In a letter submitted to the Atlantic States Marine Fisheries Commission (ASMFC), Peter Himchak, Senior Scientific Advisor to Omega Protein, warned that “there has been an inordinate amount of focus on menhaden generally, and the reduction fishery in particular” in discussions about recent osprey declines in the Chesapeake Bay.
Omega Protein, which processes menhaden into fishmeal, fish oil, and related nutritional products, is supplied by Ocean Harvesters under a long-term harvesting agreement. Himchak submitted the letter on behalf of the company ahead of the ASMFC’s Summer Meeting.
Himchak, who served for 39 years as a fisheries biologist with the New Jersey Division of Fish and Wildlife and as a long-time advisor to both the ASMFC and the Mid-Atlantic Fishery Management Council, sat on the ASMFC’s Atlantic Menhaden Technical Committee and Stock Assessment Sub-Committee from 1988 until 2006.
In the letter, Himchak criticized the ASMFC’s Work Group on Precautionary Management in Chesapeake Bay for proposing “draconian management recommendations ‘without determining if there is or is not an adequate supply of menhaden to support predatory demand in the Bay.’” He warned that moving forward with such actions without first determining whether there are, in fact, fewer menhaden in the Bay or whether the fishery has any impact on osprey “risks gravely impacting a more than 150-year-old industry and hundreds of jobs while doing nothing to improve the osprey situation.”
Himchak wrote that the ASMFC’s Technical Committee (TC) already has a significant workload in advance of the Commission’s Annual Meeting, but raised four areas of scientific inquiry the TC could investigate that would provide the Board with more complete information. 1) He asked whether “the phenomenon of reduced osprey production [is] confined to the times and areas in which the menhaden reduction fishery operates,” referencing USGS data showing declines in osprey abundance in coastal areas of multiple states—not just the Chesapeake—and increases in interior regions. He also noted that the fishery does not begin fishing until May or later—after migrant ospreys arrive in the region from late February to early March and begin building nests from mid-March to mid-April—raising questions about how the fishery could influence osprey’s months-earlier decisions about where to nest.
2) He wrote that there have been sizable increases in populations of multiple menhaden-dependent predators since at least the turn of the century, and that a stomach contents analysis of striped bass, which are only somewhat dependent on menhaden, indicated they “are not starving and would be considered healthy.” Therefore, he asked, “is it more likely that ospreys are being outcompeted or that the reduction fishery uniquely impacts osprey?”
3) Regarding eagle-osprey interactions, he noted a recent Maryland DNR release announcing “large increases in the state’s bald eagle population.” He referenced myriad studies finding that bald eagles are “kleptoparasitic”—a term used to describe their well-documented habit of attacking hunting osprey to steal their food or prey on adults, young, and eggs. Citing a study from Voyageurs National Park, he wrote that “increased numbers of eagles were associated with a reduction in the numbers of osprey nests, their nesting success and heronry size,” and asked whether “issues of competition and depredation [can] be ruled out as a cause of osprey’s lack of breeding success.” He further pointed to “significant scientific and anecdotal evidence of the dominant and adverse impacts eagles have on osprey.”
That concern was echoed in a newly released Saving Seafood special report titled “Bald Eagle Recovery in Chesapeake Bay Raises Red Flags for Osprey.” The report compiled over three decades of peer-reviewed research, field observations, and published accounts documenting instances in which eagles had a negative impact on osprey populations. In one study, researchers found “eagle abundance was negatively associated with nest reuse (i.e., persistence) and success of ospreys.” Significantly, the researchers found “little evidence of bottom-up limitations,” such as poor weather or declining fish stocks, and emphasized the role of eagle aggression, including harassment and food theft. While this body of research does not prove the resurgence of bald eagles in the Chesapeake to be the cause of osprey reproduction issues, it does indicate it is a possibility deserving of further investigation.

4) Himchak also asked the Technical Committee to consider whether osprey foraging success is being affected by climate-driven environmental changes, including storm frequency, shoreline hardening, warming waters, or hypoxia. Citing a 2024 study by Bryan Watts, he noted that “deliveries of all forage species to osprey nests declined steadily from 1974 to 2021,” and asked whether “ospreys’ apparent lack of foraging success is tied to changes in local conditions that are impacting either local abundance of forage or osprey’s hunting success.”
