Groundfish: NEFMC Discusses Recreational Issues, Amendment 23, Data, New Sector

January 31, 2019 — The following was released by the New England Fishery Management Council:

On January 30, midway through its three-day meeting in Portsmouth, NH, the New England Fishery Management Council covered a wide range of groundfish-related issues. These included:

  • The Fishery Data for Stock Assessment Working Group’s final report;
  • The peer review of the working group’s report by a subpanel of the Scientific and Statistical Committee;
  • A brief overview of the December 17, 2018 meeting of the Northeast Trawl Advisory Panel (NTAP), which included an announcement that NTAP is soliciting candidates through February 22, 2019 to serve on the panel;
  • A progress report on Groundfish Monitoring Amendment 23;
  • Consideration of whether the Greater Atlantic Regional Fisheries Office (GARFO) should approve a new lease-only groundfish sector called Mooncusser Sector, which the Council supported based on a recommendation from its Groundfish Committee that followed guidance on the process for new sectors;
  • A short update on the Council’s Groundfish Catch Share Review – here’s the draft outline; and
  • A number of recreational fishing issues.

Shutdown leaves NOAA behind schedule on East Coast fisheries management

January 29, 2019 — The administrator of a federal fisheries office says the government is behind schedule on actions related to oceans management because of the long shutdown.

The National Oceanic and Atmospheric Administration is charged with regulating fishing and marine issues for the U.S. government. Michael Pentony, the administrator of its Greater Atlantic Region Fisheries Office, said Monday the office is “behind schedule on many, many critically important actions.”

Pentony said fishing boats haven’t been able to fish because they could not get permits. He said there also weren’t enough resources to fully monitor protected ocean resources. Some fisheries have also been unable to operate at full capacity.

Statement from the GARFO Regional Administrator on the Government Shutdown

January 28, 2019 — The following was released by NOAA Fisheries:

On behalf of all the staff here at GARFO, let me say how happy we are to be back to work! This has been a trying time for our staff, our families, and our communities. While we are thankful the shutdown is over and we’re able to get back to serving the American people, we are now coming to grips with the full effect and impact of the shutdown on the people, communities, industries, and resources we serve.

We recognize and understand this shutdown didn’t just affect our federal staff and contractors; it also had, and continues to have, significant impacts on many of our partners and stakeholders. Fishing vessels have been unable to fish because they couldn’t get permits or transfer quota; projects couldn’t move forward without the required consultations; and there were inadequate resources to fully monitor and assess our protected resources.

Several fisheries have not been able to operate at full capacity because we haven’t been able to finalize the regulations that would increase quotas or fully restore the expected specifications. Some of these actions are past due, and some are due very soon. Frankly, we are behind schedule on many, many critically important actions. While our dedicated staff would like to get everything done on time, we simply will not be able to. The impacts of a shutdown of this scope and duration cannot be remedied quickly.

We will have three priorities as we ramp back up to full and normal operations: Getting fishermen fishing; completing consultations so federally permitted projects in your communities can move forward; and ensuring that adequate monitoring and protections are in place for our protected resources.

What does this mean? At least initially, some actions will not be prioritized and, even for our highest priorities, it will take staff time to work through the significant backlog of time-critical work that has accumulated over the last month. We ask for your patience and understanding as we work as quickly as possible to address all the priority actions that would have been completed during the shutdown, and on the actions that are needed in the coming weeks.

Shutdown hampers planning for management of fisheries

January 23, 2019 — The New England Fishery Management Council will meet as scheduled next week, but the agenda for the three-day meeting in Portsmouth, New Hampshire, will be colored by the ongoing shutdown of much of the federal government.

While the council is not scheduled to vote on any final actions, the shutdown has precluded a legion of scientific and fisheries management staff at the Gloucester-based Greater Atlantic Regional Fisheries Office and NOAA Fisheries’ Northeast Fisheries Science Center from contributing analysis and participating as they normally would in the management process.

“It’s really affected the plan development teams,” said Janice Plante, council spokeswoman. “Without their participation, the plan development teams just can’t get the analyses done. We knew this would be one implication of the shutdown. But the longer and longer it goes on, the more and more we miss their participation.”

NOAA leader looks to cultivate culture of collaboration

March 1, 2018 — As debuts go, Mike Pentony’s first day on the job as the regional director for NOAA’s Greater Atlantic Regional Fisheries Office was a corker.

