Deeply Flawed Population Survey Fuels False Claims

April 5, 2018 — BUELLTON, Calif. — The following was released by the California Wetfish Producers Association:

This Sunday, April 8, the Pacific Fishery Management Council is meeting in Portland to debate the fate of the West Coast sardine fishery, after the 2018 sardine stock assessment estimated the biomass has declined by 97 percent since 2006. The only problem with that finding is it belies reality.

“Fishermen are seeing more sardines, not less, especially in nearshore waters. And they’ve been seeing this population spike for several years now,” said Diane Pleschner-Steele, executive director of the California Wetfish Producers Association (CWPA). “This stock assessment was an update that was not allowed to include any new methods and was based primarily on a single acoustic survey that reached only as far south as Morro Bay and totally missed the nearshore coastwide.”

The 2018 update assessment of 52,000 tons, down from 86,586 tons in 2017 and 106,100 tons the year before, is based on a change in methods and assumptions in estimating population size developed during an independent stock assessment review in 2017. Scientists acknowledged that assuming the acoustic survey ‘sees’ all the fish leads to lower biomass estimates. But it’s obvious to fishermen that the survey missed a lot of fish. In fact, with different assumptions, the 2017 biomass estimate would have increased from 86,586 tons to 153,020 tons.

The thorny problem the Council faces in April is what to do with a flawed assessment that is perilously close to the 50,000-ton minimum stock size threshold that would trigger an “overfished” condition and curtail virtually all sardine fishing. (The directed fishery has been closed since 2015, but incidental harvest in other fisheries, as well as Tribal take and live bait fishing have been allowed under a precautionary annual catch limit of 8,000 tons for all uses.) The extremist group Oceana has already signaled its intent to lobby for the Council to declare sardines “overfished.”

“Despite ample evidence to the contrary – most scientists agree that environmental factors play the primary role in sardine populations swings – Oceana claims that overfishing is the cause of the sardine fishery decline,” said Pleschner-Steele. “But the absolute opposite is true: fishing is a non-issue and more importantly, the sardine stock is not declining.”

The NOAA acoustic survey was based mainly on the 2017 summer acoustic trawl cruise that ran from British Columbia to Morro Bay, CA, but did not include the area south to Pt. Conception and Southern California where fishermen have reported large schools of sardines for the past three years. What’s more, this stock assessment update was based on a model that the chair of the 2017 Stock Assessment Review panel termed the “least worst” option. In part, the problem is that acoustic trawl surveys conducted by large research vessels cannot gather data in nearshore waters inside about 50 meters depth – 27 fathoms. But 70 to 80 percent of California’s sardine catch comes from nearshore waters inside the 20-fathom curve.

Acoustic trawl survey methods also underwent review in January 2018, and independent scientists criticized current survey methods and assumptions, noting that the current ATM trawl procedure seems to focus on precision at the expense of accuracy, and the protocol is repeatable but not necessarily objective.

To document the missing fish, the California Department of Fish and Wildlife and CWPA conducted a cooperative aerial survey in the Monterey / Half Moon Bay area last summer – at the same time the acoustic trawl cruise was surveying outside waters – and saw a significant body of both sardine and anchovy inside the acoustic survey nearshore limit.

Here is the map illustrating the thousands of tons of sardine that the NOAA acoustic survey missed, an estimated 18,118 mt of sardine and 67,684 mt of anchovy.And here is a video from fisherman Corbin Hanson who was out fishing for squid last November and saw large schools of sardines in Southern CA. He commented that, “…this is just one school. Last week we drove by the biggest school of sardines I have ever witnessed in my career driving boats. It was out in front of Ventura Harbor and we saw countless other schools along with it.”

The problem is this evidence has not yet been qualified for use in stock assessments. However, at the upcoming meeting, the Department of Fish and Wildlife will present the data from our nearshore aerial surveys in 2016-17. CWPA will also request that the Council approve our experimental fishery permit to help us qualify our aerial surveys as an index of nearshore abundance for future assessments.

