Atlantic Menhaden FAQ and Stock Assessment Overview

There’s been a lot of stakeholder discussion on the outcome of the October 28, 2025 meeting of the Commission’s Atlantic Menhaden Management Board. Some of the information being shared reflects a misunderstanding of the findings of the single-species assessment update and Ecological Reference Point Benchmark Stock Assessment, as well as the Board’s response to the assessments’ findings.

The Commission developed an FAQ and an Overview of the Atlantic Menhaden Stock Assessment Update and ERP Benchmark Stock Assessment to help explain how the Commission coordinates Atlantic menhaden management and the science behind recent Management Board decisions. We hope you find these helpful.

Delaware to host Atlantic States Marine Fisheries Commission meeting this year

October 22, 2025 — The Atlantic States Marine Fisheries Commission’s 83rd Annual Meeting will be hosted by Delaware for the first time since 2008 starting Oct. 27 to Oct. 30. at the Hyatt Place Dewey Beach, on Coastal Highway.

DNREC encourages anglers, commercial fishers and conservationists to attend the meeting either in-person or virtually to provide input specifically for striped bass, menhaden and horseshoe crabs. Proposed changes will be voted on by ASMFC commissioners.

The Horseshoe Crab Management Board meeting is on Oct. 28 from 8:30 – 10 a.m., followed by the Atlantic Menhaden Management Board meeting, starting at 1:30 p.m. The Atlantic Striped Bass Management Board meeting will take place on Oct. 29 from 9:45 a.m.-noon and resuming from 1:30-5 p.m.

Meeting Process
Board chairs will ask both in-person and virtual board members if they wish to speak. In-person members can simply raise their hands at the meeting without logging on to the webinar, while virtual members will raise their hands on the webinar. The chair will work with staff to compile the list of speakers, balancing the flow of questions/comments between in-person and virtual attendees. The same process will be used for public comment. Depending upon the number of commenters, the board chair will decide how to allocate the available time on the agenda (typically 10 minutes) to the number of people who want to speak.

ASMFC could reallocate menhaden quota, industry pushes for equity

February 3, 2021 — The Atlantic States Marine Fisheries Commission (ASMFC) will likely look into how the U.S. Atlantic menhaden fishery allocates its quota in 2021.

The commission is considering reallocating the menhaden fishery this year based on Amendment 3. Implemented in 2018, the rule requires the Atlantic Menhaden Management Board to revisit its quota allocations every three years. A letter written by the MFC, which represents some of the largest players in the menhaden fishing industry, is asking the commission to take into account historic catch levels in its deliberations.

Menhaden board lowers allowable catch by 10% for Atlantic coast states, Chesapeake Bay’s cap stays the same

October 20, 2020 — The Atlantic Menhaden Management Board voted to lower the total allowable catch for Atlantic menhaden coast-wide by 10% in response to a change in management that considers the role the tiny oily fish plays as food for others.

After a few hours of discussion Tuesday morning, the board voted at its online meeting to lower the allowable catch to 194,400 metric tons for 2021 and 2022. No change was made to the allocation of menhaden that can be caught in the Chesapeake Bay, which is capped at 51,000 metrics tons. Maryland was among the states voting in favor of the change.

The total allowable catch was last changed in 2017, when the board increased it from 200,000 metric tons to 216,000 metric tons.

Earlier this year, the Atlantic Menhaden Management Board, a subset of the Atlantic States Marine Fisheries Commission, approved the use of a new ecological reference point model to inform management that considers menhaden’s role as food for other species such as rockfish and bluefish. Instead of focusing on menhaden abundance as a single species, the model examines the interactions between the tiny silver fish and other key species in the Chesapeake Bay and Atlantic Ocean, where it plays a vital role in the food chain, eating up plankton and being eaten in turn by larger fish and whales.

Using those new reference points, which assume striped bass are also fished sustainably, managers calculated different catch scenarios for the next two years.

