IAN URBINA: Out on the high seas, when news happens no one sees it

April 26, 2021 — About 100 miles off the coast of Thailand, three dozen Cambodian boys and men worked barefoot all day and into the night on the deck of a purse seiner fishing ship. Fifteen-foot swells climbed the sides of the vessel, clipping the crew below the knees. Ocean spray and fish innards made the floor skating-rink slippery.

Seesawing erratically from the rough seas and gale winds, the deck was an obstacle course of jagged tackle, spinning winches and tall stacks of 500-pound nets. Rain or shine, shifts ran 18 to 20 hours. At night, the crew cast their nets when the small silver fish they target — mostly jack mackerel and herring — were more reflective and easier to spot in darker waters.

This was a brutal place, one that I’ve spent the past several years exploring. Fishing boats on the South China Sea, especially in the Thai fleet, had for years been notorious for using so-called sea slaves, mostly migrants forced offshore by debt or duress.

Two-thirds of the planet is covered by water and much of that space is ungoverned. Human rights, labor and environmental crimes occur often and with impunity because the oceans are vast. What laws exist are difficult to enforce.

Arguably the most important factor, though, is that the global public is woefully unaware of what happens offshore. Reporting about and from this realm is rare. As a result, landlubbers have little idea of how reliant they are on the sea or the more than 50 million people who work out there.

Your seafood dinner could be tied to slavery on fishing vessels, says journalist

November 13, 2019 — Desperate to escape a life of slavery on a fishing ship in the South China Sea, Cambodian Lang Long took his chances — and jumped overboard.

He was trying to swim to a nearby vessel, but his attempt was short-lived, said investigative journalist Ian Urbina.

“They caught him, brought him back, and from then forward he was shackled by the neck when he was not working,” Urbina told The Current’s interim host Laura Lynch.

He added that after his escape attempt, Long was also routinely beaten.

Urbina interviewed Long for a 2015 New York Times investigation into human trafficking and slavery on fishing vessels, which he described as roach- and rat-infested and men and boys are worked 20 hours a day, six days a week.

His new book, The Outlaw Ocean: Journeys Across The Last Untamed Frontier, returns to the topic of human trafficking and slavery on the high seas, which Urbina said is driven in part by the economics of the fishing industry.

ILO Finds Progress in Fixing Thai Fishing Industry Abuses

March 7, 2018 — BANGKOK — A survey of working conditions in Thailand’s fishing and seafood industry conducted by the U.N.’s International Labor Organization has found that new regulations resulted in progress in some areas, including less physical violence, but problems such as unfair pay and deception in contracting persist.

The European Union in April 2015 gave Thailand a “yellow card” on its fishing exports, warning that it could face a total ban on EU sales if it didn’t reform the industry. Thailand’s military government responded by introducing new regulations and setting up a command center to fight illegal fishing.

The ILO report released Wednesday on “Ship to Shore Rights” recommends that the Thai government strengthen its legal framework, ensure effective enforcement, establish higher industry standards and enhance workers’ skills, knowledge and welfare.

“We want competitiveness in the global seafood trade to mean more than low prices and high quality,” Graeme Buckley, ILO country director for Thailand, Cambodia, and Laos, said at a news conference. “We want it to mean decent work for all the industry’s workers, from the boat to the retailer.”

A Pulitzer Prize-winning Associated Press investigation in 2015-16 that uncovered severe rights abuses affecting migrant workers in Thailand’s fishing and seafood industries helped turn an international spotlight on the problem. The AP’s stories contributed to the freeing of more than 2,000 men from Myanmar, Cambodia, Thailand and Laos, more than a dozen arrests, amended U.S. laws and lawsuits seeking redress.

The ILO said that changes in Thailand’s legal and regulatory framework had contributed to positive developments since the group’s last survey of workers in 2013.

Rights Abuses Still ‘Widespread’ In Thailand’s Fishing Industry, Report Says

January 23, 2018 — Forced labor, human trafficking and other rights abuses are “widespread” in the Thai fishing industry, according to a new Human Rights Watch report that provides an update on a sector that has been cited for enabling slavery conditions.

In recent years, reports have emerged that detail forced labor and confinement on ships that make up Thailand’s large fishing fleet, where migrants from Thailand’s neighbors, such as Myanmar and Cambodia, are often victimized. Past reports have found prison-like conditions; the new report details how workers are often paid below the minimum wage, are not paid on time, and are held in debt.

Despite scrutiny from U.S. and European monitors and the Thai government’s public promises to clamp down, the abuses remain a big part of Thailand’s fishing industry, according to the report.

“Under Thai law, migrant laborers are not entitled to Thai labor law protection. …

“The European Union has warned Thailand it could face a seafood export ban and the U.S. has placed Thailand on the Tier 2 Watch List in its latest trafficking in persons report.”