He concluded the letter by writing, “The commission must be guided by science. Precipitous actions, taken in the name of precaution, are not always harmless. Neither Ocean Harvesters nor Omega Protein can survive without the current low level of access to the menhaden resource in the Bay. There simply are not enough ‘fishable days’ – that is, days where the weather and sea conditions allow vessels to operate – in a year to safely conduct a profitable fishery solely in the ocean. The menhaden fishery is managed in the most conservative manner in its 150 year or so history, and the reduction fishery is operating at its lowest sustained levels – in the Bay and overall – for as long as we have reliable records (i.e., since the 1950s). Precaution is already the policy. Before taking actions that could cause irreversible economic harm to this historic fishery, the Board should ensure that all reasonable avenues of inquiry into the issues facing osprey are explored.”

July 29, 2025 — More than half of North Carolina’s 20 coastal counties will be represented at the launch of what commercial shrimping advocates envision as an organization poised to fight for the industry in Raleigh.
The inception of the North Carolina Coastal Counties Fisheries Coalition is set to kick off in an Aug. 5 meeting in Morehead City, where coastal-based local and state elected officials and their constituents are invited to converge, discuss and formulate a plan to combat what they deem politically charged threats to commercial fishers.
“Bottom line, simple mission statement: We want to provide fresh, local seafood for our citizens and visitors and protect the livelihoods and families that harvest it,” said Dare County Board of Commissioners Chair Bob Woodard. “We’re going to do everything humanly possible to protect our commercial fishermen.”
The meeting is scheduled for 1 p.m. in the Crystal Coast Civic Center’s main hall, 203 College Circle.
The idea to form a coastwide coalition to defend and protect the state’s commercial fishing fleet sprouted fresh on the heels of a fierce fight that ensued in the North Carolina Legislative Building in late June.
That’s when a last-minute amendment to ban shrimp trawling in inland and nearshore coastal waters was tucked into a House bill originally authored to expand recreational access to southern flounder and red snapper. A companion bill, House Bill 441, was gutted and revised to establish a program that would pay out annual installments over three years to qualifying shrimpers.
July 29, 2025 — Entanglement in fishing gear or marine debris ensnared 64 large whales in U.S. waters during 2023, below the average annual number of cases in recent years but not yet a clear trend, the National Marine Fisheries Service reported.
The National Report on Large Whale Entanglements Confirmed in the United States in 2023 notes the 64 confirmed large whale entanglement cases nationally was less than 67 confirmed large whale entanglement cases in 2022.
“It is also below the average annual number of confirmed entanglements over the previous 16 years (which was 71.8),” according to a July 28 summary from the agency. “We will continue to analyze data from 2023 to understand whether this dip is temporary or part of a longer-term downward trend.”
Along with ship strikes, entanglements are a threat to individual whales and threatened or endangered species, such as the North Atlantic right whale with a population now estimated at only around 370 animals.
Reducing that danger to meet NMFS’ mandates under the Marine Mammal Protection Act drives management actions on the East, Gulf and West coasts, including changes to fishing seasons, gear restrictions and efforts to develop and test so-called ropeless gear in fisheries.
According to a NMFS breakdown of 2023 confirmed entanglement cases, 61 cases or 95 percent involved live animals, and three were whales found dead and floating when initially reported. The 2023 cases were lower than the average annual number of 71.8 confirmed entanglements from 2007–2022.
Four species of large whales were documented with 2023 entanglements in U.S. waters: humpback whales, gray whales, minke whale and North Atlantic right whales.
July 29, 2025 — Trawling near Antarctica for krill — a crustacean central to the diet of whales and a critical buffer to global warming — has surged to a record and is fast approaching a never before reached seasonal catch limit that would trigger the unprecedented early closure of the remote fishery, The Associated Press has learned.
The fishing boom follows the failure last year of the U.S., Russia, China and two dozen other governments to approve a new management plan that would have mandated spreading out the area in which krill can be caught and creating a California-sized reserve along the environmentally sensitive Antarctic Peninsula.
In the first seven months of the 2024-25 season, krill fishing in Antarctica reached 518,568 tons, about 84% of the 620,000-ton limit that, once reached, will force the fishery to automatically close. In one hot spot, the catch through June 30 was nearly 60% higher than all of last year’s haul, according to a report from the Commission for the Conservation of Antarctic Marine Living Resources, or CCAMLR, the international organization that manages the world’s southernmost fishery.
