Western Pacific Federal Managers Support Conservation Definition and Request Better Coordination with NOAA on ESA Biological Opinions

June 23, 2022 — The following was released by the Western Pacific Regional Fishery Management Council:

Today, the Council requested NOAA and the Council for Environmental Quality (CEQ) adopt a Council Coordination Committee (CCC) area-based management subcommittee’s proposed definition of “conservation area” to identify qualifying regions in President Biden’s “30×30” initiative. The CCC represents the eight Regional Fishery Management Councils in the nation.

“The Council has a golden opportunity to support what the CCC has done, and help NOAA and the CEQ move forward with a sensible and fair definition of conservation that not only includes provisions to protect biodiversity, but also promotes wise use of fisheries,” said Will Sword, Council vice chair from American Samoa.

The Council recommends CEQ follow National Environmental Protection Act (NEPA) guidelines when implementing America the Beautiful and consult state and territorial governors affected by new conservation areas. In addition, the Council will inform NOAA, the CEQ and Biden Administration that the Western Pacific Region has met 97% of the “30×30” goal to conserve 30% of all U.S. lands and waters by 2030 with its existing marine managed areas.

The Council called upon NOAA National Marine Fisheries Service (NMFS) to include the Council in developing any reasonable and prudent measures in advance of the draft biological opinions on the Hawai‘i deep-set and American Samoa longline fisheries. The biological opinion assesses if the fisheries are likely to jeopardize the continued existence or recovery of Endangered Species Act-listed species.

A NMFS policy directive recognizes the Council’s unique role in helping the agency comply with the ESA. The Council is charged with developing fishery management regulations under the Magnuson-Stevens Act, which are approved by the Secretary of Commerce and then implemented by NMFS. Despite repeated Council requests over the past three years, NMFS has not discussed potential measures that may be needed to reduce the fisheries’ impacts on ESA-listed species.

The Council recommended setting a 2023 catch limit of 2,000 metric tons (mt) of bigeye tuna each for American Samoa, Guam and the Commonwealth of the Northern Marianas (CNMI). Each U.S. Participating Territory would have a transfer limit up to 1,500 mt to Hawai‘i-based U.S. longline vessels operating under approved specified fishing agreements with the territories. Total transfers would be limited to 3,000 mt.

The Hawai‘i longline fishery has a low impact (3% of total catch) on the Western and Central Pacific (WCPO) bigeye tuna stock. The Council recommended exploring an increase to the U.S. longline catch limit for WCPO bigeye tuna and increasing future allocation limits from the territories to Hawai‘i-based longline vessels.

In the 2021 annual report on the status of fisheries in the region, pelagic fisheries catch increased across gear types, resulting in increased revenue from high fish prices. Bottomfish fisheries in the CNMI and Guam increased substantially in catch and effort. Bottomfish catch in American Samoa waned to its lowest level over the past decade—the average yearly catch of approximately 12,000 pounds dropped to just over 2,000 pounds in 2021. Reports will be available on the Council website next week.

The Council held an equity and environmental justice (EEJ) workshop in April that brought together indigenous Council members, advisory panel members, NOAA regional staff and leaders in the Western Pacific Region. To effect EEJ momentum in our region, participants emphasized the importance of outreach and engagement, building local capacity, fostering a bottom-up approach, funding community projects, collaborating with local agencies and managing climate change impacts. Based on this workshop, the Council will provide comments on the NMFS draft EEJ strategy to identify long-standing issues in the U.S. Pacific Islands.

Nation’s Fishery Management Councils Find Consensus on MSA Changes, Advocate for Efforts to Address Environmental Justice Issues

October 26, 2021 — The following was released by the Pacific Fishery Management Council:

Leaders of the nation’s eight Regional Fishery Management Councils concluded their second biannual meeting in 2021 last week by videoconference. The Council Coordination Committee meeting provides the Councils and heads of the National Marine Fisheries Service an opportunity to discuss issues relevant to all of the Councils. The three-day meeting was open to the public and hosted by the Pacific Fishery Management Council.  Among the issues discussed were proposed changes to the Magnuson-Stevens Fishery Conservation and Management Act and the need to more fully address environmental justice for underserved fishing communities.

Nation’s Fishery Councils Recommend Ways to Support American Seafood, Improve Coordination with NMFS

September 30, 2020 — An executive order, changes to National Environmental Policy Act measures, guidance related to overfishing and a National Seafood Council were among several issues fishery leaders from around the country discussed last week. The biannual meeting of the Council Coordination Committee was held virtually, but hosted by Western Pacific Regional Fishery Management Council.

