NOAA Fisheries Designates Critical Habitat for Atlantic Sturgeon

August 16, 2017 — The following was released by NOAA Fisheries:

NOAA Fisheries today designated critical habitat for Atlantic sturgeon–an important step to ensuring their recovery.

The critical habitat designation will require federal agencies to consult NOAA Fisheries if they operate or fund activities that may affect designated critical habitat in more than 3,968 miles of important coastal river habitat from Maine to Florida. Atlantic sturgeon was listed under the Endangered Species Act in 2012 and is comprised of the threatened Gulf of Maine distinct population segment and the endangered New York Bight, Chesapeake Bay, Carolina, and South Atlantic distinct population segments.

The ESA requires that NOAA Fisheries designate critical habitat when a species is listed as threatened or endangered. Under the ESA, critical habitat is defined as specific areas within the geographical areas that are occupied by the species, that contain physical or biological features essential to the conservation of that species, and that may require special management considerations.

The designation of critical habitat does not include any new restrictions or management measures for recreational or commercial fishing operations, nor does it create any preserves or refuges. Instead, when a federal agency funds, authorizes, or carries out activities that may affect critical habitat, it must work with NOAA Fisheries to avoid or minimize potential impacts to critical habitat. The activity of the federal agency may need to be modified to avoid destroying or adversely modifying the critical habitat.

“We look forward to working with our federal partners to reduce potential impacts to Atlantic sturgeon critical habitat,” said Samuel D. Rauch III, deputy assistant administrator for regulatory programs at NOAA Fisheries. “Our focus now will be on providing guidance to federal agencies to help them carry out their actions efficiently and effectively while minimizing impacts to habitat that is critical to these endangered and threatened populations of sturgeon.”

Atlantic sturgeon are anadromous and use coastal and estuarine waters throughout their lives, and travel to rivers to spawn or lay their eggs. Unlike some anadromous fish, sturgeon do not die after spawning and will return to spawn multiple times. They can grow up to 14 feet long, weigh up to 800 pounds, and live up to 60 years.

Historically, Atlantic sturgeon inhabited approximately 38 rivers in the United States spanning from Maine to Florida. Scientists identified 35 of those as spawning rivers. Atlantic sturgeon can now be found in approximately 32 of these rivers, and spawn in at least 20 of them. Critical habitat areas in coastal rivers were identified based on physical and biological features, such as soil type in the river bed, water temperature and salinity, and underwater vegetation, that are essential to the conservation of Atlantic sturgeon, particularly for spawning and development.

Atlantic sturgeon were harvested heavily in the twentieth century, particularly for their eggs (or roe) used for caviar. Overfishing led to a decline in abundance of Atlantic sturgeon, and in 1998 the Atlantic States Marine Fisheries Commission issued a coast-wide moratorium on the harvest of Atlantic sturgeon, and NOAA Fisheries followed with a similar moratorium in federal waters.

Request for Comments: Application for Incidental Take of Atlantic Sturgeon in the James River, Virginia.

August 15, 2017 — The following was released by NOAA Fisheries:

We recently received an application from Dominion for an Endangered Species Act Section 10(a)(1)(B) Incidental Take Permit for activities associated with their Chesterfield Power Station along the James River in Chesterfield, Virginia.

We are considering issuing a 10-year permit to the applicant that would authorize take of endangered Atlantic sturgeon (Acipenser oxyrinchus oxyrinchus) from the Chesapeake Bay Distinct Population Segment (DPS) incidental to the withdrawal of cooling water from the James River and sampling required by the Clean Water Act.

Dominion’s application for an Incidental Take Permit, their draft habitat conservation plan, and our draft environmental assessment are all available at Regulations.gov for public review and comment.

Comments are due on September 13, 2017.

