Fisheries alliance signs pact with NMFS and BOEM

March 29, 2019 — The Responsible Offshore Development Alliance has signed a 10-year collaborative agreement with NMFS and the Bureau of Ocean Energy Management regarding the development of offshore wind energy projects off the East Coast.

The Washington-based alliance represents the seafood and fishing industries and has been working to voice and amplify the concerns of the maritime trades as offshore wind projects are being fast-tracked for approval.

“The fishing industry has expressed its concern about the potential impacts of rapid, large-scale wind energy development to coastal communities and sustainable fishing practices,” said Annie Hawkins, executive director of the alliance. “This agreement paves a way forward for fishing communities to give meaningful input to federal regulators in determining the future of our ocean resources.”

The agreement states that the federal agencies will seek to engage local and regional fishing communities in areas where offshore wind projects are being considered and work together to ensure decisions are made using the best available science. They will also determine how to incorporate industry knowledge into the offshore wind development process.

“Of course, any development on the Outer Continental Shelf must consider how these activities can affect current ocean users and the marine environment,” said BOEM’s Acting Director Walter Cruickshank. “That is why working with federal, state and local agencies, fishing communities, and the public in our process is such an essential part of our renewable energy program. We look forward to working with NOAA and RODA to balance the needs of all ocean users through extensive and continuous engagement.”

Offshore Wind, Commercial Fishing Industries Partnering Up In Unusual Collaboration

January 18, 2019 — The Responsible Offshore Development Alliance (RODA), a group representing fishermen from Maine to North Carolina formed specifically to interact with offshore wind companies, and developer Orsted U.S. Offshore Wind (formerly Deepwater Wind) said the partnership is the first-of-its-kind.

As development of offshore wind farms is underway off of Rhode Island and Massachusetts’ coasts, commercial fishermen have been in talks with developers to figure out the best way to build wind farms that sustain the fishing industry.

However, RODA and Orsted feel the way the industries have been engaging with one another has been inefficient.

“The fishermen are being pulled in a million directions and we’re very excited to have a more structured approach where we can get that input and give it back to the developers as well as to the government,” Annie Hawkins, executive director of RODA, said.

Jeff Grybowski, Co-CEO of Orsted U.S. Offshore Wind, agreed the new partnership will make it easier for the industries to communicate.

“It can often be difficult for a developer to find the right people to talk to because obviously fishermen are, they’re small businesses and some of them are big businesses, but there are lots of different people,” Grybowski said.

Hawkins added the goal is to have fewer, more productive meetings, however any recommendations that come out of them are nonbinding.

Commercial fishermen have raised multiple concerns about offshore wind farms, such as the layout of the turbines affecting their access to fishing grounds and ability to safely return to shore, and spinning turbines interfering with their radar navigation.

Offshore Wind Giant and Fishing Group Agree to Partnership

January 18, 2019 — A new agreement has been announced between a group representing commercial fishermen and the world’s leading developer of offshore wind farms.

The Responsible Offshore Development Alliance and Orstead U.S. Offshore Wind are looking for ways to improve communcation with each other.

Alliance Director Annie Hawkins says the agreement provides a structure to help fishermen give direct input to Orsted.

“Having a structured partnership will create a much better opportunity for fishermen to be involved,” said Hawkins. “It’s a good faith agreement; it provides a forum for the concerns of fishermen to be heard.”

The agreement calls for the creation of a joint industry task force to explore issues like the siting and design of offshore wind facilities.

Hawkins says when it comes to the North Atlantic fisheries, Orsted is still learning. “They are certainly a developer with a lot of experience in offshore wind, but probably a little less experience in dealing with Federal fisheries in the U.S.”

RODA and Ørsted Partner to Address Fisheries and Offshore Wind Coexistence

January 17, 2019 — BOSTON — The following was released by the Responsible Offshore Development Alliance and Ørsted:

The Responsible Offshore Development Alliance (RODA) today announced that it has entered into a partnership agreement with Ørsted U.S. Offshore Wind to improve communications between the commercial fishing industry and offshore wind energy developers.