Nation’s Fishery Management Councils Recommend Ways to Support American Seafood, Improve Coordination with National Marine Fisheries Service

September 28, 2020 — The following was released by the Western Pacific Regional Fishery Management Council:

Leaders of the nation’s eight Regional Fishery Management Councils concluded their second biannual meeting in 2020 yesterday by videoconference. The Council Coordination Committee (CCC) meeting provides the Councils and heads of the NOAA National Marine Fisheries Service (NMFS, also known as NOAA Fisheries) an opportunity to discuss issues relevant to all of the Councils. Under the Magnuson-Stevens Fishery Conservation and Management Act (MSA), each Council is authorized to develop, monitor and amend fishery management plans for federally managed fisheries in its region. Once approved by the Secretary of Commerce, these plans are implemented by NMFS. The two-day meeting was open to the public and hosted by the Western Pacific Council. Among its recommendations, the CCC addressed President Trump’s Executive Order (EO) 13921 on Promoting American Seafood Competitiveness and Economic Growth, new National Environmental Protection Act (NEPA) measures issued by the White House Council on Environmental Quality (CEQ), and NMFS coordination on a proposed National Seafood Council and on overfishing technical guidance.

EO 13921 aims to strengthen the American economy, improve the competitiveness of American industry, ensure food security, provide environmentally safe and sustainable seafood, support American workers, remove unnecessary regulatory burdens and ensure coordinated, predictable and transparent Federal actions. At its May 2020 meeting, the CCC released a preliminary joint statement, and, subsequently, each Council provided its own regional recommendations or status in the process of identifying potential changes to regulations, orders, guidance documents and other similar agency actions. The May 2020 CCC letter highlighted the consequences of marine national monuments on the Nation’s fisheries and can be found at www.fisherycouncils.org/ccc-correspondence. Yesterday, the CCC requested that NMFS continue to brief the CCC and the individual Councils on the review and implementation of their recommendations.

EO 13921 also includes actions for more effective permitting related to offshore aquaculture and long-term strategic planning to facilitate aquaculture projects. Taking this into account, the CCC yesterday recommended that its consensus statement on aquaculture be revised and considered for review at the next CCC meeting planned for May 2021.

The CCC also recommended that NMFS coordinate with the Councils to release the aquaculture programmatic environmental impact statement (EIS) for public comment. The EIS assesses the impacts of siting aquaculture facilities. The CCC further recommended that NMFS, prior to identification of Aquaculture Opportunity Areas (AOA), provide the spatially referenced data used to identify the AOAs and that the Councils be included on the AOA implementation teams.

Another initiative to support and increase the value of sustainably managed U.S. fisheries is an industry-led National Seafood Council that the NMFS Marine Fisheries Advisory Committee recently recommended. In regard to this proposal, the CCC requested that NMFS evaluate the NOAA FishWatch criteria for the purpose of serving as an equivalent to third-party certification deeming U.S. fishery products as sustainable. The CCC requested that NMFS report on the utility of FishWatch for this purpose and any possible alternatives by the May 2021 CCC meeting. Several other recommendations by the CCC focused on improving coordination between the Councils and NMFS.

The CCC moved to create a CCC subcommittee to make recommendations to NMFS in developing guidance on the new NEPA rule announced by CEQ on July 15, 2020. Such guidance could include determining and implementing the functional equivalency provision of the new rule, which would address current duplication in MSA and NEPA requirements. Signed into law in 1970, NEPA requires Federal agencies to consider the environmental effects of proposed major Federal actions significantly affecting the quality of the human environment.

The CCC requested that NMFS circulate draft reports of its National Standard 1 Technical Working Groups through the Councils with sufficient time for the Councils to consult with their Scientific and Statistical Committees and develop a response through their full Councils. The MSA contains 10 National Standards. Standard 1 says conservation and management measures must prevent overfishing while achieving, on a continuing basis, optimum yield from each fishery for the U.S. fishing industry. The issues addressed by the Working Groups were estimating fish population reference points, quota carry-over and phased-in catch limits, and alternative management approaches due to data limitations.

The CCC also requested that the NMFS Office of Sustainable Fisheries form a working group comprised of NMFS and Council staff members to determine alternative approaches to the use of annual catch limits (ACLs) to manage data limited stocks. The 2006 reauthorization of the MSA mandated that overfishing be addressed through enforceable ACLs that cannot exceed scientific recommendations. Alternative approaches identified in the CCC recommendation include those that are based on fishing mortality rates, fish lengths and fishing trip limits, among others.

