Environmentalists, fishermen question new cod fishing rules

March 22, 2016 — PORTLAND, Maine (AP) — Environmentalists and commercial fishermen both say they are fearful of proposed changes to the federal rules that govern New England’s beleaguered cod fishing industry.

The rules govern an industry that has fed New England for centuries and is now in steep decline. Most codfish sold to consumers in the region now come from foreign countries such as Norway, Iceland and Russia.

Cod is closely associated with fish and chips.

Regulators who typically split New England’s cod into two stocks want to slightly raise the Gulf of Maine quota but more dramatically cut the Georges Bank quota for the coming fishing year. The catch limit would rise 30 percent, to 500 metric tons, in the Gulf and fall nearly two thirds, to 762 metric tons, on Georges.

The quota cut on Georges Bank also would make it difficult for fishermen to pursue other, higher-quota species such as haddock and pollock, said Ben Martens, executive director of the Maine Coast Fishermen’s Association. Fishermen also must stop fishing for other species when the cod quota is met.

NOAA Fisheries Seeks Comments on Proposed Groundfish Catch Limits and Modifications to the At-Sea Monitoring Program

March 23, 2016 — We are seeking public comment on a proposed rule that would set 2016-2018 catch limits for all 20 groundfish stocks, adjust the groundfish at-sea monitoring program, and adopt several sector measures.

Catch Limits

The new catch limits proposed for all 20 groundfish stocks are based on stock assessments conducted in late 2015.

The proposed allocations for Gulf of Maine cod, Georges Bank cod, Southern New England/Mid-Atlantic yellowtail flounder, and witch flounder could limit the operation of the groundfish fishery. However, these reductions are necessary to prevent overfishing for these stocks, which are all at historically low levels.

Based on the proposed allocation increases for Gulf of Maine haddock (150 percent) and Gulf of Maine cod (30 percent), we are proposing trip limit increases and season extensions for the recreational groundfish fishery in a separate action.

At-Sea Monitoring

The 2016 fishing year (May 1, 2016, through April 30, 2017) is the first full year that sectors will be responsible for the costs of at-sea monitoring. We worked with the New England Fishery Management Council to develop a set of reasonable modifications to the at-sea monitoring program to make the program more cost-effective while still reliably meeting monitoring groundfish catch.

The proposed changes include:

  • Elimination of the coverage requirement for certain sector trips with low groundfish bycatch;
  • Adjustment of method  NOAA Fisheries uses to set the annual coverage level to use more years of discard information and stock health to predict coverage levels; and
  • Reduction of the target at-sea monitoring coverage level of 14 percent for the 2016 fishing year (down from 24 percent for 2015).

RHODE ISLAND: Loberstermen Dispute Finding That New England Lobsters Are At Record Lows

March 4, 2016 — It’s been months since the Atlantic States Marine Fisheries Commission released its latest report on how lobsters are faring in the Atlantic Coast. But it’s still a hot topic among fishermen in the Ocean State.

The latest lobster stock assessment found lobsters in the Gulf of Maine and Georges Bank are doing well; but lobsters in southern New England are not. Most southern New England fishermen disagree with that assessment, according to David Spencer, president of the Commercial Fisheries Research Foundation and a lobster fisherman.

“I don’t think all the fishermen are saying that things are tremendous and rosy,” said Spencer, “but I think the biggest disagreement seems to be in the severity of the assessment and fishermen think that the resource is actually a little bit better than that.”

Spencer said most fishermen have seen an uptick in the lobster population in the last couple of years and the assessment doesn’t reflect that progress because it’s based on data through 2013.

The assessment doesn’t include more recent data because it takes time to collect, enter and analyze data, explains Toni Kerns, director of the Interstate Fisheries Management Program at the commission.

Scientists say ocean warming is driving lobsters northward

March 2, 2016 — It’s too early to know what Maine’s 2015 lobster landings will look like, but there’s no doubt that the number will be huge.

In 2014, the last year for which the Department of Marine Resources has figures, Maine’s fishermen landed more than 123 million pounds of lobster — the third year in a row that landings topped 120 pounds — worth a record $457 million.

While last year’s numbers aren’t in, fishermen and dealers talk about a bonanza fishery, and mild weather saw the fishery stay active into December.

In a sense, the landings are unsurprising.

According to a 2015 Atlantic States Fisheries Management Commission stock assessment, the abundance of lobsters in the Gulf of Maine and on Georges Bank showed a meteoric rise starting in 2008 and is now at an all-time high. In southern New England, though, the story is completely different.

From a peak in 1997, the southern New England stock fell swiftly to a point where, by 2004, it was well below what scientists consider the threshold of sustainability. Things leveled off briefly; then the resource began an ongoing plunge again in 2010.