“The bottom line is it’s vital for proper management of our fisheries that we use all available scientific data. That’s why the Council needs to take into consideration these nearshore findings when recommending sardine management measures in 2018,” said Pleschner-Steele. “CWPA along with sardine fishermen contest the 52,000-ton stock assessment and will request a new stock assessment review as soon as possible, including other indices of abundance in addition to acoustic trawl. If the Council closes the sardine fishery entirely, California’s historic wetfish industry – which until recent years produced 80 percent or more of the volume of seafood landed statewide – will suffer unnecessarily, along with the state’s entire fishing economy.”

As the sardine population keeps dropping, the feds come under scrutiny

March 29, 2018 — On April 8, the Pacific Fishery Management Council – a body of appointed officials that regulates fisheries off the West Coast – will be presented with the draft assessment of the sardine population from roughly southern California to Canada. The news it brings is neither good for fishermen nor the local marine ecosystem: The estimated number of sardines in July 2018 – which dictates policy for the 2018-19 fishing year – is 52,065 metric tons, an approximately 97-percent drop from 2006, the most recent peak.

The cutoff for when sardine fishing can occur is when the estimated population is at least 150,000 metric tons, which means the fishery will be closed for the fourth consecutive year.

What is in dispute: the accuracy of the population assessment, and how we got here. On one side, conservation nonprofit Oceana believes the assessment could be too high, and that sardines were pushed to this point due to overfishing when the numbers were low.

On the other side, advocates for fishermen believe there are far more sardines in the water than estimated, and that the estimates are not using the best available methods to make projections.

Currently, the method employed by scientists from the National Oceanic and Atmospheric Administration is to do months-long acoustic surveys off the coastline to measure sardine biomass.

Diane Pleschner-Steele, executive director of the California Wetfish Producers Association, believes that method is flawed and doesn’t accurately capture the sardines close to the shore – NOAA uses large boats that can’t come in too close.

Species battle pits protected sea lions against fragile fish

March 23, 2018 — The 700-pound sea lion blinked in the sun, sniffed the sea air and then lazily shifted to the edge of the truck bed and plopped onto the beach below.

Freed from the cage that carried him to the ocean, the massive marine mammal shuffled into the surf, looked left, looked right and then started swimming north as a collective groan went up from wildlife officials who watched from the shore.

After two days spent trapping and relocating the animal designated #U253, he was headed back to where he started — an Oregon river 130 miles (209 kilometers) from the Pacific Ocean that has become an all-you-can-eat fish buffet for hungry sea lions.

“I think he’s saying, ‘Ah, crap! I’ve got to swim all the way back?'” said Bryan Wright, an Oregon Department of Fish and Wildlife scientist.

It’s a frustrating dance between California sea lions and Oregon wildlife managers that’s become all too familiar in recent months. The state is trying to evict dozens of the federally protected animals from an inland river where they feast on salmon and steelhead that are listed under the Endangered Species Act.

The bizarre survival war has intensified recently as the sea lion population rebounds and fish populations decline in the Pacific Northwest.

The sea lions breed each summer off Southern California and northern Mexico, then the males cruise up the Pacific Coast to forage. Hunted for their thick fur, the mammals’ numbers dropped dramatically but have rebounded from 30,000 in the late 1960s to about 300,000 today due to the 1972 Marine Mammal Protection Act.

Sea lions keep eating the Northwest’s endangered fish

March 22, 2018 — NEWPORT, Ore. — Two species of fish listed as threatened under the Endangered Species Act are facing a growing challenge in Oregon from hungry sea lions.

The federally protected California sea lions are traveling into the Columbia River and its tributaries to snack on fragile fish populations.

After a decade killing the hungriest sea lions in one area, wildlife officials now want to do so at Willamette Falls, a waterfall in the Willamette River about 25 miles (40 kilometers) southeast of Portland.

The falls represent a new battleground in a bizarre survival war between fish and sea lions in the Pacific Northwest.

Halibut Catch Limits for Alaska Made Official Today

March 21, 2018 — SEAFOOD NEWS — Alaska’s halibut fishermen can be forgiven if they’re confused about catch limits for the season starting this Saturday, March 24.

The final numbers are published today in the Federal Register and they are lower than last year, but — in Alaska — exactly at the levels recommended by the U.S. Commissioners of the International Pacific Halibut Commission last January.

The commercial catch limits, by regulatory area, are as follows.