This first-of-its-kind partnership will create an unprecedented opportunity for commercial fishermen to provide direct input to the wind energy industry on matters of significant interest to their businesses. Under this partnership, both industries will remain autonomous but provide a platform to move towards workable solutions. While non-binding in nature, it is RODA and Ørsted’s hope that discussions will prove beneficial to all parties involved.

“Partnering with Ørsted is a significant step forward as we look to strengthen our ongoing dialogue between commercial fishermen and offshore wind developers,” said RODA Executive Director Annie Hawkins. “RODA believes that we need to develop solutions for offshore wind energy and commercial fishing to coexist, and today’s announcement will support future sustainability for both industries.”

“We are proud to be the first offshore wind developer to partner with RODA, which is an important part to the future of offshore wind,” said CEO of Ørsted U.S. Offshore Wind and President of Ørsted North America Thomas Brostrøm. “The fishing community must be considered as offshore wind development continues in the U.S. Through this partnership, we will be able to share our concerns in a productive way and develop practical solutions as we all seek to coexist and thrive for a better tomorrow.”

RODA is the only national commercial fishing organization that is purpose-built for interacting with the offshore wind industry to maintain sustainable fisheries. Based from Midcoast Maine to the Outer Banks of North Carolina, it also has the broadest geographic and gear-type range of any East Coast fishing industry membership organization active in offshore wind engagement.

The RODA Board of Directors consists of fishing industry representatives who bring over 200 years of combined operational and management experience, split across the range of federally and state-managed Atlantic fisheries. One of RODA’s primary goals is to ensure that the fishing industry’s input at-large is received, considered, and accommodated to the maximum extent possible in leasing, design, construction, and operations of new offshore developments.

This new initiative will provide a more structured process for further collaboration between the two industries.

Ørsted and RODA strongly encourage other offshore wind energy developers and commercial fishermen to join this partnership in order to develop well-informed and enduring approaches to best practices and provide broad representation of the industries.

Offshore wind projects worry Northeast fishermen

June 21, 2018 — A flurry of planned and proposed offshore wind projects in the Northeastern United States is causing anxiety among fishermen, who are worried that the turbines will disrupt marine life, make fishing more difficult, and harm their livelihoods.

The United States’ nascent offshore wind industry is predicted to grow rapidly in the coming years as states create and follow through on requirements to source a greater portion of their energy from clean sources, such as offshore wind.

The first offshore wind project in the U.S. – just five turbines generating 30 megawatts of electricity – came online in December 2016 near Block Island, Rhode Island. In the years to come, many more turbines are expected to crop up on the horizon.

Some fishermen worry the turbines will be too close together, making navigating difficult and possibly dangerous. Others are concerned the turbines will affect ocean currents, and the larvae that are swept up in them. And still others fret about the possibility that undersea electricity transmission will cause behavioral changes in bottom-dwelling creatures.

Earlier this month, a new lobbying group called the Responsible Offshore Development Alliance formed to represent the East Coast fishing industry in discussions over permitting of offshore wind development.

New Lobbying Group Formed by East Coast Fishing Industry to Address Wind Power Concerns

June 11, 2018 — SEAFOOD NEWS — A new lobbying group, the Responsible Offshore Development Alliance, has been formed by the East Coast Fishing industry to represent seafood interests in discussions and permitting around offshore wind development.

One of the criticisms by the industry of offshore development of wind power was that with a localized permitting process, there was no way for the overall fisheries impact of multiple projects to be recognized.

“The current, splintered approaches to engaging fishing communities in the offshore wind leasing process are ineffective and inefficient, and the result is that critical fishing industry expertise is not being considered,” said Anne Hawkins, legal and scientific counsel for RODA. “Fisheries need a unified effort to ensure they get the best possible offshore outcomes.”

Hawkins is a lawyer with Kelly Drye, the firm that has long represented scallopers and other fishing interests in New Bedford and elsewhere along the East Coast.

One of RODA’s first priorities is exploring partnerships with NOAA and the Atlantic states to develop collaborative scientific research. This research would address the lack of peer-reviewed information on the effects of offshore development to fisheries and fish populations. It would also be used to inform offshore developers and regulators in planning sites, awarding leases, designing operations plans, and developing mitigation strategies.

Another principal in the effort is Robert Vanasse, communications and media advisor to RODA. Vanasse founded Saving Seafood, and also works on other East Coast fisheries issues such as Omega Protein’s menhaden fishery.