House Committee Approves Harris Chesapeake Bay Amendment

July 17, 2017 — The following was released by the office of Representative Andy Harris (R-MD)

On July 13, the House Appropriations Committee adopted an amendment introduced by Congressman Andy Harris (MD-01) to the Commerce, Justice, Science, and Related Agencies Appropriations bill for Fiscal Year 2018. This amendment prohibits the use of funds to implement or enforce the designation of any area of the Chesapeake Bay watershed as a “Critical Habitat” for the Atlantic Sturgeon. Congressman Harris issued the following statement praising the amendment’s passage:

“The Appropriations Committee’s adoption of this amendment is a victory for both the conservation of the Bay and the Eastern Shore’s economy. The National Oceanic and Atmospheric Administration’s (NOAA) proposal to designate the Chesapeake Bay as a Critical Habitat for the Atlantic Sturgeon was crafted without adequate opportunity for input from the communities surrounding the Chesapeake Bay. Furthermore, NOAA has failed to document sufficient cause for the designation.

Designation of the Bay as a Critical Habitat for the Sturgeon is an unnecessary and burdensome regulation that could lead to restricted use of various regions of the Bay, stifling commercial activity in the Bay and inhibiting oyster restoration and other important conservation activities.”

Rep. Andy Harris amendment aims to stop Chesapeake sturgeon effort

July 17, 2017 — An amendment from Congressman Andy Harris (R-Md.-1st) to an appropriations bill would prohibit funds to implement a “Critical Habitat” designation for Atlantic Sturgeon anywhere in the Chesapeake Bay watershed.

On Thursday, the House Appropriations Committee adopted Harris’ amendment to the Commerce, Justice, Science, and Related Agencies Appropriations bill for fiscal year 2018, according to a statement from Harris’ office.

Harris said a proposal from the National Oceanic and Atmospheric Administration to designate the Chesapeake Bay as a Critical Habitat for the Atlantic Sturgeon was created without adequate opportunity for input from the communities surrounding the bay, and that NOAA has not documented sufficient cause for the designation.

Biologists alarmed over lack of young Atlantic sturgeon in surveys

August 16, 2016 — Biologists have been surprised in recent years about how many big Atlantic sturgeon they are finding around the Chesapeake Bay. But rather than celebrating, they have become increasingly alarmed about what they are not seeing: a new generation of young sturgeon.

While finding more adults is certainly good news, biologists say they have seen little evidence those sturgeon have successfully produced significant numbers of offspring in recent years that would be critical if the endangered species is to make a comeback in the Chesapeake.

“To get any kind of recovery, the best thing you can do is to increase that first year of survival,” said Dave Secor, a fisheries biologist with the University of Maryland Center for Environmental Science. If young fish survive, he said, “you can actually realize very rapid recovery, even for a species like sturgeon.”

That’s something that biologists working with sturgeon around the Bay say they haven’t seen, perhaps for a decade or more. Many blame the absence of young sturgeon on a rampant population of introduced blue catfish, which they say could be consuming eggs and newly hatched fry, or outcompeting them for habitat.

But researchers who study the catfish dispute that, and even sturgeon specialists acknowledge they lack concrete evidence.

Endangered Atlantic sturgeon find a new nursery in the Connecticut River

July 20, 2016 — OLD LYME, Conn. — Though facing extinction after 70 million years of existence, Atlantic sturgeon apparently aren’t done looking for new ways to adapt and survive.

“They’re really amazing fish,” Isaac Wirgin, associate professor in the Department of Environmental Medicine at New York University’s School of Medicine, said Monday. “This was really an unexpected result.”

The result he was referring to was the outcome of genetic tests he completed last fall on tissue samples from some 6-inch, 1-year-old Atlantic sturgeon caught in the lower Connecticut River in 2014.

Tom Savoy, a fisheries biologist with the state Department of Energy and Environmental Protection who’s been researching Atlantic sturgeon in Long Island Sound for more than 20 years, caught the small fish while sampling with nets in the river for a related species — the short-nosed sturgeon — and knew right away he’d found something unique.

Based on their size, they had to have been born in the river.

“Prior to that, we assumed the breeding population had been extirpated in Connecticut,” said Savoy, who works out of DEEP’s Marine Headquarters on Ferry Road.