The 134-page report from Human Rights Watch is titled “Hidden Chains: Forced Labor and Rights Abuses in Thailand’s Fishing Industry. Compiled from interviews with 248 current and former fishers, it includes several quotes from workers.

“I didn’t know what was going on when I arrived,” trafficked Burmese worker Bang Rin said in March of 2016. “They just put me in a lockup, and it was only when the boat came in that I realized that was where I’d have to work. I went to do my pink card application on the 4th, and on the 5th I was out on the boat.”

The HRW says the research was conducted from 2015 to 2017, when its staff members visited all of Thailand’s major fishing ports.

Fish caught by slaves may be tainting your cat food

January 3, 2017 — Crack open a can of seafood-flavored cat food and whiff that fishy broth. Now try to guess where those gloopy bits of meat originate.

It’s a futile task. Oftentimes, no one knows quite how they got there, or who hauled those fish aboard which boat. Not even the multinational corporations who sell it on supermarket shelves.

Sure, pet food conglomerates can tell you which factories ground up the fish. They know who mixes in the additives, like tricalcium phosphate, and then dumps it into a can.

But the men who actually yanked it out of the sea? They’re usually anonymous, obscured by a murky supply chain.

That’s unfortunate. Because much of the pet food sold in the West is supplied by a Southeast Asian seafood industry, centered in Thailand, that is infamous for its use of forced labor.

For years, this industry has been scandalized by reports of human trafficking and even outright slavery. The victims are men from Myanmar and Cambodia, duped by human traffickers.

Here’s how the scam works. Traffickers promise desperate men a job on a factory or farm in Thailand — a relatively prosperous country compared to its poverty-stricken neighbors.

But there is no legit job. The victims are instead forced onto squalid trawlers. Once the boats leave port, they enter a lawless sea, and the men are forced to toil without pay — sometimes for years on end.

Thai Navy shows off technology to fight fishing abuses

December 9, 2016 — SAMUT SAKHON, Thailand — Thailand’s navy on Friday showed off new technology to monitor fishing boats in a renewed effort to crack down on illegal fishing, forced labor and corruption in the seafood industry.

New equipment the navy has been testing includes a GPS tracking system to monitor fishing vessels, a central database and a scanner for officials to check documents.

The system, demonstrated to reporters, won’t fully be in place until April, but outside groups are already skeptical it will achieve what it’s set out to do unless more human enforcement is put into place.

Thailand has been under pressure from the European Union after revelations that it relied heavily on forced labor, and is facing a potential total EU ban on seafood imports unless it reforms its fishing industry.

‘‘We’re doing this to increase the effectiveness of inspection, because putting humans in the loop has caused some errors in the past,’’ said Cdr. Piyanan Kaewmanee, head of a Thai navy group that oversees illegal fishing, who pointed to corrupt officials as a major issue. ‘‘We can ensure that our workers are accounted for, and aren’t lost at sea or transferred from ship to ship.’’

New on Friday was a handheld scanner that can read crew identification and other papers to make sure workers are documented and the fishing gear is licensed. During the inspection demonstration, workers crouched and huddled together, holding up green identification cards, as Thai navy sailors boarded their ship, looked through documents, and patted down workers.

The scanners will be integrated into a vessel monitoring system which will keep track of the location of all Thai fishing vessels using GPS technology and a central database.

Taiwan Seeks to Improve Conditions in Fishing Fleet

October 4th, 2016 — Commercial fishing boat owners in Taiwan, one of the world’s biggest seafood exporters, face strict rules and potential fines under a new law aimed at preventing overfishing and protecting migrant crewmembers who work far at sea with little oversight.

The Distant Water Fisheries Act, which takes effect Jan. 15, 2017, comes amid growing pressure on Taiwan’s seafood industry to crack down on modern-day slavery and other abuses for the more than 20,000 migrants working on the island’s fleet of fishing vessels.

Frances Lee, a spokeswoman for Taiwan’s Ministry of Foreign Affairs, said new requirements for the foreign fishermen will include insurance, health care, wages, working hours and human rights.

Last year the European Union gave Taiwan a “yellow card” warning for failing to control illegal fishing on its commercial vessels, which sail around the world to catch some $2 billion a year worth of exported tuna and other seafood every year. Without improvements, Taiwan’s $14 million worth of seafood exports to the EU could face sanctions.

The U.S. State Department’s 2016 Trafficking in Persons report says that while Taiwan has cracked down on forced labor and sex trafficking, fishing vessels need more attention. The report says fishermen mostly from Indonesia, Cambodia and Vietnam have been fraudulently recruited to work on Taiwan-flagged vessels where they can face abuses including violence, limited food supplies and withheld wages.

The issues extend well beyond Taiwan. Commercial fishing boat owners around the world, including the U.S., recruit foreign crews for the dangerous and exhausting work of hauling in the catch. The migrant fishermen are vulnerable to human trafficking and other exploitation because the work takes place so remotely, far from police or labor officials, and they can remain offshore for years as their catch is shuttled in to port.