“The industry needs to speak as one,” said Vanasse. “The offshore wind energy industry, and regulators at the federal, state, and local levels need to hear clearly the concerns of participants in our domestic fisheries.  We will work to foster the productive dialogue among those parties that is urgently needed and sorely lacking.

Specifically, RODA will coordinate engagement between offshore development and affected fisheries to guide the planning of future offshore development sites, and to implement effective operations and mitigation programs for existing sites. By creating a united effort from fishing communities, RODA will facilitate more informed development of shared offshore resources.

With offshore renewable and wind energy development becoming increasingly common on the East Coast, a new alliance has formed to ensure that these developments are compatible with the existing interests of the nation’s fishing communities. The Responsible Offshore Development Alliance (RODA) brings together a broad range of commercial fishermen from across the Northeast and Mid-Atlantic to advocate for their shared concerns over emerging offshore developments.

RODA is seeking to coordinate the efforts of the fishing industry, offshore wind development interests, and federal, state, and local governments to promote effective offshore development policies, and to support more scientific research on offshore development impacts. Current regulatory efforts to assess the impact of offshore development on fisheries have been disconnected. Past offshore projects have not adequately engaged with the fishing industry and the regional fishery management councils, leading to offshore leases being awarded to projects located in prime fishing grounds.

Putting fishermen first: An open letter to Donald Trump

March 23, 2017 — In your campaign, you correctly recognized that many basic industries in the United States — ones that have created stable jobs and communities for generations — have increasingly come under siege. You identified globalization, overzealous regulation, and the past administration’s inclination to advance international policy goals at the expense of domestic jobs, as among the culprits.

Your words struck a chord among many in the commercial fishing industry, where middle class jobs have been hollowed out of the coastal communities. There are many fishing ports around the country that bear witness to this sad fact.

While your policy prescription is general, like advanced cancer treatments, the best cures may be patient-specific.

We’d like in this column to focus on infrastructure, but not infrastructure as it’s generally thought of. There are plenty of fishing vessels available for use. Many issues with fish processing are largely a function of disuse, rather than a lack of capacity. Instead, we respectfully ask you to focus on the intellectual infrastructure of fisheries management.

Among our chief complaints with the administration just past is that it was long on big plans, but short on follow-through. It’s one thing to center fisheries management policy on data-hungry ecosystem management models and complex catch share programs. It’s quite another to implement these regimes effectively.

Maybe worse than being overzealous, fisheries management in the Obama administration became over-ambitious.

A reflexive reaction might be to throw out all regulation, but that’s not the solution, either. Sustainable fisheries do produce more economic benefits. The U.S. Atlantic scallop fishery is but one example of a somewhat flexible management regime producing an ecologically stable fishery. The lean years have become less lean, and the good — even great — years more prevalent. Product quality improved. Scallopers maintained a consistent level of supply when the rest of the world couldn’t or didn’t. Marketplace rewards followed.

Also, and this may be controversial even among our clients, but starving managers of federal funds does not necessarily make them do less. Specifications need to be set each year, and much of fisheries regulation is just keeping up with what’s happening in the ocean. A lack of resources can, however, make them do what they do less well. “Bureaucratic incompetence” can become a self-fulfilling prophesy when there aren’t sufficient funds for data collection and brain power.

Now that draft regional ocean plan is out…

July 19, 2016 — In Commercial Fisheries News May issue, the background, impending release, and need for fishermen to comment on the draft Northeast Regional Ocean Plan were discussed.

The Northeast Regional Planning Body (RPB) is now accepting written comments on the draft ocean plan through July 25, and will host a series of public meetings across the region.

A full list of meetings is provided on the RPB’s website. We encourage you to review the ocean plan and provide comments relevant to your fisheries.

On May 25, the RPB – comprised of six New England states, six federally-recognized tribes, nine federal agencies, and the New England Fishery Management Council – released the nation’s first draft Regional Ocean Plan.

Over four years in the making, and building on the efforts in the region that have occurred over the last decade, the Regional Ocean Plan (the plan) is intended to advance coastal and ocean data, improve engagement with ocean users, and enhance coordination among agencies who manage ocean and coastal resources.