Area 2C (Southeast Alaska) — the commercial IFQ is 3.57 million pounds, down 15.2% from last year’s commercial quota of 4.21 mlbs.  The charter sector received810,000 lbs. this year, down 12% from last year’s charter allocation of 920,000 in Area 2C.

Area 3A (Gulf of Alaska) — the commercial quota is 7.35 mlbs, down 5% from last year’s commercial quota of 7.74 mlbs. For the 3A charter sector, the quota dropped 5% to 1.79 mlbs. from last year’s 1.89 mlbs.

Area 3B (Kodiak, Western Gulf) — 2.62 mlbs. compared to 3.14 mlbs. last year. A drop of 16.6%.

Area 4A (Bering Sea) — 1.37 mlbs. compared to 1.39 mlbs last year. Down 1.4 %.

Area 4B (Aleutian Islands) — 1.05 mlbs. compared to 1.14 mlbs. last year, a 7.9% decline.

Area 4CDE (Bering Sea) — 1.58 mlbs. compared to 1.7 mbls. last year, a drop of 7.1%.

Total Alaskan commercial quota this year (not including sports charters) of 17,540 mlbs. is a 10% drop from last year’s 19.32 mbls.

The catch limits for Washington, Oregon, and California are not yet finalized. Washington State has asked for a readjustment of the .69 mlbs. recommended by the U.S. Commissioners in January to a higher number. The final catch limit is expected to be published on Monday March 26, but effective on the season opening date of March 24. Regulatory Area 2A, which encompasses waters off those three states, won’t open until later in the year.

The Alaska catch limits reflect the recommendations made by the U.S. Commissioners but those recommendations were not reflected in the initial NMFS Rule of March 9 or in the IPHC’s Rule Book that was mailed out to stakeholders last week.

Earlier versions of the catch limits also referred to catch share plan totals, which included sport catch, and some version reported Total Constant Exploitation Yield, which included wastage, bycatch, and subsistence removals.

Pacific Fishery Management Council Chooses Options 2018 Salmon Season

March 19, 2018 — The following was released by the Pacific Fishery Management Council:

ROHNERT PARK, Calif. – The Pacific Fishery Management Council has adopted for public review three alternatives for the 2018 salmon seasons off the West Coast of the United States. The Council will select a final alternative at their next meeting in Portland, Oregon April 6-11. Detailed information about season starting dates, areas open, and catch limits for all three alternatives are available on the Council’s website at www.pcouncil.org.

Fisheries north of Cape Falcon (in northern Oregon) are limited by the need to reduce catch of lower Columbia natural tule Chinook and coho stocks of concern. Additionally, three stocks of coho (Queets River, Strait of Juan de Fuca, and Snohomish) currently meet the criteria for overfished status, which is also a concern when structuring 2018 fisheries. The Council also provided guidance to structure ocean fisheries so that the ocean escapement of Columbia River upriver bright fall Chinook is at least 200,000 fish, which will allow more access to that healthy stock in Columbia River treaty Indian and non-Indian fisheries.

Fisheries south of Cape Falcon are limited by the need to reduce catch of Oregon Coast natural coho, Klamath River fall Chinook, Sacramento River fall Chinook, and Rouge/Klamath coho.  Klamath River fall Chinook and Sacramento River fall Chinook contribute significantly to ocean harvest, but both met the criteria for overfished status as a result of poor returns over the past three years.  However, the forecast for Klamath River fall Chinook is substantially improved over last year, and both stocks are projected to meet their spawning escapement objectives under this year’s management alternatives.

“Although some abundance forecasts are improved over last year, the 2018 salmon runs still present a challenge for ocean fishermen and managers throughout the west coast,” said Executive Director Chuck Tracy. “In the north, low returns of some Puget Sound and Washington coastal coho runs and lower Columbia River natural tule fall Chinook will constrain fisheries. In the south, the conservation needs of Sacramento River fall Chinook and Rogue/Klamath coho will constrain fisheries.”

“Once again, the Council adopted a range of management alternatives for public review designed to conserve and rebuild a broad range of Chinook and coho stocks of concern. Commercial and recreational fisheries will face restrictions in areas along the entire west coast in response to the Council’s conservation efforts” said Council Chair Phil Anderson.