Fishery Management Councils to Meet May 27-28 by Teleconference

May 21, 2020 — The following was released by the Western Pacific Regional Fishery Management Council:

Leadership teams from the nation’s eight regional fishery management councils will convene by teleconference for the spring 2020 Council Coordination Committee (CCC) meeting. The CCC is comprised of the chairs, vice chairs and executive directors of the Caribbean, Gulf of Mexico, Mid-Atlantic, New England, North Pacific, Pacific, South Atlantic and Western Pacific Fishery Management Councils. CCC chairmanship rotates annually among the eight Councils, which have authority over fisheries seaward of state waters in the US exclusive economic zone.

The committee meets twice each year with the National Marine Fisheries Service (NMFS) to discuss issues relevant to all fishery management councils. The Western Pacific Council is serving as this year’s CCC chair and will be hosting this year’s first meeting on May 27 and 28. The meeting will be held by teleconference due to COVID-19 travel and quarantine restrictions.  The public is welcome to participate.

Agenda items will be discussed between 7:30 a.m. and 11:30 a.m. (Hawai‘i standard time) each day. Among the scheduled topics are the following:

First MSA Reauthorization Hearing Acknowledged Successes, Identified Needed Changes

August 2, 2017 — SEAFOOD NEWS — At the first of a series of hearings on the Magnuson-Stevens Act held yesterday at the Subcommittee on Oceans, Atmosphere, Fisheries, and Coast Guard, senators from both sides of the aisle voiced support for the regional management council system, NOAA Fisheries, and the science that supports fisheries management, despite the deep cuts proposed in the President’s budget.

“With regard to the budget, I think some of these cuts may not survive the [reauthorization] process,” said Chairman Dan Sullivan (R-AK). “I think we’re going to be adding a lot back to the projects that we think are vital.”

Sullivan was responding in part to a series of questions from Sen. Richard Blumenthal (D-CT) to Chris Oliver, Assistant Administrator for NOAA Fisheries, about the current administration’s proposed budget for the agency.

“My question concerns the budget submitted by the president of the United States. The budget slashes funding for programs like Sea Grant and the Milford Lab at the University of Connecticut [Northeast Fisheries Science Center],” Blumenthal said.

“These federal research efforts to help grow and expand certain aspects of aquaculture are very promising. As a representative of this administration, how can you justify these cuts to the agency that you are responsible for administering? Are you going to commit to me that you’re going to [find funding] for Sea Grant and the Milford Lab?”

Oliver responded, “Senator, I don’t know that I’m in a position to comment very extensively on the President’s budget. I do know that they’ve placed a revised emphasis on the Department of Defense and national security.”

Blumenthal: “I’m on the Armed Services Committee sir, and I very much support that emphasis … but this kind of slashing and trashing of programs that are essential to the kinds of programs you administer, that are vital to our economic future in aquaculture I consider a mockery of the mission of your agency. And if you’re not in a position to justify it, who would be?”

Oliver: “All I can say sir is we’re going to do our best to operate within the budget that we have, and I know that a lot of the programs that were slated to be cut involve cooperative agreements or past grants of funding through the Sea Grant program, for example, and grants to the coastal states. We’re going to do our best to make that up internally…”

Blumenthal: “Are you going to commit to me that you can make up those cuts to the Sea Grant program and the Milford Lab and the University of Connecticut that are essential to those programs?”

Oliver: “I can’t commit that we’re specifically going to be able to make those up from our baseline budget. I think that we’re facing some tough decisions too. I’ve said on many occasions that I feel that this agency may be in a position to refocus on some of its very core mission – science mission…”

Blumenthal: “You’d agree with me that those are valid and important programs?”

Oliver: “Of course sir, I really do.”

Blumenthal: “If you agree these programs are valid, then your agency has a responsibility to fight for them and to make sure they are fully funded.”

The exchange was toward the end of an otherwise non-confrontational hearing on the “long overdue” reauthorization of the MSA with Oliver and Dr. John Quinn, Chair of the New England Fisheries Management Council. Both men lauded the successes brought about by the original 1976 law and the amendments to it, most recently in 2007.

“As a group, we are strong believers in the Magnuson-Stevens Act – and not just because it established the Councils,” said Quinn, who spoke on behalf of the Council Coordination Committee (CCC), which is made up of the chairs, vice chairs, and executive directors of the eight Regional Fishery Management Councils.

“The outcome of our management success is clear: commercial, recreational, and subsistence fisheries are key contributors to our coastal communities and the nation’s economy. In large measure, this is because the Act structured a very successful approach to sustainable fisheries management. Central to the Act are the 10 National Standards that guide our management process.”