DAVE FRULLA & ANNE HAWKINS: Whither the Lenfest report?

May 20, 2016 — The following is an op-ed by Dave Frulla and Anne Hawkins, published in the June 2016 issue of National Fisherman:

In 2012, the Lenfest Ocean Program commissioned a report entitled “Little Fish, Big Impact,” regarding management of lower trophic level fisheries. Lenfest and other environmental groups followed the report’s publication with a major domestic and international media campaign. If Lenfest wanted to spark scientific debate and inquiry regarding forage fish management, it did a good job. If, however, its plan was to drive a “one- size-fits-all” solution to a complex problem, the results are far less constructive.

The report consisted of a literature review and basic computer modeling to “quantify” the value of forage fish to their predators. It concluded these fish were twice as valuable to other animals as for human nutritional, agricultural and aquaculture uses. The report thus recommended cutting forage fish catch rates between 50 and 80 percent across the board, to double the amount of forage fish left for fish, seabirds and other predators. It also recommended closures for spawning and around seabirds that rely on forage fish, and instructed no additional forage fish fisheries be authorized.

At release, the Lenfest report was received relatively uncritically, despite its far-reaching conclusions and recommendations. Since then, globally preeminent fishery scientists, including some of the Lenfest report’s own authors, have begun to examine the report’s assumptions and conclusions. Despite the report’s confident tone, there is no consensus on whether special management measures will provide any benefit to forage stocks.

Criticism of the Lenfest report can be divided into two main categories: its application to specific forage species, and its general methodology. Regarding application to specific species, it is important first to highlight there is no common definition of “forage fish.” It is, rather, a loosely formed concept, given how many marine organisms (and not just finfish) can be labeled important prey species for a given ecosystem or even for just one species.

Further, not all low trophic species fit the Lenfest report’s biological archetype. For instance, in April 2015, the Atlantic States Marine Fisheries Commission’s Biological Ecological Reference Points Workgroup presented a Memorandum to the Commission’s Menhaden Management Board stating that, “Ultimately, the BERP WG does not feel that the management actions recommended in [the Lenfest report]… are appropriate for Atlantic menhaden specific management,” in part because menhaden do not exhibit the stock-recruit relationship assumed in the Lenfest paradigm. (That is, menhaden recruitment is driven by environmental factors, rather than spawning stock size.)

As to methodology, the Lenfest report largely drew conclusions from ecosystem models that were not designed to evaluate management strategy impacts on low trophic level fisheries. The Lenfest report admits this shortcoming. Indeed, after its publication, Lenfest report authors Tim Essington and Eva Plaganyi co-authored their own follow-up paper showing that among the most common features absent from most of these ecosystem models were natural variability of forage fish stocks, important aspects of spatial structure, and the extent of overlap in size of predator and prey stocks. Regarding the last factor, a predator may eat smaller-sized year classes of prey fish than a fishery targets. Accordingly, humans and the predator fish aren’t competing; the forage species ran the predation gauntlet before being subject to fishing. Overall, Essington and Plaganyi concluded that “most of [the existing] models were not developed to specifically address questions about forage fish fisheries and the evaluation of fishing management.” Model suitability is but one element of the post-Lenfest report work on the scientific agenda for further consideration.

The ultimate question is whether the public, press and fisheries managers will pay attention as fisheries scientists pursue the important questions the Lenfest report raised, but did not resolve. The situation is reminiscent of the debate that occurred following publication by Dr. Boris Worm and other scientists of a 2006 report in Science suggesting all fisheries could collapse by 2048. That report received the same sort of PR roll-out as the Lenfest forage fish report. (We understand Dr. Worm’s work also received Pew Charitable Trusts/Lenfest funding.)

In 2009, Drs. Worm, Ray Hilborn (not a co-author of the initial report), and 19 other scientists collaborated on a subsequent report in Science concluding that existing fishery management tools were reversing the claimed global trend of depletion for individual stocks, and the situation was not so dire as Dr. Worm originally forecast. To this day, though, Dr. Worm’s original report is presented in press and policy debates without mention of his even more significant subsequent collaborative work. We hope the Lenfest report on forage fish management represents one early element — but not the final word — in consideration of the important topic it addresses.
