboards alone are expected to convey the city’s branding message to at least 400,000 commuters during the city’s run on them.

He said the grant money also will be used to defray the city’s overall costs of participating in the Seafood Expo North America show and the Boston Seafood Festival in each of the next two years.

MASSACHUSETTS: Gloucester must relentlessly promote locally harvested seafood

February 20, 2016 — Gloucester needs to be relentless in promoting the benefits of its locally harvested seafood, as well as the fishermen and processors that send it to market, a city official told the Fisheries Commission this week.

Economic Development Director Sal Di Stefano said the city is addressing the challenges of operating in the modern, international seafood market with a marketing strategy designed to promote the city, its fresh seafood bounty, its fishermen and its shore-side businesses to the seafood-consuming world.

“If we don’t do this, other people will,” Di Stefano told the commission Thursday night during a discussion on the city’s plans for the upcoming Seafood Expo North America show in Boston. “And they will try to take it from us.”

The city’s new branding campaign, “Gloucester Fresh,” is at the heart of the promotional strategy aimed at helping consumers identify seafood harvested from the waters around Cape Ann and landed in Gloucester while appreciating its nutritional and sustainable benefits.

Working with Salem-based Sperling Interactive, the city is developing a website that Mayor Sefatia Romeo Theken is scheduled to launch at the beginning of the Seafood Expo during the first week of March.

Court battle continues over at-sea monitoring

February 10, 2016 — The federal lawsuit filed by a New Hampshire fisherman to block NOAA Fisheries’ plan to shift the cost of at-sea monitoring to groundfish permit holders has devolved, at least for now, into a paper fight.

Lawyers for plaintiff David Goethel, captain of the Ellen Diane out of Hampton, N.H., have filed a motion asking U.S. District Judge Joseph J. Laplante for an expedited hearing on the merits of the case. Federal lawyers have countered with a motion to dismiss the case outright.

Laplante, sitting in Concord, N.H., has yet to rule on either motion.

In late January, Laplante denied a motion by Goethel’s lawyers for a preliminary injunction that would have immediately halted federal plans to shift the costs of at-sea monitoring to the groundfish boats, thereby helping stave off the impending economic carnage the shift is expected to visit on the already reeling fleet.

“Given that preliminary injunctive relief is not available, plaintiffs request that the court proceed to the merits at its earliest convenience,” Goethel’s lawyers wrote in their motion. “This case remains urgent, with a ‘substantial, largely unrebutted’ risk of ‘potentially disastrous financial impact’ impending in a matter of weeks.”

The National Oceanic and Atmospheric Administration said it expects to run out of money for the at-sea monitoring around March 1. Groundfish fishing sectors have been instructed to begin negotiating with monitoring contractors to directly provide the service for the remainder of the 2015 fishing season and the 2016 fishing season that is set to begin May 1.

The question, however, is at what cost. The currently accepted estimate for the cost of groundfish monitors is about $710 per day per vessel, though some fishing sectors around New Bedford have said they were able to negotiate a better price from observer contractors.

Gloucester-based fishing sectors have declined to give specifics about their negotiations with the providers of observer coverage.

MASSACHUSETTS: Delving into the deep

February 5, 2016 — Maritime Gloucester has embarked on an ambitious slate of programs for 2016, many designed as teaching tools providing information on a variety of topics within the overarching themes of ocean planning and innovation on the waterfront.

The working museum and maritime education center on Harbor Loop built the schedule — including the MGTalks and HarborLAB series — to provide relevant information to Cape Ann residents from all sides on maritime topics of local interest, ranging from fisheries to ocean exploration, said Melanie Murray-Brown, Maritime Gloucester’s director of program information. 

“We decided that we didn’t want to shy away from controversial topics,” Murray-Brown said Thursday. “We’re not advocating for any particular side on these issues, but providing the information more as a public service.”

The MGTalks series kicks off next Thursday, Feb. 11, at 7 p.m. at Maritime Gloucester with a free panel discussion on who owns the ocean and balancing interests while managing ocean sprawl.

The panel, including Bruce Carlisle, director of the state’s Office of Coastal Zone Management, and Jack Clarke, a Gloucester resident who is director of public policy and government relations for the Massachusetts Audubon Society, will discuss the formation and goals of the Massachusetts Ocean Plan.

The discussion is expected to include the roles of specific stakeholders and the areas of dissent on issues stretching from sand and gravel mining to the ramping up of the exploration for gas and oil near entry points to the Gulf of Maine by Canadian public and private interests.

John Sarrouf of the Gloucester Conversations project will moderate the panel.

