    Court denies fishing interests opportunity to question officials in regulations flap
    NEW BEDFORD — In a serious setback for the city's fishing interests, a federal district court judge has denied New Bedford, Gloucester and others who filed suit against new fishing regulations the chance to interview officials involved in writing and imposing the new rules.

    EarthJustice and Oceana file motions against Seattle fishing industry and Alaska government
    JUNEAU, Alaska - February 3 - Oceana and Greenpeace, represented by Earthjustice, filed motions in the United States District Court for the District of Alaska in support of conservation measures implemented by the National Marine Fisheries Service to protect the Steller sea lions. The measures restrict fishing by large bottom trawl vessels in certain areas of the western and central Aleutian Islands. These factory trawlers compete with sea lions for food and leave inadequate fish to support sea lion reproduction and recovery. The western stock of Steller sea lions has declined by almost ninety percent in waters with large-scale commercial fishing.

    EarthJustice files Amicus Brief for CCCHFA Sector; Says Cities' Claims are "without merit"
    BOSTON - Feb. 5, 2011 - Yesterday, shortly before Federal District Court Judge Rya Zobel issued a number of orders in the case of City of New Bedford, et. al. v. Honorable Gary Locke, etc. et al.,  the Georges Bank Cod Fixed Gear Sector filed a motion to Participate as Amicus Curiae in the litigation.

    The Cape Cod Commercial Hook Fishermen’s Association (CCCHFA) website describes the  Georges Bank Cod Fixed Gear Sector  as a "pioneer of the sector system."  According to the CCCHFA, "the Hook Association established its first 'harvesting cooperative' for fishermen using hook gear in 2004. A second Hook-sponsored sector, comprised of fishermen using both hooks and gillnets, was approved in 2006. This year, the two groups combined to form the Georges Bank Fixed Gear Sector."

    The Georges Bank Fixed Gear Sector is represented by EarthJustice, of 1625 Massachusetts Avenue, N.W. Washington, D.C. 20036.   Attorneys Roger Fleming, Erica Fuller and Stephen Roady of EarthJustice filed, the motion.  The attorneys from EarthJustice also requested permission to participate if oral argument takes place.

    Federal Judge Allows Amicus Briefs, Denies Discovery Without Explanation in Amendment 16 Lawsuit
    BOSTON - Feb. 4, 2011 - United States District Court Judge Rya Zobel today issued a number of orders in the case of City of New Bedford, et. al. v. Honorable Gary Locke, etc. et al.

    With some qualifications the judge allowed the various organizations and individuals who have asked to submit amicus briefs. The judge denied the petition of Food and Water Watch to intervene as a plaintiff, but allowed the group to file an amicus brief.

    However, the judge denied the plaintiffs' motions for discovery without explanation. The last sentence of her order stated merely "Two motions for discovery by plaintiffs (Docket ## 33 and 39) are denied."  

    While Federal Judges are not required to explain their action,  Saving Seafood has asked Judge Zobel's clerk for a statement from the judge explaining her reasoning.