The federal government marked his ascension on Jan. 22 as only the federal government can — shutting down all but the most essential government services as a consequence of the usual congressional mumbley-peg.

“My first action was to come in and proceed with the orderly shutdown of government operations,” Pentony said recently during an interview in the corner office on the uppermost floor of GARFO headquarters in Gloucester’s Blackburn Industrial Park.

The respite was short-lived. The shutdown lasted a day. When it was over, the 53-year-old Pentony began his new job in earnest as the leader of the regional agency that manages some of the most historically productive — and at times contentious — fisheries in the United States.

It is, as his successor John K. Bullard would attest, a monumental task, working on a canvas that stretches geographically along the Eastern seaboard from Maine to North Carolina and west to the Great Lakes.

But the geographical sweep pales in comparison to the scope and density of the regulations Pentony is charged with enforcing.

There is the crisis of cod in the Gulf of Maine, the alarming demise of the North Atlantic right whales, the malfeasance of cheaters such as New Bedford fishing kingpin Carlos Rafael and a myriad of other issues that affect every fishing community within his purview.

There is incessant wrangling over habitat protections, the usual tug-of-war between environmentalists and conservationists on one side and fishermen on the other. It is a drama with a disparate cast of characters and Pentony is convinced the only way to address extraordinarily intricate problems — usually requiring even more intricate responses — is by forging a collaborative spirit.

“I want to try to develop a culture, not just within GARFO and the agency, but within the region, both mid-Atlantic and New England, where we’re all partners with a collective goal of healthy fisheries and healthy fishing communities.” Pentony said. “The problems and challenges are so huge that we’re only stronger if we’re working together.”

He also understands, given the varying degrees of conflict that exist among fisheries stakeholders, that achieving that collaboration will be far more difficult than contemplating its benefits.

“There’s always going to be people that find it easier to stand outside the circle and throw stones than to get inside the circle and work,” Pentony said. “If they stand outside the circle and just shout about how everything is wrong, that generally doesn’t do much to solve the problem.”

Campaign of engagement

Pentony served under Bullard as assistant regional administrator for sustainable fisheries starting in 2014. He was asked what advice his predecessor gave him.

“He told me there are a lot of people cheering and hoping for your success,” Pentony said. “Not just me personally, but if I’m successful, then the regional office can be successful and the agency can be successful. And if you tie that success to our mission, then our success would mean healthy, sustainable fisheries, healthy and sustainable resources and healthy and sustainable fishing communities.”

Pentony made his fishery management bones as a staff member at the New England Fishery Management Council prior to joining NOAA Fisheries in 2002. That experience, he said, instilled in him a solid faith in the ability of the council system to ultimately arrive at the best decision once all implications are considered.

“I’ve been involved with the council process for 20 years,” Pentony said. “It’s not perfect. But I have a ton of respect for the work and effort council members put into being informed and working through what I think is unique in the federal regulatory process. We have this incredibly unique process that engages stakeholders.”

Pentony didn’t even wait for his first official day in the big chair to begin his own campaign of engagement.

The Friday before his official starting date, he traveled to the Yankee Fishermen’s Cooperative in Seabrook, New Hampshire, to meet with David Goethel — a frequent critic of NOAA Fisheries — and other New Hampshire fishermen to give them a sense of how he plans to approach the job.

Later that day, he had lunch in Gloucester with Vito Giacalone and Jackie Odell of the Northeast Seafood Coalition. He’s also traveled to Maine to breakfast with Maggie Raymond of the Associated Fisheries of Maine and met with New Jersey fishing companies and processors while in the Garden State on personal business.

New England Council Supports Regional Administrator’s Action to Enforce Groundfish Sector IX Operations Plan

November 21, 2017 — The following was released by the New England Fisheries Management Council:

The New England Fishery Management Council supports today’s announcement by the National Marine Fisheries Service’s (NMFS) Greater Atlantic Regional Fisheries Office (GARFO) that it will be enforcing groundfish sector rules and the Northeast Fishery Sector IX operations plan.

Under Amendment 16 to the Council’s groundfish plan, GARFO’s regional administrator has authority to withdraw approval of a sector at any time he or she, after consulting with the New England Council, determines that: (1) sector participants are not complying with the requirements of an approved operations plan; or (2) “continuation of the operations plan will undermine achievement of fishing mortality objectives” of the Northeast Multispecies Fishery Management Plan.