According to last year’s assessment, the Gulf of Maine-Georges Bank stock is not depleted and is not being overfished. The estimated lobster population from 2011 to 2013 was 248 million lobsters, which is well above the abundance threshold — a red flag for fisheries managers — of 66 million lobsters.

In contrast, in the years 2011 to 2013, the southern New England stock was depleted at an estimated 10 million lobsters. The “red flag” abundance level is 24 million lobsters.

New Lobster Scientist Hired by Maine Department of Marine Resources

February 18, 2016 — The following was released by the Maine Department of Marine Resources:

Katherine Thompson has been hired by the Maine Department of Marine Resources as the lead lobster sampling program scientist. Thompson, a Ph.D. student in Marine Biology at the University of Maine, will be responsible for the coordination, implementation, and participation in the lobster sea sampling program in all seven-lobster management zones as well as the juvenile lobster ventless trap survey.

Thompson’s responsibilities will include supervision of DMR scientific staff and contractors who participate in the sea sampling and ventless trap survey programs. 

The DMR sea sampling program places trained observers onto commercial lobster boats to gather data on the near shore lobster fishery. The ventless trap survey uses specially modified traps distributed along the coast to help the DMR characterize the juvenile lobster population in Maine waters. 

Thompson will also manage the lobster research program database, oversee data entry compilation and annual summary statistics/reports for publication and will assist in writing grant reports. In addition, she will present survey results at lobster zone council meetings. 

Thompson brings to the position experience both in commercial fishing and fisheries research. Raised in a fishing family in New Harbor, Thompson served as a sternman for a Round Pond lobster fisherman during summers while she pursued a degree in Biology from Smith College. The vessel she worked on participated in DMR’s ventless trap survey, providing her first experience with cooperative research. After graduating, Thompson completed an internship in lobster research through Bigelow Laboratory focusing on the settlement index survey conducted by Dr. Richard Wahle.

In 2013 Thompson received her Master’s degree in Living Marine Resource Science and Management from the University of Massachusetts Dartmouth’s School for Marine Science and Technology. Her Master’s thesis project provided the first conclusive evidence of semiannual scallop spawning in U.S. waters on Georges Bank, which has important implications for management of the fishery.

From 2013 to 2014, Thompson served as a Supervisory Research Biologist for Coonamessett Farm Foundation, a scientific research and education foundation based in Falmouth, Massachusetts.

In January 2015 she began her doctoral studies at the University of Maine focusing on northern shrimp reproduction and distribution. 

“I’m excited about working closely with industry, especially here in my home state,” said Thompson.

“Katherine’s experience in scientific research of multiple fisheries provides a strong foundation for her work here at DMR,” said DMR’s Lead Lobster Biologist Kathleen Reardon. “She has the strong academic and practical experience in marine science and commercial fishing to help move our monitoring programs forward.”

 

Whale habitat change concerns fishermen

February 2, 2016 — GLOUCESTER, Mass. — NOAA Fisheries announced last week that it was expanding the critical habitat for endangered North Atlantic right whales to cover its northeast feeding areas in the Gulf of Maine and Georges Bank. The designated area is much larger than the one it replaces, and now includes all of the Gulf of Maine on the U.S. side of the national boundary with Canada.

The designation also was applied to an expanded area of the whales’ southeast calving grounds from North Carolina to Florida.

Under the Endangered Species Act, critical habitat within the range of the species consists of areas that contain physical or biological features essential to conservation of the species.

The final rule, which was first proposed in February 2015 and received 261 general comments over a 60-day comment period, does not include any new restrictions or management measures for commercial fishing operations. It does not create preserves or refuges.

However, federal agencies conducting, funding or permitting activities in these areas are required to work with NOAA Fisheries to avoid or reduce impacts on critical habitat.

The announcement has sparked long-standing disagreements between environmental and animal organizations and commercial fisheries.

Humane Society CEO Wayne Pacelle called the decision “a lifeline” for right whales in a blog post published Friday. “The HSUS and its allies have been fighting for an expansion of protected habitat since 2009, and it’s a victory for us over commercial fishermen and shipping interests that have irresponsibly downplayed their role in driving down the numbers of these mammoth creatures,” he wrote.

Herring vs. Haddock in Data Debate

February 3, 2016 — PORTLAND — Last October, the National Marine Fisheries Service (NMFS) drastically constrained the ability of midwater trawlers to fish for herring in offshore waters for a period of more than six months, because the herring fleet had bumped up against its quota for the incidental catch of Georges Bank haddock.

As a result, at its December meeting, the New England Fishery Management Council (NEFMC) heard a request from herring fishery interests to reconsider the level of constraint for the upcoming fishing year of May 1, 2016 to April 30, 2017, and for future years, since Georges Bank haddock appears to be plentiful and, they said, estimates of haddock catches by the herring fleet were inaccurate.