Gloucester, Mass. investment in seafood expo is money well spent

February 3, 2016 — Of all the initiatives begun last year by then-interim Mayor Sefatia Romeo Theken, the return of the city to the international Seafood Expo North America in Boston was a no-brainer, given Theken’s deep ties to the Gloucester Fishermen’s Wives Association.

By all accounts, the endeavor was a success. The city’s booth stood out amid a sea of sterile, cardboard convention center displays, thanks to the presence of the mayor and Angela Sanfilippo, president of the Fishermen’s Wives, and a bubbling, aromatic pot of redfish soup. That end product — the food people actually put in their mouths — is as emblematic of the Gloucester fishing industry as its hard-working fleet or the Man at the Wheel. Gloucester fishes so people can eat. What better way to bring home the point than with 40 steaming gallons of fish stew?

The end result was an increased awareness of the Gloucester brand, and a series of meetings among city officials, waterfront businesses and potential clients from the United States and abroad. It’s exactly the kind of result one would hope for from a long weekend’s attendance at a trade expo.

Last year’s expo, in fact, is still paying off: On the Monday of this year’s event, the city will play host to potential buyers and trade representatives from more than a dozen countries, including Canada, Turkey, Mexico, Iceland, Taiwan, Morocco, Spain, Indonesia and the Netherlands. Those are real contacts.

New quotas cut deep for fishing industry

February 3, 2016 — Fishermen and fishing stakeholders say the darkness that has descended on the Northeast groundfish fishery over the past three years is only going to grow deeper in 2016, with some fishing stakeholders envisioning the final collapse of the small-boat industry due to slashed quotas for species they believe are abundant.

“With these cuts, we will not have a fishery as we know it anymore,” said Vito Giacalone, the manager of Gloucester-based Northeast Fishing Sector 4 and the policy director at the Northeast Seafood Coalition. “The great shame to this is we’re going to have this entirely detrimental economic impact while the stocks are in great shape and no one in the government is listening. There is just no leadership.”

At the heart of the issue is the expanding difference between what fishermen say they are seeing on the water and the results from NOAA stock assessments used to produce the annual fishing quotas. Call it a watery Great Divide.

“The fish are in great shape and the only real constraint on catch is quota,” Giacalone said. “Fishermen are seeing that across the board on a lot of the species.”

The quotas, set for 2016 by the National Oceanic and Atmospheric Administration in the final groundfish framework, reflect a far different analysis by NOAA and its scientists. They include savage cuts to gray sole (55 percent), Georges Bank cod (66 percent), northern windowpane flounder (33 percent) and Gulf of Maine yellowtail flounder (26 percent).

“We’ve never had a greater gap between what the fishermen are seeing on the water and what the scientists are saying,” Giacalone said. “Never.”

Gloucester fisherman Al Cottone said his personal sector contribution (PSC) for 2016 includes a slight increase in Gulf of Maine cod from the 1,800 pounds he was allotted in 2015, but cuts in several other species such as yellowtail flounder (down 25 percent to 2,400 pounds); American plaice (down 17.6 percent to 2,800 pounds) and gray sole (down 6 percent to 2,800 pounds).

Gloucester Massachusetts Looks to Hook Interest in its Seafood

January 31, 2016—The icebreaker was last year, when the city of Gloucester made its first foray to the vast and international Seafood Expo North America at the Boston Convention Center.

The mission was simple: raise Gloucester’s profile among the thousands of seafood buyers who flock to the show from just about every point on the planet and develop the kind of relationships that will thrust the city’s harvesters, processors and, of course, seafood into the international mix.

The effort, both inside and outside the city, was viewed as a raging success. So, with that precedent, Mayor Sefatia Romeo Theken placed a little quest in front of point man Sal Di Stefano.

“The mayor challenged us to do it even bigger and better this year,” said Di Stefano, the city’s director of economic development.

Toward that end, Di Stefano has amassed an armada of city resources, Gloucester-based seafood businesses, volunteers, nonprofits and assistance from Endicott College to set sail for this year’s Seafood Expo North America with a more expansive plan centered on the city’s seafood marketing campaign of Gloucester Fresh Seafood.

“It’s a tremendous amount of work for everyone involved, but it’s really exciting how the entire community has responded,” Di Stefano said. “And we’re the only ones doing it like this.”

The city, which has budgeted $10,000 for the March 6-8 event and doubled the size of its booth, is the only Massachusetts municipality that will have a presence at the show.

Bill to Expand Lobster Sales Adopted by Massachusetts State Senate

January 28, 2016 — BOSTON — The following was released by the Office of State Senator Bruce Tarr:

The State Senate today adopted a bill which updates Massachusetts’ lobster laws to permit the processing, sale, and transportation of cooked and frozen in-shell lobster parts.