Regional Administrator Bullard consulted with the Council on two occasions – first during the Council’s June meeting in Portland, ME and then again during the September meeting in Gloucester, MA. On September 27, the Council voted to request that “GARFO immediately enforce sector regulations and the Sector IX operations plan.”

“We asked them to enforce the rule, and that’s what they’re doing,” said Council Executive Director Tom Nies. “Since 2004, the Council has emphasized repeatedly that sectors are responsible for monitoring their catch and enforcing sector provisions. Sector IX failed to comply with its own enforcement provisions when its president admitted to reporting violations.”

NMFS published an interim final rule on April 28, 2017 stating it had “provisionally approved” the Sector IX operations plan for 2017 and 2018, along with the annual catch entitlement (ACE) allocated to the sector for 2017.

Carlos Rafael, who was president of the sector at that time, pleaded guilty on March 30 to falsely reporting catch information for 13 vessels operating under the sector. However, since the Rafael case was under litigation when NMFS published the interim final rule approving all of the region’s 19 sectors and their operations plans, the agency stated its intention to take “additional action” if warranted for Sector IX following settlement of Rafael’s criminal case.

Rafael was sentenced September 25 in U.S. District Court in Boston to 46 months in prison, three years of supervised release, and fines. On October 11, he was further ordered to forfeit his interests in four vessels and their associated permits.

GARFO’s announcement today withdrawing approval of the Sector IX operations plans means that vessels enrolled in Sector IX are prohibited from: (1) fishing on a sector trip and harvesting sector ACE; (2) fishing on a common pool trip; or (3) joining another sector.

However, the action does not reallocate the ACE to other sectors or to the common pool. NMFS is continuing to analyze the extent of the sector’s ACE overages based on the misreporting of catch information for several stocks. The agency stated, “Any accountability measures, such as assessing and deducting ACE overages incurred by the sector, (will) be determined in a future action.”

NOAA Fisheries Greater Atlantic Regional Administrator Announces Retirement

July 12, 2017 — The following was released by NOAA:

NOAA Fisheries Greater Atlantic Regional Administrator John Bullard today formally announced he will retire on January 5, 2018. Bullard, who took the top job in the agency’s Gloucester-based office in 2012, will leave a legacy of improved relationships with the regulated community, the research community, environmentalists, local, state, and federal officials and agency partners, including the New England and the Mid-Atlantic fishery management councils and the Atlantic States Marine Fisheries Commission.

As the regional administrator responsible for leading the agency’s approach to fisheries, habitat, sea turtle, and marine mammal issues from Maine to North Carolina as well as the Great Lakes region, Bullard also provided a much-needed conduit helping the regulated communities understand the critical role of science in informing management decisions.

“As the former Mayor of New Bedford, Bullard brought with him a unique connection to the fishing industry, and used that connection to improve communication with all aspects of the industry and Congress during a very challenging period for the agency,” said Sam Rauch, NOAA Fisheries Deputy Assistant Administrator for Regulatory Programs.

As Regional Administrator, Bullard worked with the fishery management councils and the commission to manage 44 fish stocks, including two, scallops and lobster, worth more than $500 million each.

During his tenure, he faced the daunting New England groundfish crisis. Bullard met the challenge head on, making the tough and unpopular decision to impose emergency closures when the New England Council failed to act.

“I know how difficult these issues are, and I tried to tackle them with courage and compassion,” says Bullard.

Bullard worked with Congress and state directors to deliver $32.8 million in disaster assistance to affected fishing families and communities. In close collaboration with the New England Council, Bullard then put quotas and closures in place to protect cod and other depleted fish stocks.

“We wish John well,” said New England Council Executive Director Tom Nies. “He is always willing to work with the council to find management solutions and empowers those around him to actively participate in the process, which is one of his key accomplishments. That may go unnoticed by many, but it is one of the reasons our council has been able to complete so many management actions during his tenure.”

Bullard’s leadership in protecting living marine resources included removing approximately 30,000 miles of rope from Atlantic coastal waters to reduce whale entanglements and expanding critical habitat for North Atlantic right whales in the region by more than 25,000 nautical miles. He also oversaw development of a strategy to restore river herring populations, imposed catch caps on mackerel and herring fisheries, and removed dams and created fish passages to double fish runs in key Maine, New Hampshire, and Massachusetts rivers.

“For me, John is an example of public service and more importantly, an example of working with stakeholders to have a positive impact on tough issues,” said Dr. Jon Hare, science and research director at NOAA’s Northeast Fisheries Science Center. “I will miss working with him and am thankful for his time as regional administrator.”