July 29, 2025 — Lawmakers in U.S. Congress will consider several fisheries provisions in the U.S. Department of the Interior budget bill, with each legislative body proposing different levels of funding for the National Fish Hatchery System, fish conservation, and stopping the spread of invasive species.
Though currently on vacation, both the U.S. House and the U.S. Senate are in the midst of the fiscal year 2026 budget process, which involves passing several massive appropriations that offer varying levels of policy guidance to the federal government.
July 29, 2025 — Maine’s plan to install GPS tracking devices on all lobster boats and monitor their exact location at all times went before the First Circuit Monday, but the court seemed unconcerned that this could be an invasion of the fishermen’s privacy.
“It makes sense to me,” U.S. Circuit Judge Seth Aframe said at oral argument.
The devices are required on all commercial lobster boats and record the boats’ location every minute at sea and every six hours on shore. They can’t be turned off, and they record all activity, even if the boat is being used for recreational or other non-commercial purposes. They’re Bluetooth-compatible and can collect audio information, although the state denies that it’s secretly recording anyone’s conversations.
Five lobstermen challenged the rule in court, claiming it was an unreasonable search under the Fourth Amendment. A trial judge upheld the Maine rule under existing precedent for administrative searches but found the issue so disturbing that he took the unusual step of recommending an appeal to the First Circuit.
The mariners immediately ran into choppy seas before the three-judge panel, however, as the judges credited the state’s claim that it needed to track lobster stocks and protect against interference with whales.
“The lobster stock is changing dramatically,” explained Sean Donahue of Donahue, Goldberg & Herzog in Washington, D.C., representing the Atlantic States Marine Fisheries Commission. “In New York, the catch is 3% of what it was 20 years earlier. In Maine, there’s a clear movement toward colder waters. The data require careful assessment, and this is critical.”
July 29, 2025 — New Bedford’s long-running tradition of honoring its commercial scallop fishery will take center stage once again on August 14 during “Scallopalooza,” a new community event organized by the New Bedford Fishing Heritage Center (FHC).
Scheduled from 5-8 p.m. during the city’s August AHA! Night, Scallopalooza will host a shucking contest featuring 15 local scallopers. The competition is set to begin at 6:30 p.m. in the center’s parking lot on Bethel Street, which will close to traffic at 1 p.m. that day for vendor and stage setup.
While the shucking contest is the main draw, the event will also showcase the broader culture and industry that surrounds the region’s scallop fishery, FHC said in a press release. Attendees can expect live music, food vendors, and educational demonstrations and exhibits that highlight the city’s working waterfront. The indie rock band Immuter will kick off the evening with a set at 5 p.m., followed by an artist talk with Michael Medeiros at 5:30 p.m. and a scallop dredge link squeezing demo by Blue Fleet Welding at 6 p.m.
July 28, 2025 — Kauaka Petaia guided his motorboat out of Tuvalu’s main lagoon at dawn and into the vast Pacific Ocean, where he and his nephew scanned the rolling horizon for signs of their country’s most precious resource: tuna.
They searched for more than two hours before finally spotting seagulls circling in the distance. Petaia threw open the throttle as his nephew, Ranol Smoliner, tossed a hooked line into the water. Soon, the younger man felt the tug of a 25-pound yellowfin, which he pulled up and bashed with a club. By morning’s end, the pair had caught eight tuna — a haul far smaller than when Petaia’s father taught him to fish 30 years earlier.
“We have to spend longer and go farther to get them,” the 48-year-old said as the fishermen unloaded their catch.
“I’m not sure there will be any tuna left by the time I’m my uncle’s age,” added Smoliner, 22.
Tuna is a pillar of life in the Pacific, where for centuries people have braved the ocean to bring back yellowfin, skipjack, bigeye and albacore for their families.
In recent decades, as global demand for tuna has soared, Pacific island nations including Tuvalu have propped up their struggling economies by selling licenses to allow international fishing companies to trawl their vast exclusive economic zones. These seas provide as much as one-third of the world’s tuna supply.
But climate change is warming the world’s oceans at an accelerating rate, threatening livelihoods.
Scientists predict that climate change will push tuna away from Pacific island nations and toward the high seas, where wealthier countries with large fishing fleets – China, Japan, South Korea and the United States – will catch them without paying license.