Senate Minority Leader Bruce Tarr (R- Gloucester) sponsored the measure to end prohibitions on in-state sales and processing of lobster parts to accommodate the growing interest of consumers.  The bill, supported by the Massachusetts lobster industry, is expected to cause an expansion of lobster processed in state and a reduction in lobster diversions to Canadian processors. 

“This bill will allow more American lobsters currently being harvested and purchased here and subsequently processed in Canada, to be prepared for market in Massachusetts,” said Tarr. “The net effect of modernizing the law will bolster local economic activity for lobstermen, processors, and local restaurants and food stores.”

Tarr expressed appreciation for coastal Senators Mark Montigny (D- New Bedford),Vinny deMacedo (R- Plymouth), Daniel Wolf (D-Harwich) and Michael Rodrigues (D-Westport) for their efforts to strengthen the industry and in championing the bill.

“The time has come to eliminate such outdated restrictions on lobster processing and sales in the Commonwealth.  Easing constraints on processing operations will allow a thriving industry to further invest in our local economy through expanding operations and creating new jobs.  I commend Senator Tarr’s leadership as the sponsor of this bill and am proud to have partnered with him in seeing this through to passage.  It is my hope the House will quickly follow the Senate’s lead to have a bill on the Governor’s desk as soon as possible.” said Senator Montigny.

“I am thrilled that the Senate has taken steps to bring this bill forward with a unanimous vote and I know that the lobstermen will be pleased with the advancements that we’ve made,” said Senator deMacedo.

The lobster industry is a critical part of the Commonwealth’s economy and heritage with more than 900 licensed lobstermen.  A similar law in Maine has boosted Maine’s economy, produced local outlets for product sales, and created jobs in the state.

“The action of the Senate today helps consumers, suppliers and lobstermen, I expect that we will see an economic boost for the lobstermen in my district and in other coastal communities in the state as well,” said Senator Rodrigues.

 “Our historic lobster industry deserves the opportunity to be more creative and flexible in how they market and sell their popular product,” said Cape and Islands Senator Wolf. “This legislation is a huge help in that regard, and will create economic benefits that will ripple through our coastal communities.”

While the sale of live, cooked, and canned lobster is legal in the state, the legislation expands the industry market with the inclusion of other lobster products. The Senate bill allows Department of Public Health licensed wholesale dealers to process unfrozen lobsters, authorizes the importation of unfrozen shell-on lobster parts and tails, and it allows for the retail of previously frozen raw in-shell tails.

The Massachusetts Division of Marine Fisheries will be responsible for maintaining essential regulations including enforcing minimum lobster shell size standards and processing standards. The lobster fishery adheres to stringent state regulations including trap limits and the release of live juveniles.

The bill now moves to the House for further consideration.

Feds to Help Gloucester Mass. Brand its Seafood

January 26, 2015 — Gloucester’s effort to develop a specific brand for the bounty of seafood yanked from local waters, as well as the means to promote food produced at local farms, is receiving a boost from the Obama administration.

The White House’s Rural Council chose Gloucester as one of 27 communities nationwide from about 350 municipal applicants to participate in the Local Foods, Local Places initiative designed to help transform locally harvested food into local economic development and healthier eating.

 Gloucester is the only Massachusetts community included in the initiative, as well as the only city in the Northeast that will receive the technical support and advice from a bevy of experts on the best methods for developing local food projects specific to Gloucester and Cape Ann, according to Gloucester Economic Development Director Sal Di Stefano.

“It’s really a feather in our cap for us as a city to be recognized in this way,” Di Stefano said. “Farm-to-table is a very recognizable concept these days, and what we want to do is develop a similar concept along the lines of sea-to-table or dock-to-dish.”

As part of the initiative, city officials will work with experts in the areas of agriculture, transportation, environmental affairs, public health and regional economics to produce local food projects that could help regenerate the city’s ailing fishing industry while also promoting other regional sources of food and healthier eating.

The projects, according to Di Stefano, could include test kitchens, downtown food hubs, food business incubators and food security outreach programs.

Working with the experts will help the city and its food businesses more narrowly focus on the specific methods for expanding markets for locally grown and harvested foods, whether from land or sea, he said.

“They’ll be able to come in and advise us on what’s worked best in other parts of the country that we might be able to tailor to Gloucester,” Di Stefano said. “That way, we’ll be able to sort through all the options and focus our energies in particular areas that give us the best way to connect our resources to our residents. Who knows what this can lead to?”