Bullard strongly supported groundbreaking actions created to bolster the Mid-Atlantic region’s important recreational and commercial fisheries. In 2016, he approved the Mid-Atlantic Council’s deep-sea coral amendment that protects 15 deep-sea canyons and a total area of 24 million acres, about the size of Virginia, where fragile, slow-growing corals live. These hotspots of biodiversity provide important habitat, refuge, and prey for fish and other marine life. Bullard has also advanced an action to protect small schooling fish, also known as forage fish, which serve as prey for larger fish, marine mammals, and sea birds. This would be the first ever action on the Atlantic coast to designate forage fish as important parts of the ecosystem and provide protection for them.

“Throughout his tenure as regional administrator, John has been an engaged and dedicated participant in the council process, and he has played an important role in increasing focus on the Mid-Atlantic portion of the Greater Atlantic Region,” said Chris Moore, executive director of the Mid-Atlantic Fishery Management Council. “His insight and leadership have been especially valuable to the Mid-Atlantic Council during the development of several new initiatives such as the Deep Sea Corals Amendment, the Unmanaged Forage Fish Amendment, and the development of an ecosystem approach to fisheries management.”

Bullard also led the charge to modernize access and sharing of fishery dependent data in cooperation with the Northeast Fisheries Science Center, the fishing industry, the councils and the Atlantic Coastal Cooperative Statistics Program. He championed electronic monitoring pilot projects on fishing vessels with partners in the industry and environmental non-government organizations to increase coverage and improve the data on which our science is based.

“It’s been an honor and pleasure to work with John. He has been a strong supporter of state/federal cooperation in the management of our shared marine resources,” said Bob Beal, executive director of the Atlantic States Marine Fisheries Commission. “We are grateful for his contributions to sustainable management and wish him the very best.”

“I’m really proud of the work I’ve done with the GARFO team. They are intelligent, hard-working, and caring professionals, and I rely on them every day to make me smart on the many issues we face,” said Bullard, who has no plans to slow down before he leaves. “There is work left to do before I leave—very important work. Still on my list are the Omnibus Habitat Amendment, the New England Council’s Deep Sea Coral Amendment, some critical dam removals, electronic monitoring, the Carlos Rafael situation, the summer flounder crisis, and the continuing groundfish challenge, among others.”

However, once he does bid the agency goodbye, he plans to literally sail into the sunset, provided the weather is warm enough!

The agency will launch a search for Bullard’s replacement within the next several months.

2016 fishing review highlights monitors —human and electronic

April 24, 2017 — NOAA’s Greater Atlantic Regional Office released its annual year in review for 2016 and nowhere does it mention the ever-churning debate over Gulf of Maine cod and the yawning divide between scientists’ data and the primary-source observations of fishermen.

For the most part, the report is a four-color chronicle of what officials at Gloucester-based GARFO — which manages the nation’s federal fisheries from the Gulf of Maine south to Cape Hatteras and west to the Great Lakes — consider the agency’s most tangible accomplishments in 2016.

Still, the review gives some insight into some of the agency’s management priorities and policy areas where it may marshal its resources in the future.

It specifically mentions the office’s work in drafting a recovery plan for endangered Atlantic salmon and a five-year action plan for the species. It highlights its work with commercial groundfishermen — many of them from Gloucester — on potential changes to the small-mesh whiting fishery.

The report also highlights the agency’s transfer of the cost of of at-sea monitoring to permit holders.

NEFMC Considers Adjusting Skate Bait Trigger, Possession Limit

April 18, 2017 — The following was released by the New England Fishery Management Council:

The New England Fishery Management Council has initiated a framework adjustment to the Northeast Skate Complex Fishery Management Plan (FMP) to consider alternatives for adjusting the skate bait threshold trigger and possession limit.

The Council’s Skate Committee recommended the action, and the National Marine Fisheries Service’s (NMFS) Greater Atlantic Regional Fisheries Office (GARFO) will provide assistance in developing the document. The framework will be narrowly focused, addressing only the trigger/possession limit issues. The Council anticipates taking final action at its June meeting and, if all stays on schedule, NMFS is aiming to implement the new measures in December.

Complications with this winter’s fishery led the Council to pursue a framework adjustment. On January 30, NMFS reduced the commercial per-trip possession limits for both the skate wing and skate bait fisheries to the following “incidental” levels:
