New Bedford Standard Times: One more fault with fishing rules

January 15, 2016 — Fishing vessels tied up in New Bedford but not allowed to unload part of their catch this week suggest one more weakness in our fishing regulations that is ripe for remedy.

State environmental regulations allow a boat carrying fish to an out-of-state port to land fish in Massachusetts when injured crew or severe mechanical issues force the decision. Foul weather, apparently, is not part of the equation.

Unfortunately for seven vessels — three home-ported here and four from North Carolina — foul weather this week chased them to New Bedford, though they were all fishing on North Carolina permits. The state regulators have allowed the boats to land the portion of the catch classified as “incidental,” but the main target, fluke, as of Thursday afternoon, were still aboard at least two of the vessels because the fluke season doesn’t open in the local fishery until February.

The decision to allow the landing of the incidental catch is somewhat encouraging, as it suggests the Environmental Police tackling this interstate fish story can be flexible.

The fact that the fluke was still aboard yesterday, however, means there’s room for improvement among the rules concerned with quotas, sectors and neighboring regional Fishery Management Councils.

Real-time fishery management significantly reduces bycatch

January 12, 2016 — DURHAM, N.C. – Using real-time management policies to regulate fisheries can reduce the accidental bycatch of juvenile fish and endangered species with substantially less economic impact on fishermen, a new Duke University-led study finds.

The study compared results from six different types of fishery closures commonly used to reduce bycatch.

It found that “dynamic closures” — which typically involve setting smaller portions of the ocean off-limits for shorter periods, based on fine-scale, real-time assessments of changing conditions — are up to three times more efficient at reducing bycatch with lower costs to fishermen than static measures that close large areas and remain in force longer.

“The ecological patterns that create bycatch don’t occur on monthly or 100-square-kilometer-size scales or larger. They occur at much smaller time-space scales,” said Daniel C. Dunn, lead author of the study and a research scientist in the Marine Geospatial Ecology Lab at Duke’s Nicholas School of the Environment. “Our study provides empirical evidence that if we’re not managing the ocean at these smaller scales there is an inherent inefficiency in the system that costs both fishermen and species alike.”

The study appeared the week of January 6 in the Proceedings of the National Academy of Sciences.

The success of dynamic fisheries management hinges on recent advances “that extend the real-time technology at our fingertips and take it into the ocean,” said Sara M. Maxwell, assistant professor of biological sciences at Old Dominion University, who co-authored the study.

MASSACHUSETTS: Coast Guard tows fishing boat over violations

January 8, 2016 — A New Bedford fishing vessel’s voyage was cut short Thursday after the Coast Guard found multiple safety violations, according to a statement from the Coast Guard.

The 83-foot Amber Nicole did not have a life raft, had improperly marked survival suits, and no record of performing mandatory monthly drills, all serious safety deficiencies, according to the Coast Guard statement. The boat was operating about 44 nautical miles off Nantucket with a crew of seven.

Sustainable Fishburger Based On Chef Eric Ripert’s Recipe Coming To Hamptons School

January 8, 2016 — A group of extraordinary East End chefs have joined forces in the kitchen for The Montauk Fishburger Project, an initiative that aims to familiarize local elementary and high school students with one of the area’s plentiful, nutritious resources, which is being conscientiously harvested under firm federal and state fisheries management regulations, incredibly close to home.

The program is being pioneered by the founding members of Dock to Dish, the first Restaurant Supported Fishery program in the U.S., who have now established the inaugural partnership with The Long Island Commercial Fishing Association and the Bridgehampton Edible School Garden program, with the goal of making wild, sustainable, traceable local seafood readily available to East End youth.

MASSACHUSETTS: ‘We’re not dying yet. But …’

January 8, 2016 —  Gerry O’Neill looks at the water world spinning around him, a world of regulation and re-regulation and over-regulation — in other words, the modern world of commercial fishing — and thinks that he’s seen this movie before.

Two days removed from the public comment hearing at the state Division of Marine Fisheries offices on Emerson Street on potential changes to rules governing the scope and the schedule of the herring season, O’Neill sits in his office on Jodrey State Fish Pier and wonders if his two 141-foot mid-water trawlers Challenger and Endeavour and the Cape Seafood fish processing and sales operations that collectively employ almost 40 full-time workers — and even more when the product is flowing — will survive the future any better than the nearly decimated Gloucester groundfish fleet.

“At the end of the day, the groundfishermen are struggling and everybody knows that and it’s because of over-regulation as well,” O’Neill said. “We’re not dying yet. But if they keep doing what they’re doing, we’re going to go the same way as the groundfishermen.”

Given the state of the groundfish fleet, that is a chilling phrase, made even more-so by his matter-of-fact delivery in the soft brogue of his native Ireland and his admission that he favors regulations that will sustain the fishery even when they cost him fish and money.