Northern Oregon and Washington (north of Cape Falcon)

Sport season alternatives

Ocean sport fishery alternatives north of Cape Falcon in Oregon and off the Washington coast include Chinook recreational quotas ranging from 22,500 to 32,500, a decrease from 2017. For coho, recreational quotas range from 16,800 to 42,000 hatchery coho, compared to 42,000 in 2017.  Starting dates range from June 23 to July 1, and in all alternatives, recreational fisheries are scheduled to run through early September. Both coho and Chinook retention are allowed in all alternatives.

Commercial season alternatives

Non-Indian ocean commercial fishery alternatives north of Cape Falcon include traditional Chinook seasons between May and September. Chinook quotas for all areas and times range from 22,500 to 32,500, compared to 45,000 in 2017. Coho quotas in the commercial fishery alternatives range from 3,200 to 5,600 marked coho, similar to 2017.

Lawsuit aimed at protecting humpback whales filed against Trump administration

March 16, 2018 — Several conservation groups have joined together to file a lawsuit that claims the Trump administration has failed to protect humpback whales from fishing gear, ship strikes and oil spills.

The Center for Biological Diversity, Turtle Island Restoration Network and Wishtoyo Foundation announced Thursday they have sued the Trump Administration for “failing to protect humpback whale habitat in the Pacific Ocean.” The lawsuit was filed in the federal district court in San Francisco.

The nonprofit groups hope the lawsuit will force the National Marine Fisheries Service to follow the Endangered Species Act’s requirement to designate critical habitat within one year of listing a species as threatened or endangered, and not authorize actions that would damage that habitat, according to a release.

Two Pacific Ocean humpback populations were listed as endangered and a third as threatened in September 2016.

“The federal government needs to protect critical humpback habitat that’s prone to oil spills and dangerously dense with fishing gear and ship traffic,” Catherine Kilduff, an attorney with the Center for Biological Diversity. “These whales need urgent action, not more delays.”

New Sustainable Shark Trade Bill is Supported by Both Conservationists and Fishing Industry

March 15, 2018 — The following was released by the Wildlife Conservation Society:

WCS (Wildlife Conservation Society) supports a new bipartisan bill introduced in the U.S. Congress that encourages a science-based approach to fisheries conservation and management to significantly reduce the overfishing and unsustainable trade of sharks, rays, and skates around the world and prevent shark finning.

H.R. 5248, the Sustainable Shark Fisheries and Trade Act, was introduced in the U.S. House of Representatives by Rep. Daniel Webster (R-FL) and Rep. Ted Lieu (D-CA), along with co-sponsors Rep. Bill Posey (R-FL), Rep. William Lacy Clay (D-MO), and Rep. Walter Jones (R-NC).

The Sustainable Shark Fisheries and Trade Act would require that imports of shark, ray, and skate parts and products to the U.S. be permitted only from countries certified by National Oceanic and Atmospheric Administration (NOAA) as having in place and enforcing management and conservation policies for these species comparable to the U.S., including science-based measures to prevent overfishing and provide for recovery of stocks, and a similar prohibition on shark finning.

By requiring that imports of shark, skate, and ray parts and products be subject to the same standards that U.S. domestic fishers already meet, the legislation aims to level the playing field for U.S. producers and use access to the U.S. market as leverage to encourage other countries to adopt and implement strong conservation and management measures that support sustainable fisheries and trade in shark and ray products.

WCS, along with its partners in the conservation community and allies in the fishing industry, have launched a campaign to support the Sustainable Shark Fisheries and Trade Act in order to conserve sharks, rays and skates. The coalition includes more than 40 partner organizations and aligns with the Association of Zoos and Aquariums’ Saving Animals From Extinction (SAFE) initiative, which leverages the reach, expertise and resources of accredited zoos and aquariums to save species in the wild.

Rep. Daniel Webster (R-FL) said, “Fishing is a long-standing profession and treasured American pastime, and particularly important in Florida. Our responsibility to is balance the needs of the industry with conservation. This bill recognizes the sacrifices American fishermen have made to rebuild and sustain our shark populations. It encourages other nations wishing to export shark products to the United States to the same high standards for shark, skate, and ray conservation and management we apply to fishermen here.”