“But the great news is, evidently they are spawning in the Connecticut River,” he said. “Now, because they’re a federally protected species, the state is obligated to learn more. We need to know where they are, and how many there are.”

The ancient species, which supplied the caviar that became one of the first exports from the colonies, was declared a federally endangered species in 2012.

Living up to 70 years and growing up to 400 pounds, adult Atlantic sturgeon were popular fish for Native Americans and the European settlers who came after them.

“By the 1800s, about 75 percent of the stocks on the East Coast were wiped out,” Savoy said.

Since receiving endangered species status, more researchers have been looking for — and finding — Atlantic sturgeon in rivers and estuaries along the Atlantic coast, with the Hudson River population standing out as the most robust, Wirgin said.

MARYLAND: More sturgeon turn up in Bay, raising new questions – and worry

July 13, 2016 — For years, scientists thought there might not be any native Atlantic sturgeon in the Chesapeake Bay. That idea changed in recent years, as biologists began netting hundreds of adults in the James River, and others began turning up in other tributaries.

Now, genetic analyses show the Chesapeake is home to at least two — and possibly more — distinct populations of the endangered fish.

DNA analysis shows that James River sturgeon and those recently found spawning next door in the Pamunkey River, a tributary of the York River, are not even particularly closely related, despite their geographic proximity.

The 138 Pamunkey fish sampled seem more closely related to what could be a third population farther up, and across, the Bay in the Nanticoke River where 15 adult fish have been caught — and released — the last two years.

It’s too early to say whether the sturgeon netted in the Nanticoke and its tributaries constitute a unique population, said Tim King, a fisheries biologist with the U.S. Geological Survey who did the genetic analysis. King said he would like at least 25–30 samples before offering a more concrete opinion about the Nanticoke sturgeon.

“It is way too early to draw any conclusions,” King said. “But it would seem that they are not James fish. They are genetically more similar to the Pamunkey fish than they are the James, but I am not willing to say that they are Pamunkey fish.”

MAINE: Feds Propose to Protect Atlantic Sturgeon Habitat in Maine

June 3, 2016 — PORTLAND, Maine – Federal fishing regulators are proposing to designate the waters of several Maine rivers as critical habitat for Atlantic sturgeon.  The designation is also proposed for other Atlantic coast waterways further south.

The anadromous fish, which mature in estuaries and marine waters but return to rivers to spawn, are listed as a threatened species in the Gulf of Maine, and as endangered in other areas.

The National Oceanic and Atmospheric Administration is proposing to protect the Atlantic sturgeon’s river habitat in Maine, including parts of the Penobscot, Androscoggin, Kennebec, and Piscataqua rivers.

“Sturgeon need this habitat to recover,” says NOAA Fisheries assistant administrator Eileen Sobeck, in a press release, “and these designations give us an important additional conservation tool.”

New York DEC Reports Recovery Signs for Atlantic Sturgeon

February 29, 2016 — A joint Federal and State 2015 Juvenile Atlantic Sturgeon Survey shows the highest number of Atlantic sturgeon in the Hudson River in the 10-year history of the survey and the trend of the results show an increasing juvenile sturgeon abundance (see chart below), New York State Department of Environmental Conservation (DEC) Acting Commissioner Basil Seggos has announced.

“Juvenile Atlantic sturgeon are at the highest level recorded in the Hudson River in the last 10 years. These survey results are an encouraging sign for the recovery of Atlantic sturgeon,” Acting Commissioner Seggos said. “We are cautiously optimistic that, with our continued vigilance and efforts to protect this species, Atlantic sturgeon will have a secure future.”

Commercial fishing rates for Atlantic sturgeon exceeded the ability of the fish to replenish themselves in the late 1980s and early 1990s. New York led the way in conservation through implementation of a harvest moratorium for Atlantic sturgeon in 1996. In 1998, an amendment of the Atlantic States Marine Fisheries Commission (ASMFC) Fishery Management Plan for Atlantic sturgeon resulted in a coast wide moratorium on Atlantic sturgeon harvest for 40 years and aimed to protect two generations of females in each spawning stock.