Fishery not broken

His voice was steady and calm, just as it was at Tuesday’s session in which David Pierce, the executive director of DMF and the state’s representative on the Atlantic States Marine Fisheries Commission which governs the Northeast herring fishery, conceded the fishery remains robust.

“The stock remains rebuilt and over-fishing is not occurring,” Pierce told the approximately 20 stakeholders that attended. “The mortality seems to be under control and the stock appears to be in a good shape.”

MASSACHUSETTS: Fishermen’s Trust Looks to the Future

January 7, 2016 — After a strong year, the Martha’s Vineyard Fishermen’s Preservation Trust is pressing ahead with its mission to support commercial fishermen on the Island. On Tuesday, eight of the nine board members attended a meeting of the Chilmark selectmen to seek further support.

“We have accomplished as much as we possibly can do in a volunteer setting,” board member and commercial fisherman Wes Brighton said, emphasizing the need for funding and other support to help attract young fishermen and sustain the industry. The Island fleet has struggled in the face of increasing costs and regulations in recent years.

Last summer the trust held its first Meet the Fleet event in Menemsha, drawing large crowds to the harbor and raising awareness of the challenges facing the industry. It also partnered with The Nature Conservancy to purchase the Island’s last federal groundfish permit, in its efforts to establish a permit bank to support Island fishermen.

But the Island’s historic fishing harbor is changing. In September, the 75-foot Unicorn dragger was sold in New Bedford, following the path of its sister ship, the Quitsa Strider II, in 2014. Both ships had once landed groundfish and other species by the ton but ended up unused and rusting in the harbor. Trust president John Keene worried that as Island lobstermen retire, a new generation may be unable to replace them.

“Pretty soon the harbor will be without the main attraction,” he said of the commercial fishing fleet. “We’re worried that if that happens, then Menemsha starts changing from what it is to more of a marina.”

Public hearing set on fluke and sea bass regulations

January 4, 2016 — A public hearing on summer flounder and sea bass regulations will be held at 6:30 p.m. Jan. 7 at the Stafford Township Municipal Building.

What’s on the table is Draft Addendum XXVII to the Atlantic States Marine Fisheries Commission’s Summer Flounder, Scup, Black Sea Bass Fishery Management Plan.

There will be a cutback of 30-percent of the coastwide harvest of summer flounder in 2016 from 23 million pounds to 16 million pounds but it may not impact recreational regulations because anglers fished under their 2015 quota.

MASSACHUSETTS: Hearing on new herring rules this afternoon in Gloucester

January 5, 2016 — Interstate regulators are holding a hearing for fishermen in Gloucester today about a plan to amend some of the rules for Atlantic herring fishing.

The Atlantic States Marine Fisheries Commission is soliciting comments about the amended rules. The proposal includes alternatives to the current spawning monitoring program and changes to the requirements about a boat’s condition before it leaves on a fishing trip.

Today’s meeting in Gloucester begins at 2 p.m. at the state Division of Marine Fisheries’ Annisquam River Station at 30 Emerson Ave.

More absurdness from the North Carolina Division of Marine Fisheries

December 31, 2015 — On January 1 we will have imposed on commercial fishermen (those who fish with nets) and people who like fresh seafood bought either from the local fish market or prepared in a local restaurant an example of the worst kind of government. That is, the imposition of regulations for the sake of regulation, without valid or reliable science or even common sense. The Division of Marine Fisheries will impose absurd regulations on the catching of flounder in North Carolina’s coastal waters.

The purpose of the regulations, plus the mission of the DMF in general in recent years, could be said to extinguish commercial fishing in the state’s waters.

Maine DMR closes Gouldsboro Bay and other areas to scallop fishing

December 14, 2015 — ELLSWORTH, Maine — The Maine scallop fishing season opened on Dec. 1 and, less than two weeks later, Department of Marine Resources Commissioner Patrick Keliher closed it down in large areas of Downeast waters.

Last week, DMR announced that, as of Sunday, scallop fishing in Gouldsboro and Dyer bays in Hancock County and Wohoa Bay, the Jonesport Reach and the department’s Inner Machias Rotational Area, all in Washington County, are done for this season. According to DMR, Keliher shut the fishery down in those areas “in order to protect Maine’s scallop resource due to the risk of unusual damage and imminent depletion.”

At a meeting in Ellsworth just days before the season opened, DMR Resource Coordinator Trisha Cheney warned that scallop populations throughout the state were extremely low. While the department agreed to industry requests to set the fishing season (except in Cobscook Bay) at 70 days, Cheney said, it was likely that fishing in some areas would be closed after only a few days of fishing.

The closure was announced after just seven days of fishing. (In most areas, fishing is allowed only four days per week, Monday through Thursday.)

With the scallop resource still in poor condition, DMR is worried that continued harvesting in the closed areas could deplete the stock in those locales beyond its ability to recover.

“Continued harvesting may damage sublegal scallops that could be caught during subsequent fishing seasons, as well as reducing the broodstock essential to a recovery,” the department wrote in an explanation of the adoption of the emergency closure rule.