“Under the standards set in the Magnuson-Stevens Act the nation has made great strides in maintaining more stocks at biologically sustainable levels, ending overfishing, rebuilding overfished stocks, building a sustainable future for our fishing-dependent communities, and providing more domestic options for U.S. seafood consumers in a market dominated by imports,” echoed Oliver.

Both agreed, however, that changes should be made. Oliver noted in particular ways in which overall production could be increased, particularly in areas where catch limits have not been updated to changes in stock sizes.

“For example, while our West Coast groundfish fisheries have rebuilt several important stocks, in recent years fishermen are leaving a substantial amount of the available harvest of some groundfish species in the water, due to regulatory or bycatch species constraints. We must find ways to maximize allowable harvests that are still protective of non-target species in all of our fisheries,” explained Oliver.

Stakeholders in the West Coast groundfish fishery were enthusiastic about Oliver’s references to the plight of those working in the non-whiting trawl catch shares program. The program has realized far less than full utilization of the resource, with less than one-third of the available fish being harvested annually.

“We applaud Chris Oliver’s recent testimony to the Senate on the state of the West Coast IFQ non-whiting trawl fishery,” Pacific Seafood’s Mike Okoniewski said.

“Members of industry have been testifying for years that while the conservation benefits of the program have passed all expectations, but the economics are performing at abysmal levels,” Okoniewski said.

Oliver’s testimony drilled to the heart of the matter: if you cannot get the fish out of the water you cannot realize the economic benefits outlined in the program’s goals and objectives. Targets such as increasing economic benefits, providing full utilization of the trawl sector allocation, increasing operational flexibility and providing measurable economic and employment benefits throughout the processing and distribution chain have not been met for the non-whiting sector.

“Chris Oliver’s testimony is a huge step forward to reverse the present trajectory we are on. Again we thank him and look forward his leadership of NMFS. His focus on balance and economic output, as well as conservation and sustainability, is long overdue,” Okoniewski said.

“Much like Pacific groundfish (to quote AA Oliver), New England groundfish fishermen ‘are leaving a substantial amount of the available harvest of some groundfish species in the water, due to regulatory or bycatch species constraints’”, noted Maggie Raymond, Executive Director of Associated Fisheries of Maine.

Both Quinn and Oliver referenced a need for “flexibility”, Raymond observed.

“Quinn’s testimony is specific to a need for flexibility in rebuilding timelines.  But flexibility in rebuilding timelines is not necessarily the fix, at least not for New England,” she added.

“As long as an otherwise healthy mixed stock fishery remains constrained by a weak stock in the complex, the problem of leaving available harvest in the water cannot be addressed.  We look forward to working with AA Oliver to ‘find ways to maximize allowable harvests that are still protective of non-target species.’

“Let’s start with windowpane flounder. A species with no economic value that puts a significant burden on the NE groundfish and scallop fisheries,” said Raymond.

Oliver acknowledged his testimony from last year on no need for further flexibility on MSA. But, he said, “I’m in a new role now and as I look at the issue more broadly, I’d heard from constituents across the country, listened to the dialog about issues with the Act, and I’ve come to believe that there is a possibility that additional flexibilities should be considered, accountability measures that are used to enforced annual catch limits (ACLs), particularly in fisheries where we don’t have the robust and accurate accounting.

“Many of our recreational fisheries are of a nature that don’t lend themselves well to those monitoring methods.

“The administration has not taken positions on these specific issues,” Oliver said. “But in my personal view, in fisheries that don’t have robust systems of accountability, in particular the recreational fisheries that have different goals, there’s room for flexibility.”

Quinn agreed. “We’re here to reauthorize [the MSA], not repeal it. Data availability and stock assessment, particularly in the recreational side, I think we’ve got a lot of work to do. Data needs are really important. ACLs and AMs work for the commercial, not necessarily for the recreational fisheries.”

Senator Cory Booker (D-NJ) called the nation’s bycatch quantity “unacceptable” and asked Quinn for an assessment on catch shares.

“In some parts of the country, catch shares have worked,” Quinn responded. “In my part of the country, it hasn’t worked as well. But the CCC’s position is to keep catch shares as a part of our management tool box.”

Sullivan brought up the issue of electronic monitoring as a less expensive alternative to onboard observers and asked, “What can we do to help the councils use EM more efficiently?”