Several nonprofit advocacy groups including Greenpeace and the International Labour Organization have repeatedly raised concerns about working conditions for foreign crew in Taiwan’s fishing fleet.

Allison Lee at the Yilan Fishermen’s Labor Union, which represents migrant workers in Taiwan, said men have been beaten, overworked and denied pay on board boats.

Hardships await fishermen lured to Indonesia

April 21, 2016 — “I would never recommend anyone to work at sea,” says a fisherman from Myanmar who lost four fingers in an accident while on a fishing trawler.

Despite a difficult life as a fisherman, Tunlin knew he had to be patient if he wanted to survive. “I couldn’t give up my life at sea,” said the 34-year-old who returned from Ambon Island in Indonesia last year.

Tunlin is among some 2,900 fishermen who have been rescued and repatriated by the Labour Rights Promotion Network Foundation (LPN). The operation, started in 2014, continues to help both Thais and migrants, mostly from Myanmar, Cambodia and Laos, stranded in Indonesia.

Recalling his life before Indonesia, Tunlin said he had worked at a shrimp-peeling shed from the age of 16 in Samut Sakhon province, home to a large Myanmar migrant community. But the meagre earnings –100 baht per day — hardly sufficed.

U.S. Closing a Loophole on Products Tied to Slaves

February 15, 2016 — WASHINGTON — President Obama will sign legislation this week that effectively bans American imports of fish caught by forced labor in Southeast Asia, part of a flurry of recent actions by the White House, federal agencies, international trade unions and foreign governments to address lawlessness at sea and to better protect offshore workers and the marine environment.

Last week, the president signed the Port State Measures Agreement, which empowers officials to prohibit foreign vessels suspected of illegal fishing from receiving port services and access. The United States became the 20th country to ratify the pact.

“Step by step, I do really think we’re making progress, and there is a growing awareness of how much we need to get more control over the world’s oceans and the range of crime that happens out there,” Secretary of State John Kerry said in an interview on Monday. He added that he hoped to build on the momentum in the fall during a global meeting, called Our Oceans, that he will host in Washington.

The amendment that the president has said he will sign this week would close a loophole in the Tariff Act of 1930, which bars products made by convict, forced or indentured labor. For 85 years, the law has exempted goods derived from slavery if American domestic production could not meet demand.

In July, The New York Times published an article about forced labor on Thai boats, many of which catch the fish destined for pet food. It chronicled the lives of several dozen indentured Cambodian migrants, most of them boys, working on the ships, all of whom are now free. Among them was a man named Lang Long, who was shackled by the neck during his three years of captivity at sea.

“I think most Americans were horrified to learn that the fish in the pet food they give to their cats and dogs was being caught by children forced to work on ships against their will,” said Senator Sherrod Brown, Democrat of Ohio, who, along with Senator Ron Wyden, Democrat of Oregon, sponsored the amendment, which has long been a goal of human rights advocates. The amendment focused on all types of forced and child labor, not just that used to produce seafood, and was passed by the Senate on Thursday with bipartisan support.

About 90 percent of seafood for human and pet consumption in the United States is imported, and the oceanic administration’s proposed rules are meant to protect threatened fish species and crack down on seafood entering American ports that has been caught illegally or is fraudulently labeled. The new rules would impose chain-of-custody reporting requirements for 13 species of at-risk fish, including cod, snapper, mahi mahi and several types of tuna.

The list includes types of fish that represent about 40 percent of the seafood that enters the United States, when measured by value. A spokesman for the oceanic agency said it hoped to include all imported seafood species, though no timetable has been set.

Nestle admits Thai seafood suppliers abuse workers, promises to pursue solutions aggressively

November 23, 2015 — WASHINGTON (AP) — Impoverished migrant workers in Thailand are sold or lured by false promises and forced to catch and process fish that ends up in global food giant Nestle SA’s supply chains.

The unusual disclosure comes from Geneva-based Nestle SA itself, which in an act of self-policing announced the conclusions of its yearlong internal investigation on Monday. The study found virtually all U.S. and European companies buying seafood from Thailand are exposed to the same risks of abuse in their supply chains.

Nestle SA, among the biggest food companies in the world, launched the investigation in December 2014, after reports from news outlets and nongovernmental organizations tied brutal and largely unregulated working conditions to their shrimp, prawns and Purina brand pet foods. Its findings echo those of The Associated Press in reports this year on slavery in the seafood industry that have resulted in the rescue of more than 2,000 fishermen.

The laborers come from Thailand’s much poorer neighbors Myanmar and Cambodia. Brokers illegally charge them fees to get jobs, trapping them into working on fishing vessels and at ports, mills and seafood farms in Thailand to pay back more money than they can ever earn.

“Sometimes, the net is too heavy and workers get pulled into the water and just disappear. When someone dies, he gets thrown into the water,” one Burmese worker told the nonprofit organization Verite commissioned by Nestle.