“A seven-month closure of a major fishery is very significant,” said NEFMC member Mary Beth Tooley, who is the government affairs representative for Rockland-based O’Hara Corp., which owns and operates two herring vessels. “We in the herring fishery don’t want to catch haddock. But that biomass is like locusts: They’re unbelievably abundant. It’s two-pronged: Let’s get groundfishermen catching haddock, and not close the herring fishery.”

Tooley said the herring industry agrees that there should be a limit on what the herring fishery takes from the haddock resource, and that accountability measures to enforce the limit are needed. But the methodology currently used to extrapolate estimates of how much haddock the herring fleet incidentally catches isn’t accurate, she said, and monitoring of harvesting operations, through observer or electronic programs, is inadequate for providing an accurate count of haddock catch.

“We need to have accountability,” Tooley said. “But with our current level of [observer] coverage…it’s become a real issue.”

In an action that became effective Oct. 22, 2015, herring midwater trawl vessels were prohibited from fishing for more than 2,000 pounds of herring per trip or day in the “Herring Georges Bank Haddock Accountability Measure Area,” a limit that will remain in place until the quota becomes available for the 2016 fishing year, on May 1.

The action effectively limited the midwater trawl fishery in Herring Management Area 3, because Area 3 falls within the Georges Bank Haddock Accountability Management Area.

Federally permitted herring vessels, all together, are allowed to catch 1 percent of the Georges Bank haddock resource. The overall allowable haddock catch on Georges Bank for 2015 was 53.7 million pounds (24.3 metric tons); 1 percent, which is further reduced a bit to account for management uncertainty, is 500,449 pounds (227 mt), according to NMFS.

According to data reported on Dec. 21, 2015, based on estimated haddock catches, the herring midwater fleet had reached 93.09 percent of its quota by September, and 104.49 percent by October.

The amount of haddock caught by the herring fleet is extrapolated from the amount of haddock caught on observer trips.

Herring, Haddock Fishermen at Odds as Regulators Seek Peace

January 26, 2016—PORTLAND, Maine (AP) — Fishing regulators are trying to broker peace between two of the most economically important fisheries in the Northeast, herring and haddock.

One of the areas where fishermen seek the two species is Georges Bank, a critical fishing ground off the New England coast. Atlantic herring are important as bait and sometimes as food, while haddock are a staple of New England’s fish markets and seafood restaurants.

Herring fishermen often accidentally capture haddock as bycatch, and they are allowed a “catch cap” of the fish in Georges Bank every year. They exceeded it last year, as they have in other recent years, and regulators closed a large section of Georges Bank to herring fishing until May 1, 2016.

Some herring fishermen have requested higher bycatch limits or other changes to the rules, but haddock and other groundfishermen frequently opposed changes. Haddock are an important money-maker for fishermen of bottom-dwelling species because they are much more abundant in Northeastern waters than cod, which have collapsed off of New England.

NOAA Expands Critical Habitat for Endangered North Atlantic Right Whales

January 26, 2016 — The following was released by NOAA Fisheries:

Using new information not previously available, NOAA Fisheries is expanding critical habitat for endangered North Atlantic right whales to cover its northeast feeding areas in the Gulf of Maine/Georges Bank region and southeast calving grounds from North Carolina to Florida.

This final rule, which was initially proposed in February 2015 and received 261 general comments over a 60-day comment period, does not include any new restrictions or management measures for commercial fishing operations.

“With two decades of new information and improved understanding since we first designated critical habitat for the species, we believe the expansion will further protect essential foraging and calving areas to further improve recovery of this animal,” said Eileen Sobeck, assistant NOAA administrator for NOAA Fisheries. “We’re making significant progress in reversing the population decline of the species, and are seeing signs of recovery – up to about 500 animals from the estimated 300 in 1994. But we still have a long way to get to complete recovery. “This rule is based on 35 years of aircraft and ship borne surveys of right whale distribution, research into foraging and prey availability to better understand right whale movements and life history. Together, these data provide a far more robust understanding of the factors critical to species recovery. Based on this information and public comments, NOAA scientists and managers determined a critical habitat expansion associated with feeding in the North and calving in the South is necessary for species recovery.

Under the Endangered Species Act, critical habitat within the range of the species consists of areas that contain physical or biological features essential to conservation of the species. The new designation does not create preserves or refuges or any other restrictions that directly affect the public. However, federal agencies conducting, funding or permitting activities in these areas, and project proponents that need federal permits or funding for such activities, are required to work with NOAA Fisheries to avoid or reduce impacts on critical habitat.