“Like catch shares, the authority for EM is in the Act now,” said Quinn, “but individual regions may have specific fisheries that may or may not use EM. There are a lot of pilot programs using EM now. Decisions should be made region by region.”

“I want to compliment you both on your emphasis on data and science,” Sullivan said in closing comments. “We’re going to back you up on that.”

The next hearing will be August 23, 2017 in Kenai, Alaska.

Senate Subcommittee Holds First Hearing to Guide Magnuson-Stevens Reauthorization

August 2, 2017 — The Magnuson-Stevens Act, the primary law regulating fisheries in federal waters, is in need of reauthorization, and Senate Commerce’s Subcommittee on Oceans, Atmosphere, Fisheries and Coast Guard on Tuesday held the first in a series of hearings to guide that process. And, unsurprisingly, the issue of climate change made waves.

Chris Oliver, assistant administrator of NOAA’s National Marine Fisheries Service, and John Quinn, chairman of the New England Fishery Management Council, pushed for a variety of changes, ranging from management of mixed stocks to more flexibility in how the Council Coordination Committee can monitor and collect data. But it was Sen. Richard Blumenthal who made the strongest case for change by criticizing the current system for failing New England’s fishing fleet and leaving the region’s fishermen “angry and frustrated beyond words.”

Because of climate change, Blumenthal said, fish that New England fishermen have traditionally sought were pushed north and fish from southern waters moved into New England. But catch limits for certain fish haven’t been adjusted to meet the reality facing New England fishermen, forcing them to return quota-exceeding fish to the ocean. Billions of dollars in profits are being lost, Blumenthal said, while fishermen from southern states come to New England waters to catch their migrating fish. “There is something profoundly unfair and intolerable about the situation,” he added. “In my view, it violates the present law.”

Quinn responded by pointing out that parts of the New England fishing industry are booming but agreed that groundfish fishermen are struggling. While the CCC’s process is to collect as much data as needed to produce accurate stock assessments, Quinn said they didn’t have “a simple solution for rising water temperatures or the ocean acidification,” which are the roots of the shifting fish populations.

Public invited to meetings of fishing regulators

May 12, 2017 — Gloucester, Massachusetts will sit at the epicenter of the national fishery management universe next week when top regulators from around the country gather here for three days of overviews of the nation’s individual fisheries.

The Council Coordination Committee, which includes chairmen and directors of the eight regional fishery management councils, is set to discuss issues such as national monuments and sanctuaries, habitat, recreational fisheries, enforcement and legislation.

The meetings at the Beauport Hotel Gloucester are being hosted by the New England Fishery Management Council, which was determined to hold them in a working commercial fishing port, according to NEFMC Executive Director Tom Nies.

Nies said the meetings give the geographically diverse regulators — who hale from Alaska to the Caribbean — the chance to discuss issues that cut across all of their councils. It also affords NOAA Fisheries the opportunity speak to the collective councils as a single group.

“We meet twice a year and it’s really the only time all eight council have the chance to discuss national-level policy issues and issues that other councils are facing that we may face ourselves in the future,” Nies said.

Fishery Management Councils to Meet May 15-18 in Gloucester

Leadership teams from the nation’s eight regional fishery management councils will be gathering in Gloucester, MA for the spring 2017 Council Coordination Committee (CCC) meeting.

The CCC is comprised of the chairs, vice chairs, and executive directors of the New England, Mid-Atlantic, South Atlantic, Caribbean, Gulf of Mexico, Pacific, Western Pacific, and North Pacific Fishery Management Councils. CCC chairmanship rotates annually among the eight Councils.

The committee meets twice each year to discuss issues relevant to all fishery management councils. The National Marine Fisheries Service – often called NOAA Fisheries – annually hosts the first meeting, which for 2017 was held Feb. 28-March 1 in Arlington, VA. The New England Council is serving as this year’s CCC chair and will be hosting the May 15-18 spring meeting at the Beauport Hotel on the Gloucester Harbor waterfront. The public is welcome to attend.

Principal agenda items will be discussed Tuesday, Wednesday, and Thursday, May 16-18, beginning at 8:30 a.m. each day. The eight Councils will take part in a Round Robin on Tuesday morning. Fishery Managers Voice Marine Monument Concerns to Trump

March 30, 2017 — PORTLAND, Maine — The leaders of eight regional councils that manage fisheries are reaching out to President Donald Trump to express concern over the creation of marine monuments, such as one in the ocean off of New England.

President Barack Obama created the Northeast Canyons and Seamounts Marine National Monument last year. It’s made up of nearly 5,000 square miles of habitat, and is very unpopular with many commercial fishermen.