Rep. Ted Lieu (D-CA) said, “U.S. shark fisheries are governed by some of the strongest science-based conservation regulations in the world. Accordingly, we should be leading the charge to counsel other nations in proper shark management. Preventing exploitation in global fisheries helps safeguard our ocean’s delicate ecosystem and can help promote the humane treatment of shark populations. I’m proud to introduce this bill with Rep. Webster because the U.S. should be leading the charge in environmental conservation efforts. We have a responsibility to disincentivize the trade of unsustainably or illegally harvested shark fins and other shark products.”

John Calvelli, WCS Executive Vice President of Public Affairs, said: “We must take action now to prevent the global overfishing of sharks and rays that is decimating populations of these prehistoric and iconic animals. This bill is a bipartisan solution that both conservationists and the fishing industry can agree upon. The incentives laid out by the legislation can create a ripple effect that can make all the world’s oceans a better home for sharks, rays and skates.”

Luke Warwick, Associate Director of WCS’s Sharks and Rays Program, said: “Sharks play an essential part in the health of our oceans, and they need our help. Research has clearly shown that effective fisheries management can reverse the global declines see in shark and ray populations, but that outside of a limited number of countries including the US, such management is lacking. This law would incentivize countries to better manage their shark and ray fisheries, which when coupled with our work globally to support those Governments understand their shark fisheries, and develop strong conservation and management measures, can help safe these inherently vulnerable animals.”

Bob Jones, executive director of the Southeastern Fisheries Association in Tallahassee, Florida, said, “We’d like to thank Congressmen Webster and Lieu for introducing the Sustainable Shark Fisheries and Trade Act, which represents a better way forward for shark conservation. This legislation goes a long way toward combatting the threats facing global shark stocks by promoting the successful model of American shark management.”

There are more than 1,250 species of cartilaginous fish—sharks and their relatives, which include skates and rays. Of these, as many as one-quarter are estimated to be threatened with extinction, and the conservation status of nearly half is poorly known. These fishes play important ecological roles in the marine and freshwater habitats in which they occur, and many species are culturally and economically important. These fishes are particularly vulnerable to over-exploitation—they grow slowly, mature late, and produce few young. Overfishing is the primary threat to sharks and their relatives, which are caught to supply demand for fins, meat, oil, cartilage, and other products.

Across the world, most shark, ray, and skate fisheries are subject to very little management; shark and ray populations are widely overfished and fisheries are often not regulated or monitored so that the impacts of fishing pressure are unknown or unchecked. In the U.S., however, current fisheries law, including the Magnuson-Stevens Act, provides a strong framework for improving shark and ray conservation worldwide, such as requirements for science-based limits on fisheries to prevent overfishing and rebuild overfished stocks. For example, a recent analysis of global shark catches identified several U.S. shark fisheries as meeting that study’s criteria for biological sustainability and science-based management – but globally most shark and ray fisheries lack the management needed to guarantee sustainability.

The U.S. is a significant shark fishing and trading country, primarily through exports, and U.S. leadership on sustainable trade standard is important to promoting sustainable shark fisheries globally. This bill, if it becomes law, would continue to give the U.S. a strong position from which to advocate for adoption of similar policies in other countries. As part of its field conservation work, WCS is working with governments, the fisheries sector, and environment agencies to document shark fisheries, investigate the status of shark and ray populations, and develop and implement conservation and management measures for these species.

Based on official statistics, which are widely believed to under-report actual levels, global trade in shark and ray parts and products is approaching $1 billion in value. In 2011, total global trade in shark and ray parts and products was valued at $438.6 million in fins and $379.8 million in meat. These figures do not include domestic use of shark and ray products, which drives much of the global consumption for the 800,000metric tons of sharks and rays that are reported to be landed annually by global fisheries. The value of the shark tourism industry is also estimated to be around $314 million annually. Major shark fishing countries beyond the U.S. include Indonesia, India, Spain, Taiwan ROC, Mexico, and Pakistan. The U.S. also imports shark, skate and ray parts and products from a variety of countries, including New Zealand, Canada, China including Hong Kong, and Mexico.