Public Comment Guidelines

With the intent of developing policies in the Commission’s procedures for public participation that result in a fair opportunity for public input, the ISFMP Policy Board has approved the following guidelines for use at management board meetings:

For issues that are not on the agenda, management boards will continue to provide an opportunity for the public to bring matters of concern to the board’s attention at the start of each board meeting. Board chairs will use a speaker sign-up list in deciding how to allocate the available time on the agenda (typically 10 minutes) to the number of people who want to speak.

For topics that are on the agenda, but have not gone out for public comment, board chairs will provide limited opportunity for comment, taking into account the time allotted on the agenda for the topic. Chairs will have flexibility in deciding how to allocate comment opportunities; this could include hearing one comment in favor and one in opposition until the chair is satisfied further comment will not provide additional insight to the board.

For agenda action items that have already gone out for public comment, it is the Policy Board’s intent to end the occasional practice of allowing extensive and lengthy public comments. Currently, board chairs have the discretion to decide what public comment to allow in these circumstances.

In addition, the following timeline has been established for the submission of written comment for issues for which the Commission has NOT established a specific public comment period (i.e., in response to proposed management action).

1.   Comments received 3 weeks prior to the start of a meeting week will be included in the briefing materials.

2.   Comments received by 5:00 PM on the Tuesday immediately preceding the scheduled ASMFC Meeting (in this case, the Tuesday deadline will be July 30, 2019) will be distributed electronically to Commissioners/Board members prior to the meeting and a limited number of copies will be provided at the meeting.

3.   Following the Tuesday, July 30, 2019 5:00 PM deadline, the commenter will be responsible for distributing the information to the management board prior to the board meeting or providing enough copies for the management board consideration at the meeting (a minimum of 50 copies).

The submitted comments must clearly indicate the commenter’s expectation from the ASMFC staff regarding distribution.  As with other public comment, it will be accepted via mail, fax, and email.

Atlantic Menhaden Board Meeting Added to ASMFC 2018 Winter Meeting Preliminary Agenda

Atlantic Menhaden Board Votes Against Ecological Management Plan For Fishery

November 17, 2017 — The Atlantic Menhaden Board voted earlier this week to stick to the status quo when managing the menhaden fishery and made slight changes to the annual catch limit. However, Saving Seafood, a group that represents the commercial fishing industry, has mixed feelings about those changes.

Menhaden are a forage fish found across the Atlantic Coast. The Board was considering implementing a new ecological-based management plan that was designed for forage fish.

The plan would have required fishermen to leave enough fish in the water for it to replenish itself and enough for predators to eat. However, the board voted no for the plan because it’s not specifically designed for menhaden.

Bob Vanasse, executive director at Saving Seafood, said the group agrees with the board’s decision.

“I think this was a strong statement that moving forward science needs to prevail, data needs to prevail and we need to look at this complex system in its complexity and not try apply a rule of thumb in every circumstance,” Vanasse said.

The menhaden board also voted to increase the annual catch quota by eight percent.

Political pressure affected quota decision, menhaden industry group charges

November 17, 2017 — A day after the Atlantic States Marine Fisheries Commission voted to raise the catch limit on Atlantic menhaden by eight percent, a trade group claimed on Wednesday that the commission let political pressure affect not only that raise but how quotas were allocated across member states.

The commission’s Atlantic Menhaden Management Board approved an amendment to raise the total catch limit to 216,000 metric tons. However, in doing so, it gave each member state a minimum share of 0.5 percent. While those shares seem small for states that do not have an active menhaden fishery, the Menhaden Fisheries Coalition said it will have a significant impact on the two largest fisheries, Virginia and New Jersey.

Virginia received an allocation of 78.66 percent, while New Jersey got 10.87 percent. No other state received more than 1.27 percent of the allocation.

“The creation of a system allowing non-fishing states to ‘horse-trade’ allocation, the ‘taking’ of quota from some to give to others, and the arbitrary moving of quota from the marine ingredients fishery to the bait fishery constitute inappropriate intrusions into the market economy, our members say,” the coalition said in a press release issued late Wednesday afternoon.