After a Century, Shortnose Sturgeon Return to Historic Habitat

November 17, 2015 — The following was released by NOAA Fisheries:

ORONO, Maine – Endangered shortnose sturgeon have rediscovered habitat in the Penobscot River that had been inaccessible to the species for more than 100 years prior to the removal of the Veazie Dam in 2013. University of Maine researchers confirmed evidence that three female shortnose sturgeon were in the area between Veazie (upriver of the dam remnants) and Orono (Basin Mills Rips), Maine in mid-October. Researchers had previously implanted these sturgeon with small sound-emitting devices known as acoustic tags to see if they would use the newly accessible parts of the river.

Among the most primitive fish to inhabit the Penobscot, sturgeon are often called “living fossils” because they remain very similar to their earliest fossil forms. Their long lives (more than 50 years) and bony-plated bodies also make them unique. Historically, shortnose sturgeon and Atlantic sturgeon (a related species also present in the watershed) had spawning populations in the Penobscot River as far upstream as the site of the current Milford dam, and provided an important food and trade source to native peoples and early European settlers. Overharvest and loss of suitable habitat due to dams and pollution led to declines in shortnose sturgeon populations and a listing as endangered under the U.S. Endangered Species Act (ESA) in 1967. In 2012, Gulf of Maine populations of Atlantic sturgeon were listed as threatened under the ESA.  

Today, a network of sound receivers, which sit on the river bottom along the lower river from Penobscot Bay up to the Milford Dam, detect movement and location of tagged fish. According to Gayle Zydlewski, an associate professor in the University of Maine School of Marine Sciences, the three individual fish observed were females. These fish have since been tracked joining other individuals in an area identified as wintering habitat near Brewer, Maine. Wintering habitat in other rivers is known to be staging habitat for spawning the following spring.

“We know that shortnose sturgeon use the Penobscot River throughout the year, and habitat models indicate suitable habitat for spawning in the area of recent detection upriver of Veazie, although actual spawning has not yet been observed,” Zydlewski said.

Since 2006, Zydlewski has been working with Michael Kinnison, a professor in UMaine’s School of Biology and Ecology, and multiple graduate students, including Catherine Johnston, to better understand the sturgeon populations of the Penobscot River and Gulf of Maine. Johnston, who has been tagging and tracking sturgeon in the Penobscot for two years to study the implications of newly available habitat to shortnose sturgeon, discovered the detections of sturgeon upstream of the Veazie dam remnants. Each new bit of information adds to the current understanding of behavior and habitat preferences of these incredible fish. 

“We’re very excited to see sturgeon moving upstream of where the Veazie Dam once stood, and into their former habitats,” said Kim Damon-Randall, assistant regional administrator of the National Oceanic and Atmospheric Administration (NOAA) Fisheries’ Protected Resources Division. “We need to do more research to see how they’re using it, but it’s a tremendous step in the right direction.”

Habitat access is essential for the recovery of these species. The removal of the Veazie Dam is only a portion of the Penobscot River Restoration Project, which, when combined with the removal of Great Works Dam in 2012, restores 100 percent of historic sturgeon habitat in the Penobscot. In addition to dam removals, construction of a nature-like fish bypass at the Howland Dam in 2015 significantly improves habitat access for the remaining nine species of sea-run fish native to the Penobscot, including Atlantic salmon and river herring.   

“Scientific research and monitoring of this monumental restoration effort has been ongoing for the past decade,” said Molly Payne Wynne, Monitoring Coordinator for the Penobscot River Restoration Trust. “The collaborative body of research on this project is among the most comprehensive when compared to other river restoration projects across the country,” Wynne said.

NOAA Fisheries is an active partner and provides funding for this long-term monitoring collaboration that includes The Penobscot River Restoration Trust, The Nature Conservancy and others. These efforts are beginning to shed light on the response of the river to the restoration project. Restoration of the full assemblage of sea-run fish to the Penobscot River will revive not only native fisheries but social, cultural and economic traditions of Maine’s largest river.