Market demand for shark – and in some instances ray – fins, meat and other products drives large scale international trade – with fins highly valued in parts of Asia, and meat in Europe, Republic of Korea, Latin America, and the U.S. Some of the most valuable “shark” fins in the global fin market are actually from other cartilaginous fishes, such as sawfishes and guitarfishes – two of the seven most threatened families of sharks and rays and among the most endangered of the world’s marine fishes.

Overfishing through targeted fisheries and incidental catches in fisheries targeting other species such as tunas are by far the biggest threat to sharks and rays worldwide. Although some species are so threatened that they cannot be sustainably fished, others can support sustainable fisheries if subject to adequate management.

WCS works to conserve sharks, rays and skates and their relatives through its Global Marine program, WCS country programs, and participation in the Global Sharks and Rays Initiative (GSRI), a global partnership implementing a ten-year global strategy to conserve the chondrichthyan fishes. WCS’s New York Seascape program is centered at its New York Aquarium, which provides a unique opportunity to build a constituency for shark and ray conservation in the United States. The WCS New York Aquarium is currently constructing a major new exhibit, Ocean Wonders: Sharks! which will connect visitors to the marine life and habitats vital to healthy waterways in and around New York City. The WCS New York Aquarium aims to become the hub for marine conservation on the East Coast and continue to build support for marine conservation both locally and globally.

Alaska: Halibut fishery poised to open as NMFS works on 2018 catch limits

March 15, 2018 — Alaska’s halibut fishery is set to open this month, but the final quota was still not completely set as of March 14, even as fishermen began to receive permits in the mail.

Indications, however, are that the quota will decrease this year compared to last.

Under regulations published by the National Marine Fisheries Service this month, the fishery will open March 24 and run through Nov. 7. But the total catch limits remain unknown.

That’s because this year, for just the second time in the commission’s history that dates to its creation by a 1923 treaty, the International Pacific Halibut Commission could not come to an agreement about the 2018 catch limits at its annual meeting. That leaves it up to regulatory bodies in each country to determine the limits instead.

Halibut Coalition Executive Director Tom Gemmell said he expects the quota to decrease by about 15 percent overall compared to 2017, when Alaskan fishermen had their total statewide quota set at about 22.62 million pounds. In 2017, and for a few years prior, the quota had increased slightly after nearly a decade of annual cuts totaling more than 70 percent from mid-2000 highs.

The halibut commission is the six-member body (three each from the U.S. and Canada) charged with regulating the halibut fishery from Northern California to the Bering Sea under the international Pacific halibut treaty, including setting the catch limit each year. The IPHC meets each January and decides on the coastwide halibut catch limits, based on input from staff scientists. But this past January, at its annual meeting in Portland, the commission was not able to come to an agreement on the 2018 limits.

West Coast Waters Returning to Normal; Some Fisheries Remain Disrupted

March 13, 2018 — SEAFOOD NEWS — Ocean conditions off most of the U.S. West Coast are returning roughly to average, after an extreme marine heat wave from about 2014 to 2016 disrupted the California Current Ecosystem and shifted many species beyond their traditional range, according to a new report from NOAA Fisheries’ two marine laboratories on the West Coast. Some warm waters remain off the Pacific Northwest, however.

The Southwest Fisheries Science Center and Northwest Fisheries Science Center presented their annual “California Current Ecosystem Status Report” to the Pacific Fishery Management Council at the Council’s meeting in Rohnert Park, Calif., on Friday, March 9. The California Current encompasses the entire West Coast marine ecosystem, and the report informs the Council about conditions and trends in the ecosystem that may affect marine species and fishing in the coming year.

“The report gives us an important glimpse at what the science is saying about the species and resources that we manage and rely on in terms of our West Coast economy,” Council Chairman Phil Anderson, of Westport, Wash., said in a press release. “The point is that we want to be as informed as we can be when we make decisions that affect those species, and this report helps us do that.”

Unusually warm ocean temperatures, referred to as “the Blob,” encompassed much of the West Coast beginning about 2014, combining with an especially strong El Nino pattern in 2015. The warm conditions have now waned, although some after-effects remain.

Warmer waters were blamed for increased growth of Pseudo nitzschia, which produces domoic acid. The domoic acid interrupted several fisheries, including Dungeness crab, rock crab and spiny lobster.
